Roll Call Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Holly Cousens (attending remotely via Zoom), Eliana Macias and Danny Herrera Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Clear Tee 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Proclamations Hispanic Heritage Month proclamation Mayor Janice Deccio proclaimed September 15th through October 15th, 2022 as Hispanic Heritage Month and Magaly Solis, Executive Director of La Casa Hogar, and others from La Casa Hogar accepted the proclamation. B. Presentations/ Recognitions/ Introductions Recognition of Joan Davenport for 35 years of service City Manager Harrison recognized Community Development Director Joan Davenport for 35 years of service to the City of Yakima. ii. West Valley School District update Dr. Peter Finch, Superintendent, gave an update on West Valley School District activities. C. Appointments to Boards, Commissions and Council Committees Page 1 of 6 35 Appointment to Parks& Recreation Commission MOTION: Cousens moved and Byers seconded to appoint Mariah Cornejo to the youth position on the Parks & Recreation Commission. The motion carried by unanimous vote. 5. Council Reports A. Lodging Tax Advisory Committee Report Councilmember Byers and John Cooper, President and CEO of Yakima Valley Tourism, reported on the Lodging Tax Advisory Committee recommendations for the 2023 Lodging Tax allocation. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Lund moved and Brown seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the August 16, 2022 City Council regular meeting and August 29, 2022 City Council special joint meeting with the Yakima School District B. Set date of September 20th, 2022 for a public hearing regarding a 2022 Justice Assistance Grant C. Set Date of September 20, 2022 to consider a Notice of Intent to Commence Annexation D. Set October 4, 2022 as the public hearing date to consider the Yakima Planning Commission's recommendation on one (1) Comprehensive Plan map amendment application E. Resolution authorizing a contract with Central Washington Asphalt for the Summitview Avenue Resurfacing Project 2566 RESOLUTION NO. R-2022-111,A RESOLUTION authorizing an agreement with Central Washington Asphalt for Summitview Avenue Resurfacing Project 2566. F. Resolution authorizing an agreement with HLA Engineering and Land Surveying, Inc to provide Professional Construction Management, Observation and Administration Services for the Summitview Ave Project 2566 RESOLUTION NO. Resolution authorizing a contract with Apex Mechanical LLC for the Lions Pool Facility Air Handling & Dehumidification System Improvements Project 2600 RESOLUTION NO. R-2022-114,A RESOLUTION authorizing a Contract with Apex Mechanical LLC for the Lions Pool Facility Air Handling and Dehumidification Project 2600. I. Resolution authorizing two contracts with Pacific Northwest Theatre Associates for the Capitol Theatre Curtain Replacement Project 2569 RESOLUTION NO. R-2022-115,A RESOLUTION authorizing two Agreement with Pacific Northwest Theatre Associates (PNTA)for Capitol Theatre Curtain Replacement Project 2569 J. Resolution authorizing an agreement with OIC of Washington for$102,591.00 of CDBG funding for youth programming and services at the Henry Beauchamp Community Center(HBCC) RESOLUTION NO. R-2022-116,A RESOLUTION authorizing an agreement with Opportunities Industrialization Center of Washington (OIC) in the amount of One Hundred Two Thousand Five Hundred Ninety-One dollars ($102,591) in Community Development Block Grant funds to provide youth services and programming in Yakima at the Henry Beauchamp Community Center. 7. Public Comment None. PUBLIC HEARINGS 8. Closed record public hearing and Resolution to consider the Yakima Planning Commission's recommendation regarding the preliminary plat of"Apple Tree Phase 1 C" submitted by Kinloch Borton Enterprises located in the vicinity of Occidental Rd & S 96th Ave Senior Planner Eric Crowell briefed Council on the public hearing. Mayor Deccio opened the public hearing and, with no one coming forward to speak, closed the hearing. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-117,A RESOLUTION approving the Preliminary Long Plat of Apple Tree Phase 1 C, a four-lot subdivision with one tract (a further subdivision of PSP#004- 21, which created nine lots), located in the vicinity of S. 96th Ave. and Occidental Rd. 9. Public hearing to consider: A) Resolution adopting the amended Six-Year Transportation Improvement Program for the period of 2023 through 2028, and to amend the Transportation Systems Plan 2040; and B) Resolution amending the Yakima Urban Area Comprehensive Plan Capital Facilities Element City Engineer Bill Preston briefed Council on the hearings. R-2022-118,A RESOLUTION amending the adopted Six-Year Transportation Improvement Program(TIP)for the period of 2023 through 2028 and amending the Transportation Systems Plan 2040. RESOLUTION NO. R-2022-119,A RESOLUTION to amend the Yakima Urban Area Comprehensive Plan Capital Facilities Element to incorporate the amended Six-year Transportation Improvement Program(TIP)for the period of 2023 through 2028. DEPARTMENT ITEMS 10. Millennium Plaza Restoration Update Senior Training Coordinator Jenn Zeutenhorst, Parks and Recreation Manager Ken Wilkinson and Consultant Andy Granitto provided a PowerPoint presentation on restoration efforts and progress at Millennium Plaza. 11. Resolution declaring the property located at 501 South 12th Street, Yakima, Washington, to be surplus, and authorizing disposition of such parcel to Douglas H. Lemon upon mutually acceptable terms and conditions City Attorney Sara Watkins reported the City has been evaluating City owned properties and whether they should be disposed of for various purposes. After evaluating the property at 501 South 12th Street, which is a vacant lot, it was determined by staff that it would be an appropriate lot to surplus. The City Clerk read the resolution by title only. MOTION: Cousens moved and Brown seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION 2022-120,A RESOLUTION declaring the property located at 501 South 12th Street, Yakima, Washington, to be surplus to the uses and needs of the City of Yakima, and authorizing disposition of such parcel to Douglas H. Lemon pursuant to RFP 12233P and upon mutually acceptable terms and conditions. 12. Resolution awarding RFP 12233P to Douglas H. Lemon for Development of City-Owned Property located at 501 S 12th Street, Yakima, WA Mayor Deccio reported item 12 would be considered before item 11 based on Legal advice. City Attorney Sara Watkins briefed Council on the award of surplus property. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-121,A RESOLUTION awarding RFP 12233P to Douglas H. Lemon for Development of City-Owned Property located at 501 S 12th Street, Yakima, WA. Resolution authorizing a helicopter landing at a portion of property at 1007 River Road, as provided in Yakima Municipal Code 6.32.040 Brooke Hargreaves, Senior Assistant City Attorney, reported on the application for a Modification to Existing or Approved Uses or Development to use a section of land at 1007 River Road for helicopter departures and landings. The City Clerk read the resolution by title only. MOTION: Brown moved and Byers seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-122,A RESOLUTION authorizing a helicopter landing at a portion of property at 1007 River Road, as provided in Yakima Municipal Code 6.32.040, Establishing landing or flying fields-Permit. 14. Ordinance amending YMC 5.96 Ambulance Services Fire Chief Markham reviewed an amendment to the ambulance ordinance. The City Clerk read the ordinance by title only. MOTION: Brown moved and Lund seconded to pass the ordinance. The motion carried by unanimous vote. ORDINANCE NO. 2022-025,AN ORDINANCE amending the City of Yakima Municipal Code Chapter 5.96 Ambulance Service 15. Ordinance amending the 2022 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2022 for various purposes (First Reading) Jennifer Ferrer-Santa Ines, Director of Finance and Budget, briefed Council on the first reading of the budget amendment, noting it will be brought back for a second reading at the next business meeting. The City Clerk read the ordinance by title only. First reading of an ordinance amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2022 for various purposes. CITY MANAGER UPDATE 16. Appointment of Aryn Masters as Municipal Court Judge City Manager Harrison reported the Yakima Municipal Court will be undergoing significant personnel changes in 2023 with both Judge Kelly Olwell and Judge Susan Woodard retiring from the bench. Mr. Harrison noted under Section 1.60.040 of the Yakima Municipal Code, the City Manager recommends judicial appointments to the City Council who is responsible for ratification to the position of judge. The appointment is valid until the next Municipal election in November 2023. MOTION: Cousens moved and Lund seconded to confirm the appointment of Aryn Page 5 of 6 39 Masters as Municipal Court Judge effective January 18, 2023. The motion carried by unanimous vote. 17. Review dates and times for 2023 Annual Budget Study Sessions- October 4, 6 and 11, 2022 It was Council consensus to hold budget meetings from noon to 3:00 p.m. instead of 9:00 a.m. to noon. 18. Review and update study session schedule City Manager Harrison reviewed the study session schedule with Council. There were no changes. 19. Other Business A. Executive Session to review the performance of a public employee per RCW 42.30.110 (1)(g) MOTION: Lund moved and Byers seconded to postpone executive session to review the performance of a public employee. The motion carried by unanimous vote. 20. Adjournment MOTION: Lund moved and Byers seconded to adjourn to a City Council study session on September 13, 2022, at 5:00 p.m. in the Council Chambers. The motion carried by unanimous vote.
