The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Lambert, Lynch, McNeice and Robinson, Acting City Manager Friedline and City Attorney Andrews present on roll call. Councilman Kurbitz absent on roll call. It was MOVED by Robinson, seconded by Lambert that Councilman Kurbitz be excused from this meeting: carried, Brown :,; Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of August 21, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Resolution No. D -1105, a resolution of inten- tion to improve property by constructing water mains to serve Valley View Estates, and there being no protests in writing or otherwise, it was MOVED by Brown, seconded by McNeice that Ordinance No. 950 creating L.I.D. No. 966, Valley View Estates Domestic Water District, be passed as read: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz absent. Public Works Director John Mayo explained that Lee Campbell, Glascam Builders, owns all of this property, and the final plat cannot be filed until the water main is in. ORDINANCE NO. 950, AN ORDINANCE providing for the improvement of certain property by con - structing the necessary mains, fire hydrants, valves and other appurtenances for the pur- pose of supplying water for domestic use and fire protection; establishing a Local Improve- ment District, providing for the method of payment thereof, and creating a special fund. Petition No. 551, having been filed with the City Clerk on August 21, 1967, by Howard W. McNeice & Others, requesting that Mayfair Market at 28th Avenue and Nob Hill Blvd., be restrained from using their incinerator stating it is a public nuisance, it was MOVED by Lynch, seconded by McNeice that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Kurbitz absent. Acting City Manager indicated that it might . take several weeks to investigate this matter, but that a report should be ready for the Council by September 18, 1967. Petition No. 552, having been filed with the City Clerk on August 23, 1967, by Tony Novobielski & Others, requesting improvement of property by the paving of the Alley between 13th and 14th Avenues - Walnut to Spruce Street, it was MOVED by Robinson, seconded by . Lynch that said Petition be referred to the City Manager and Staff for study and recommenda- tion: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Kurbitz absent. MOVED by Brown, seconded by McNeice that Ordinance No. 951, relating to parking of vehicles on certain streets and amending the Yakima Municipal Code, be passed as read: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz . absent. Public Works Director John Mayo explained that this Ordinance adds four more <,,` streets to the Ordinance that regulates the parking on certain streets now in effect. (No �) ORDINANCE NO. 951, AN ORDINANCE relating to traffic regulations; regulating and . restricting the stopping, standing and parking of motor vehicles; and amending Section 9.36.070 of the City of Yakima Municipal Code. MOVED by Brown, seconded by Lambert that Ordinance No. 952 relating to prohibiting the un- lawful discharge of firearms and amending the Yakima Municipal Code, be passed as read: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz absent. City Attorney Andrews explained that this Ordinance amends the Code by adding the words "without lawful authority" to the existing Ordinance. He further explain- ed that this change was made necessary because the Municipal Court had ruled the existing Ordinance invalid because it makes no exception for police officers, or anyone else having lawful authority for the firing of firearms. ORDINANCE NO. 952, AN ORDINANCE relating to public safety and morals; prohibiting the un- lawful discharge of firearms; amending Section 6.04.110 of the City of Yakima Municipal Code; and declaring an emergency. MOVED by Lambert, seconded by Robinson that Ordinance No. 953 relating to dumping garbage and refuse at the sanitary land fill, specifying a dumping fee and amending the Yakima Municipal Code, be passed as read. Acting City Manager explained that this Ordinance amends the Code by changing the fee paid by Eichler Garbage Service from S8,800 to S15,000 per year. He further stated that this matter has been studied and discussed by the Council members and with Eichler Garbage Service. Mr. Hein, representing Eichler Garbage Service, stated that he thinks this should be further discussed with the people involved, as he feels that this is too large a raise in their fee and they would have to raise their cus- tomers' fees and because of this might lose some customers. Public Works Director John Mayo stated that there has been a meeting between City officials and Eichlers and it was his belief that Eichlers were willing to accept this agreement. He further stated that Eichlers have been offered the opportunity to establish their own land fill, but they seemed to feel that they were better off with the City. Mr.. Mayo stated that the raise in fee asked for is to help cover operating costs of the land fill and to buy more land, and that this fee should have been raised sooner. Council members, indicated that although they do not like to have to raise fees like this, feel it is necessary, and indicated that Eichlers could at any time that they can prove this fee is too high, thereby making them lose customers, or for any other reason, ask that this matter be reconsidered. After due discussion, Mayor Larson called for the roll call vote on the Motion to pass Ordinance No. 953 as read, and it carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz absent. Councilmen Brown, Lynch and McNeice stated that they are . voting aye reluctantly. ORDINANCE NO. 953, AN ORDINANCE relating to health and sanitation, specifying hours for dumping garbage and refuse at the sanitary land fill by a licensed collector; specifying a dumping fee to be paid by a licensed collector; and amending Subsection 4.16.180(h) of the City of Yakima Municipal Code. . 322 AUGUST 28, 1967 MOVED by Robinson, seconded by Lynch that an Ordinance relating to the distribution of handbills and amending the Yakima Municipal Code, be passed as read. City Attorney Andrews explained that the Code now prohibits the distribution of handbills, and the request has been made through him to the Council concerning the distribution of handbills, II that the Code be amended to allow the distribution of handbills on private property. After due discussion, it was MO by Lynch, seconded by McNeice that action on said Ordinance be postponed for two weeks or until September 11, 1967, so that this can be studied further: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Kurbitz absent. MOVED by Robinson, seconded by Lambert that Resolution No. D -1113 authorizing the execution of a Collective Bargaining Agreement between City Employees and their Union, be passed as read: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz absent. Mr. Chet Hanson, local Union representative for the Yakima County and City employees, was present to answer any questions regarding this agreement. RESOLUTION NO. D -1113, A RESOLUTION authorizing and directing the Acting City Manager and City Clerk of the City of Yakima to execute a Collective Bargaining Agreement with The Washington State Council of County and City Employees, and Local 1122 of the American Federation of State, County and Municipal Employees, AFL -CIO. A Damage Claim, having been filed by Rudolph F. Roxtrom, it was MOVED by McNeice, seconded by Lynch that said claim be referred to the City Manager and Staff for study and recommenda- tion: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Kurbitz absent. There being no further business to come before the Council, it was MOVED by Lynch, seconded by McNeice that we do now adjourn at the hour of 4:25 P.M.: carried, Brown, Lambert, Larson Lynch, McNeice and Robinson voting aye by voice vote.
