HomeMy WebLinkAbout07/24/1967 Business Meeting • 3® July 24, 1967 The City Council met in regular session, Mayor Larson presiding, Councilman Brown, Kurbitz, Lambert, Lynch, McNeice and Robinson, Acting City Manager Friedline and City Attorney Andrews present on roll call. The Invocation was given by Councilman Brown. The minutes of the regular meeting of July 17, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 536, filed by Dale E. Miller & Others, requesting rezone of property located at 301, 303, 305, 307, 309 and 311 S. llth Avenue, and there being no protests in writing or otherwise, it was MOVED by Brown, seconded by Lambert that Ordinance No. 940 accepting the recommendation of the Planning Commission and rezoning said property, be passed as read: carried,' Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 940, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 301, 303, 305, 307, 309 and 311 South llth Avenue, in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -1, Modified Business Zone. Petition No. 541, having been filed with the City Clerk on July 17, 1967, by Arthur E. Church for Yakima School District No. 7, requesting improvement of property by the con- struction of curbs, gutters and surfacing of certain streets between Pleasant Avenue and King Street, and Petition No. 544, having been filed with the City Clerk on July 20, 1967, by Ralph Loomis, requesting improvement of property by the construction of a sewer:to serve property located at 5603 W. Lincoln, it was MOVED by Robinson, seconded by Lynch that said Petitions for the creation of Local Improvement Districts, be referred to the City Manager and staff for study and recommendation: . carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. • Petition No. 542, filed by Leo Gefroh and Others, requesting rezone of property located at 1415 - 1411 West Yakima Avemue, and Petition No. 543, filed by Floyd Wills, requesting rezone of property located at 818 N. 16th Avenue, having been filed with the City Clerk on July 19, 1967, it was MOVED by Lynch, seconded by Brown that said Petitions be referred to the Planning Commission for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Petition No. 545, having been filed with the City Clerk on July 21, 1967, by Thomas A. & Flora E. Dillon, requesting vacation of a portion of South llth Avenue, it was MOVED by Lambert, seconded by McNeice that said Petition be referred to the City Manager and the Planning Commission for study and recommendation; carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Then it was MOVED by Lynch, seconded by McNeice that Resolution No. D -=1098 fixing the time of Hearing for August 14, 1967, on the same petition be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D-1098, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. MOVED by Brown, seconded by McNeice that Resolution No. D -1099 authorizing the execution of Automobile.Rental Business Agreement and License with car rental operators at the Yakima Municipal Airport, be passed as read. - Acting City Manager Friedline reviewed some of the terms and conditions of the agreement. Mr. Stephen J. Cegielski, District Manager, Avis Rent A Car, stated that the only way an Agency can make it is with some volume. He further stated that they feel they can afford the 10% of gross figure, with some increase in volume, and suggested that the agreement should not state ;"'four operators allowed, " = but go with the three that are now there and should one drop out, they would be willing to pick up any minimum and split down the middle with the other operators. Mr. Cegielski stated that since the contract will exist through 1970 we are leaving the door wide open for another operator. Mr. Bob Barnes, with Hertz Rent Car,. Inc., stated that he agrees with Mr. Cegielski, that with too many operators splitting the volume, no one can make it. Councilman Kitbitz suggested a basic monthly license fee of $225. Councilman Robinson. stated that he feels that the 10% of gross is a little high; that the minimum should be a little higher than is now in the agreement; and that he does not favor the agreement as it is proposed. Councilman Lynch stated that he somewhat agrees with , Mr. Robinson; that he is a little concerned with the 10% being too high and the minimum too low; and is wondering how they would feel on 8% of gross and a $200 minimum. Councilman Brown asked Airport Manager Jim Eakin for a recommendation and opinion on how the Automobile Rental Agencies feel about the agreement. Mr. Eakin stated that most Air - ports, even the largest ones, have a maximum of three auto rental agencies and some have only two. He further recommended a minimum fee of $225, plus the $25.00 rental fee, with the 10% of gross, whichever is larger. Mr. Eakin stated that both Auto Rental Agencies represented, Hertz and Avis, are doing a good .job at the airport and are in favor of the, $225 minimum and 10% of gross. It was then MOVED by Robinson, seconded by Lambert, that the Automobile Rental Business Agreement and License be amended to change the rate from - - - ---- $150 to $200, leaving the $25.00 rental fee and changing the length of to two years instead of three: Brown, Lambert and Robinson voting aye by voice vote.. - -Kurbitz, Larson, Lynch and McNeice voting nay by . voice vote. This Motion lost for want of a majority vote. After more discussion on using 8% of gross instead of 10%, it was MOVED•\ by Lynch, seconded by McNeice that the agreement be amended to read $175 minimum and of gross and leave the length of time at three years. Councilman Brown poip'ted out that there will be a new lobby and booths and that it would seem the 10% of gross should be all right. Councilman Lynch noted that this motion raises the minimum slightly and by-- keeping the gross less than 10% it would not look as if we are trying to force out one operator, and by keeping it lower perhaps we can get along with three or four. operators. Mayor Larson suggested deleting any mention of number of operators from the agreement. Mayor Larson then called for the vote on the Motion to amend the agreement to read $175 minimum and 8% of gross. Lynch and Robinson voting aye by voice vote, Brown, Kurbitz, Lambert, Larson and McNeice voting nay by voice vote. This Motion lost for want of a majority vote. It was then MOVED by McNeice, seconded by Lambert that the Automobile Rental Business Agreement and License be amended to change the $150 basic monthly license fee to $225 and to omit any reference to the number of operators to be allowed: carried, Brown, Lambert, Larson, and McNeice voting aye by voice vote. Kurbitz, Lynch and Robinson voting nay by voice vote. Kurbitz and Robinson voting nay on roll call. RESOLUTION NO. D -1099, A RESOLUTION authorizing the Acting City Manager and City Clerk to execute Automobile Rental Business Agreement and. License with car rental operators at the Yakima Municipal Airport. . MOVED by Robinson, seconded by Lambert that Resolution No. D -1100 authorizing the execution of a Canal Crossing Agreement with Yakima Valley Canal Company, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Public Works Director John Mayo explained that the purpose of this agreement is to obtain permission from the Canal Company to use a portion of their right of way for the purpose of installing and maintaining a sewer line to serve a new home in the High View Courts Addi- tion. RESOLUTION NO. D -1100, A RESOLUTION. authorizing the execution of a Canal Crossing Agreement with Yakima Valley Canal Company. MOVED by Brown, seconded by McNeice that Resolution No. D -1101 fixing the time of Hearing for August 14, 1967, on Petition No. 532, filed by John Desoto, requesting vacation of a street right of way, adjacent to the Yakima Municipal Airport, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1101, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. MOVED by Robinson, seconded by Lynch that Resolution No. D -1102 deleting two parcels of property from the assessment roll for Local Improvement District No. 830, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. It was explained by John Mayo :. that these two parcels which are included in L.I.D. No. 830 are now owned by the State of Washington and constitute portions of right of way for the Freeway and should not be subject to further assessment but deleted from the assess- ment roll of L.I.D. No. 830. RESOLUTION NO. D -1102, A RESOLUTION deleting two parcels of real property from the assess- ment roll for Local Improvement District No. 830. MOVED by Lambert, seconded by McNeice that Resolution No. D- -1103 authorizing the hiring of work and labor and purchasing material without calling for bids, in connection with the Yakima Municipal Airport improvements, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Public Works Director John Mayo explained that this is for some electrical work that has to be done before the work covered by the Federal Grant can be started, and is work that is tied in with the general Airport improvement project. RESOLUTION NO. D -1103, A RESOLUTION authorizing and directing the Acting City Manager and City Clerk of the City of Yakima to hire work and labor and purchase materials without call' ing for bids. MOVED by Robinson, seconded by Brown that Resolution No. D - -1104 authorizing the execution of an agreement with Wm. P. Harper & Son & Company, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Acting City Manager Friedline explained that since the City contemplates the issuance of. Water and Sewer Revenue Bonds and in connection with said Bonds desires to engage professional financial advisory services, and has negotiated with said company, the City feels this is a desirable contract. . RESOLUTION NO. D- 1104, .A RESOLUTION authorizing and directing the Mayor and City Clerk to execute an agreement with Wm. P. Harper & Son & Company. An Appeal from the Planning Commission's decision to deny rezone on Petition No. 535, filed by Ace L. Ransier, requesting rezone of property located at 1114 Ledwich Avenue, having been received, it was MOVED by Robinson, seconded-by McNeice that the date of August 21, 1967, be fixed as the date of Hearing on said Petition for rezone: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Roger Edwards, member of the Yakima Chapter of Demolay, explained that their group is going to have a marathon pool game and try to break a record set by another club. They will be playing at the Ball and Cue, who will furnish the tables and equipment free, and anyone who would like to play a game with one of them will be welcomed. The money they make will go to the Shriner's Hospital in Texas. He stated that the reason he is explain - it to the Council is that a City Ordinance states that the place must close at 1:00 A.M. and they are asking permission to be able to play continuously for at least 240 hours. Council members indicated that they are in favor of authorizing the staff to help these Demolay boys in their project and approved the marathon pool game as it is to be cbnducted by the Demolay boys. After due discussion, it was MOVED by Lynch, seconded by McNeice that the staff be authorized to proceed in accordance with City Attorney Andrews' legal opinion in the matter of these boys being allowed to play pool continuously for at least 240 hours: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Katherine Cox, reporter for the Yakima Eagle, asked Council members if, they would each give their opinion of the Fluoridation issue, as she had tried to reach various ones per- sonally and had been unable to contact them. Council members indicated that the people will get a chance to vote on the Fluoridation issue before it would ever become effective in Yakima, and if she will contact them personally, they will be glad to talk to her. Mayor Larson and Assistant Mayor Robinson having been excused from the next regular meeting on July 31, 1967, it was MOVED by Robinson, seconded by Brown that Councilman Lambert be appointed as Acting Mayor while they are both absent from the City: carried, Brown, Kurbitz, Larson, Lynch, McNeice and Robinson voting aye by voice vote. The following bids were received and considered by a bid board on this date for the con- struction of a new office building at the Yakima Municipal Airport: Cook -Lewis Co. $ 81,510.00 W. M. Cameron, that the bid be awarded to said Contractor, it was MOVED by Robinson, seconded by Lynch that said recom- mendations be accepted and the bid be awarded to Cook -Lewis Company in the amount of $81,510.00: carried, Brown and all voting aye by voice vote. The following bids were received and considered by a bid board on this date for the Engle - wood Heights - North 58th Avenue and Others Paving Improvement - L.I.D.s No. 960 and No. 965: Superior Asphalt & Concrete Co. $ 82,873.40 Yakima Asphalt Paving Co. 88,261.50 The Bid submitted by Superior Asphalt and Concrete Company, being the low bid, and the City Engineer recommending that the bid be awarded to said contractor, it was MOVED by Robinson, seconded by Brown that the Engineer's recommendation be accepted and the bid be awarded to Superior Asphalt and Concrete Company in the amount of $82,873.40, and that the City Manager be and is hereby authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Brown, Kurbitz; Lambert, Larson, Lymch, McNeice and Robinson voting aye by voice vote. Acting City Manager Friedline reporting that the term of John Vandiver on the Planning Commission expires on August 31, 1967, and that Mr. Vandiver has indicated he would be willing to serve another six -year term, and Mr. Friedline recommending that he be re- appointed, it was MOVED by Lynch, seconded by Lambert that the City Council re- appoint Mr. John Vandiver to the Planning Commission for a term of six years to expire on August 31, 1973, with thanks for the fine service in the past: carried, Brown, Kurbitz, Lambert_,_- Larson, Lynch, McNeice and Robinson voting aye by voice vote. 308 July 24, 1967 • • Acting City Manager Friedline reporting that the Term of Mr. W. Britt on the Board of • Adjustment expires on August 9, 1967, and Mr. Britt having indicated he would be willing to serve another six -year term, and since this appointment is made by the City Manager with Council approval, Mr. Friedline stated he is requesting the Council's approval to • re-appoint Mr. Britt to the Board of Adjustment, it was MOVED by Robinson, seconded by Brown that the re- appointment of Mr. W. C. Britt to serve another six year term-on the Board of Adjustment to expire on August 9, 1973, be'approved:. carried, Brown, Kurbitz, Lambert; Larson, Lynch, McNeice and Robinson voting aye by voice vote. Councilman .
