JUNE 26, 1967
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
Lambert, Lynch, McNeice and Robinson, City Manager Smith and City Attorney Andrews present
on roll call.
The Invocation was given by Councilman Brown.
The minutes of the regular meeting of June 19, 1967, having been duly certified accurate
by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded.
This being the time fixed for the Hearing on Petition No. 525, filed by C. A. Enright, re-
questing rezone of property located at 305 - 307 N. 3rd Street, and there being no protests
in writing or otherwise, it was MOVED by Brown, seconded by McNeice that Ordinance No. 931
accepting the recommendation of the Planning Commission and rezoning said property, be
passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson votin,
aye on roll call.
ORDINANCE NO. 931, AN ORDINANCE accepting the recommendation of the Planning Commission and
rezoning certain property situated at 305 - 307 North Third Street, in the City of Yakima,
Washington, from B -2, Local Business Zone, to B -1, Modified Business Zone.
This being the time fixed for the Hearing on Petition No. 529, filed by Dwight E. Drumright .
requesting rezone of property located at 1006 S. 38th Avenue, and there being no protests
in writing or otherwise, it was MOVED by Lynch, seconded by McNeice that Ordinance No. 932
accepting the recommendation of the Planning Commission and rezoning said property, be
passed as read: carried, Brown, Lambert, Larson, Lynch, McNeice,'KurbitZ and Robinson - vot=
ing.aye on roll call. Mr. Drumright stated that he will file a deed restriction stating
that the buildings will be no higher than one -story duplexes, as in an R -2 Zone.
ORDINANCE NO. 932, AN ORDINANCE accepting the recommendation of the Planning Commission and
rezoning certain property situated at 1006 Sbuth 38th Avenue, in the City of Yakima, Wash-
ington, from R -1, One- Family Zone, to R- 3,.Multiple- Family Zone.
Petition No. 527, having been filed with the City Clerk on June 26, 1967, by Fred M. Plath
and Others, requesting annexation of property located at the southeast corner of 40th Ave.
and Englewood Avenue and extending southeasterly to the Congdon Canal right of way, it was
MOVED by Robinson, seconded by Lynch that the Petition for Annexation filed by Fred M.
Plath & Others, being Petition No. 527, be approved as meeting the requirements of law;
that said Petition be referred to the City Manager and Planning Commission for study and
recommendation; that the Mayor be authorized to convene a Review Board, as required by law,
for a hearing and review of this proposed annexation; and that August 7, 1967 be set as the
date for a public hearing by the City Council on this Petition: carried, Brown, Kurbitz,
Lambert, Larson, Lynch, McNeice and Robinson voting . aye by voice vote.
MOVED by Robinson, seconded by Brown that Resolution No. D -1085 authorizing the . extension
of a Lease Agreement with National City Management Company, be passed as read: carried,
Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz
temporarily absent. City Manager Smith explained that said Lease Agreement with National
City Management Company, to furnish bus service for the City, terminates on October 2, 1967
unless the City extends said Agreement for an additional three years by giving timely
notice of such extension to said Company, and that by giving this notice at this time,
some 90 days ahead of the possible termination date of the agreement, it will give them,
as well as the City, time to make any changes in said Lease Agreement, if desirable.
RESOLUTION NO. D -1085, A RESOLUTION authorizing the extension of a Lease Agreement with
National City Management Company.
MOVED by Lynch, seconded by McNeice that Resolution No. D -1086 authorizing the execution
of an Agreement with the Regents of the University of Washington for part time employment
of students by the City, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch,
McNeice and Robinson voting aye on roll call. City Manager Smith explained that the City
now has in its employ, seven of these students, four in the Engineering Department and
three in the Public Utilities Department, and that it seems to be a very favorable program
for which the City has to pay approximately 10% of the total cost until August 20, and 25%
after that, which amounts to approximately $163 per student for the summer. The rest of
the cost is taken care of under the provisions of the Economic Opportunity Act of 1964. .
RESOLUTION NO. D -1086, A RESOLUTION authorizing and directing the City Manager and City
Clerk to execute an Agreement with the Regents of the University of Washington.
An Appeal from the Planning Commission's decision to deny rezone on Petition No. 528,
filed by H. E. Patterson and Keith J. Spanton, requesting rezone of property in the general
area of 57th and 58th Avenues, abutting Lincoln Avenue, having been received, it was MOVED
by Robinson, seconded by Brown that July 10, 1967, be fixed as the date of Hearing on said
Appeal: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by
voice vote. .
A Damage Claim having been filed with the City Clerk on June 21, 1967, by Mr. Hugh Thomas,
1136 W. Nob Hill Blvd. for damages to electric wires from his garage to his house by a
City garbage truck, it was MOVED by Robinson, seconded by Brown that said Damage Claim be
referred to the City Manager and Staff for study and recommendation: carried, Brown, Kur-
bitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote.
City Manager Smith referred to a Memorandum from Jules Shockley, Fire Chief, requesting
that the salary of Jack Labusky, radio technician, be increased so as to be able to keep
him working for the City, instead of losing him to a higher paying position, and Mr. Smith
recommending the passage of an Ordinance authorizing this increase, it was MOVED by Lam-
bert, seconded by Brown that said Ordinance be read: carried, Brown, Kurbitz, Lambert, Lar-
son, Lynch, McNeice and Robinson voting aye by voice vote. After due discussion, -it was
MOVED by Lambert, seconded by Brown that Ordinance No. 933 relating to personnel and the
Comp. Plan, and amending the Yakima Municipal Code, be passed as read: carried, Brown,
Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call.
ORDINANCE NO. 933, AN ORDINANCE relating to personnel and salaries; designating the classi-
fication plan and salary. ranges for fire personnel; and amending Subsection 2.20.100 (h) of
the City of Yakima Municipal Code.
