HomeMy WebLinkAbout09/18/1967 Business Meeting ii SEPTEMBER 1$, 1967 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, Lynch, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. , _ The Invocation was given by Councilman Brown. II The minutes of the regular meeting of September 11, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. A Resolution fixing the time for a hearing by the Council, on Petition No. 533, filed by Phillip J. Robillard and Others, requesting vacation of a portion of Bell Avenue, having been ordered out at the last regular•.meeting on September 11, 1967, it was MOVED by Robin- . son, seconded by Lynch that Resolution No. D -1119 fixing October 9, 1967, as the time for said Hearing, and that notice of such Hearing be given as required by law, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. • RESOLUTION NO. D -1119, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 950, • Fairbrook Addition and Other Sewers, and there being no protests in writing or otherwise, it was MOVED by Brown, seconded by Lambert that Ordinance No. 955 confirming the assess- ment roll and every part thereof, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll .call. " ORDINANCE NO. 955, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 950 as created and established by Ordinance No. 773 of the Ordinances of the City of Yakima. . Petition No. 554, Notice of Intention to Commence Annexation Proceedings, having been . filed with the City Clerk on September 11, 1967, by Emery E. and Evelyn V. Blakely, re- questing annexation of property located at 1110 St. Johns, it was MOVED by Robinson, seconded by Lynch that this date be set as the time for a meeting with the initiating party who signed the Notice of Intention to Commence Annexation Proceedings dated September 11, 1967: carried, Brown, Kurbitz, Lambert, Larson, Lynch; McNeice and Robinson voting aye by voice vote. Mrs. Evelyn V. Blakely, indicating that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was duly moved, seconded and . passed that the annexation proposed by petition no. 554 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above Motion was made by Robinson, seconded by McNeice and carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. An Ordinance appropriating 53,000 for hot water tank replacement in City Hall, having been read in its entirety, was ordered laid on the table for one week or until the next regular meeting of the City Council on September 25, 1967. MOVED by Lynch, seconded by McNeice that Resolution No. D -1120 requesting the Auditor to hold a special election on whether or not a CATV franchise shall be granted to Independent Cablevision of Yakima, Inc., be passed as read. City Attorney Andrews explained that on September 13, 1967, an initiative petition and form of proposed ordinance were filed with the City Clerk, which petition contains sufficient signatures to require the City Council to take some action. After due discussion,Mayor Larson called for the roll call vote on the Motion to pass Resolution No. D -1120 and it carried: Brown, Kurbitz, Larson, Lynch and McNeice voting aye on roll call. Councilmen Lambert and Robinson asked to be excused from voting on this matter because of a conflict of interests. . RESOLUTION NO. D -1120, A RESOLUTION providing for the submission to the electors of Yakima, Washington, at a special election, of a proposition as to whether or not a CATV franchise shall be granted to Independent Cablevision of Yakima, Inc.; and requesting the Auditor of Yakima County, Washington to hold a special election. MOVED by Lynch, seconded by Brown that Resolution No. D -1121 requesting the Auditor to hold a special election on whether or not a CATV franchise shall be granted to Cable TV of Yakima Valley, Inc., be passed as read. City Attorney Andrews explained that on•September 14, 1967, an initiative petition and form of proposed ordinance were filed with the City Clerk, which petition contains sufficient signatures to require the City Council to take some action. MOVED by Lambert, seconded by Robinson that Resolution No. D -1122 authorizing the execution of a license agreement with the Federal Government for use of the Marine Corps Reserve Training Center by the Yakima Police Department, be passed as read: carried, Brown, Kur- bitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. City Attorney Andrews explained that this is a renewal of the present agreement which expires on October 14, 1967, and will be renewed for five years to expire on October 14, 1972. RESOLUTION NO. D -1122, A RESOLUTION authorizing and 'directing the City Manager of the City of Yakima to accept a license granted by the Federal Government for the use by the Yakima Police Department of the Marine Corps Reserve Training Center. MOVED by Brown, seconded by Lambert that Resolution No. D -1123 authorizing the payment of moving expenses for the City Manager, Craig McMicken, in the amount of $$26.15, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D- 1123, A RESOLUTION authorizing the payment of moving expenses incurred by Craig McMicken, City Manager. " ' • 329 SEPTEMBER 18, 1967 MOVED by Robinson, seconded by Lambert that Resolution No. D -1124 authorizing the filing of an application with the Department of Housing and Urban Development, for a grant to aid in financing the construction of domestic water treatment facilities, etc., be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. City Attorney Andrews explained that this Resolution authorized the filing of a revised application and to change . the name of the Yakima City Manager to Craig McMicken on such application and information furnished to the Department of .Housing and Urban Development. . RESOLUTION NO. D -1124 authorizing filing of an application with the Department of Housing and Urban Development, United States of America, for a grant under P. L. 89 -117. A progress report of construction work done by Cook -Lewis Co. on the Airport Office Build- ing for the month of August having been approved for payment by R. S. Cameron, Architect, for this project, it was MOVED by Lynch, seconded by Robinson that said report with res- pect to the progress on this project be approved and that the estimate of $13, be approved and payment of the same authorized: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. An application for a sewer hookup outside the Yakima City Limits having been filed with the City Clerk on September 14, 1967, by Warren G. Kimmel, 1222 S. 44th Avenue, it was MOVED by Robinson, seconded by Brown that this outside hookup be granted when and if the outside hookup agreement is signed by the applicant: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. A damage claim, having been filed with the City Clerk on September 13, 1967, by Errol Rhode, 1806 S. llth Avenue, in the amount of $30.11 for damages to his property caused by the Contractor doing work for the City, it was MOVED by Lynch, seconded by McNeice that said damage claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Bids were received and considered by a Bid Board on this date for additions and alterations to the Yakima Airport Terminal Building as follows: W. M. Yeaman, Yakima $174,790.00 Cook -Lewis Co., Yakima 178,000.00 R.E.W., Inc., Yakima 178,800.00 . Corpman Construction, Yakima 180,950.00 H. J. Templeton, Yakima 181,467.00 J. A. Jones Construction Co., Kennewick 187,848.00 all plus Sales Tax, Architect's Fee and Contingencies Villesvik & Smith, Architects on this project, recommending that W. M. Yeaman, having sub- mitted the low bid, be awarded the contract, it was MOVED by Robinson, seconded by Lynch that Villesvik & Smith's recommendation be accepted and the bid be awarded to W. M. Yeaman in the amount of $205,134.55, which includes the basic bid of $174,790.00 plus 42% Sales Tax of $7,865.55, Architect's Fee of 10 %, $17,479.00, and Contingencies - $5,000.00, and that the City Manager be and is hereby authorized to enter into a contract with said con- tractor upon the filing of the proper bond and insurance: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Mr. Lawrence Robinson stated that a Petition requesting the amending of the Charter of the City of Yakima regarding fluoridation of City water system, and requesting that this matter be submitted to the voters at the next General Election on November 7, had been filed with the City Clerk on September 15, 1967, and he and his committee are wondering what action is to be taken. City Attorney Andrews explained that there are some technicalities regarding this petition that must be cleared up and that he will meet with the people concerned to explain what must be done to get this on the November 7 ballot, and that it is his under- standing that this City Council meeting will be recessed to Thursday morning, at which time this matter and others will be handled. City Manager McMicken reported that as a matter of information he has appointed Mr. Ed Loidhamer of the Planning Department as Acting Director of Planning, since Rudolf Gast, former Planning Director, has left the employ of the City of Yakima and he feels it is important that there be an Acting Planning Director, and that he will ask that the Planning Commission appoint Mr. Loidhamer as Secretary of the Planning Commission. City Manager McMicken referred to his memorandum to the Council members regarding his review of the City Administration, stating that he feels it is his responsibility to review all aspects of City Administration and will report to the Council from time to time. City Manager McMicken requesting that he be authorized to attend the Conference for Public Officials on Collective Bargaining at Tacoma, Washington, October 26 - 28, 1967, at an approximate cost of $60.00, it was MOVED by Lynch, seconded by Lambert that said travel be allowed with expenses paid: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. It was pointed out that since this trip is within the state, authorization by the Council is not necessary. There being no further business to come before the Council, it was MOVED by Kurbitz, secon- ded by Lynch that we do now recess at the hour of 8:45 P.M. to continue on Thursday morning, September 21, 1967, at the hour of 8:30 A.M.: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. SEPTEMBER 21, 1967 (The City Attorney deemed it advisable in the handling of the meeting of the fluoridation petition and the annexation, to go through the formality of calling a special meeting by notifying each Councilman in writing, which was done, and due notice was handed to each Councilman by the City Clerk on September 19, 1967, and a press notice of the Special Meeting of the Yakima City Council was mailed to the following Radio Stations and the Yakima Daily Republic and the Yakima Morning Herald: KIMA Radio, KBBO Radio, KQOT Radio, KUTI Radio, KIT Radio, KNDX -FM Radio, KIMA TV, AND KNDO TV.)
