MAY 15, 1967
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
Lambert, Lynch, McNeice and Robinson, City Manager Smith and City Attorney Andrews present
on roll call.
The Invocation was given by Councilman Brown. -
The minutes of the regular meeting of May 8, 1967, having been duly certified accurate by
two Councilmen, and no . one present wishing to have said minutes read publicly, Mayor Larson
declared said minutes approved as recorded.
Petition No. 525, having been filed with the City Clerk on May 12, 1967, by C. A. and Donna
Enright, requesting rezone of property located at•305 - 307 N. 3rd Street, between E. Lin-
coln Avenue and E. "D" Street, it was MOVED by Lynch, seconded by McNeice that said Petition
be referred to the City Manager and Planning Commission for study and recommendation:
carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice
vote. .
Petition No. 526, Notice of Intention to Commence Annexation Proceedings, having been filed
with the City Clerk on May 15, 1967, by Chester S. and Lillian M. Meyer, requesting annexa-
tion of property located on both sides of S. 44th. Avenue from Nob Hill Blvd. south to Storm
Avenue extended, it was MOVED by Robinson, seconded by Lynch that this date be set as the
time for a meeting with the initiating parties, who signed the Notice of Intention to
Commence Annexation Proceedings dated May 15, 1967: carried, Brown, Kurbitz, Lambert, Lar-
son, Lynch, McNeice and Robinson voting aye by voice vote. Chester S. and Lillian M. Meyer,
indicating that the area to be annexed is willing to assume its share of the City's exist-
ing indebtedness, it was duly moved, seconded and passed that the annexation proposed by
petition no. 526 (Notice of Intention to Commence Annexation Proceedings) be accepted by
the City of Yakima and that the area sought to be annexed be required to assume the City's
existing indebtedness. The above Motion was made by Robinson, seconded by Lambert and
carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice
vote. .
Petition. No. 527, Notice of Intention to Commence Annexation Proceedings, having been filed
with the City Clerk on May 15, 1967, by Fred M. Plath, requesting annexation of property
located at the southeast corner of 40th Avenue and Englewood Avenue and extending southeast-
erly to the Congdon Canal right -of -way, it was MOVED by Lynch, seconded by Lambert that
this date be set as the time for a meeting with the initiating party, who signed the Notices
of Intention to Commence Annexation Proceedings dated May 15, 1967: carried, Brown, Kurbitzj
Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Fred M. Plath,
indicating that the area to be annexed is willing to assume its share of the City's exist -
ing indebtedness, it was duly moved, seconded and passed that the annexation proposed by
petition no. 527 (Notice of Intention to Commence Annexation Proceedings) be accepted by
the City of Yakima and that the area sought to be annexed be required to assume the City's
existing indebtedness. The above Motion was made by Robinson, seconded by Lynch and
carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice
vote.
MOVED by Lynch, seconded by Brown that Ordinance No. 910 relating to control of moved .
buildings and adopting a new Chapter of the Yakima Municipal Code, be passed as read:
carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll
call. City Manager Smith explained that the present Ordinances provide for the removal of
buildings to other property, but no provisions are made whereby we can do anything to
enforce the repair of the moved buildings within a reasonable length of time and many build-
ings have been moved but not repaired. He further stated that this Ordinance will give the
tools to assure a good job after the building has been removed.
ORDINANCE NO. 910, AN ORDINANCE relating to building regulations and to the control of
moved buildings; declaring moved buildings and structures to be new construction; requiring
a permit and bond for moving buildings structures; declaring the violation hereof to be
a misdemeanor and prescribing a penalty therefor; and adopting Chapter 11.50, "Control of
Moved Buildingsm as a new Chapter of the City of Yakima Municipal Code.
MOVED by Lambert, seconded by Brown that Ordinance No. 911 relating to licenses and business
regulations relating to house . moving and amending the Yakima Municipal Code, be passed as
read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on
roll call. City Attorney Andrews explained that this Ordinance amends the Yakima Municipal
Code to include the new Chapter added by the passage of Ordinance No. 910, just previous to
this matter.
ORDINANCE NO. 911, AN ORDINANCE relating to licenses and business regulations; requiring a
license to engage in the business of house moving; and amending Section 5.60.010 of the
City of Yakima Municipal Code.
MOVED by Robinson, seconded by Lambert that Ordinance No. 912 relating to paying fines and
costs imposed by the Yakima Municipal Court, specifying credit to be allowed for jail time
served, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz,
Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call.
ORDINANCE NO. 912, AN ORDINANCE relating to paying fines and costs imposed by the Yakima
Municipal Court; specifying credit to be allowed for jail time served; and amending Section
1.66.010 of the City of Yakima Municipal Code.
MOVED by Brown, seconded by McNeice that Resolution No. D -1074 authorizing the execution of
a Lease Modification and Extension Agreement with Puget Aviation, Incorporated, be passed
as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye
on roll call. City Manager Smith explained that at the present time Puget Aviation, Inc.,
leases approximately 310 square feel of office space in the northeast corner of the Central
Building at the Yakima Municipal Airport and would now like to lease the space formerly
occupied by the Fire Department, which is approximately 2,$20 square feel of additional
space, for an additional monthly rental of $88.36, which is the approximate amount the
other lessees are paying for comparable space in the building.
RESOLUTION NO. D -1074, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a Lease Modification and Extension Agreement with
Puget Aviation, Incorporated.

MOVED by Robinson, seconded by Brown that Resolution No. D -1075 authorizing the execution
of a Lease Modification Agreement with James A. Sellers, be passed as read: carried, Brown.
Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. City Mana-
. ger Smith explained that the City needs a little more space than first planned, to allow
• more space between the Weather Station and the new Fire Station, and that Mr. Sellers is
glad to give up this required space and cut down the amount of his.rental payment somewhat.
RESOLUTION NO. D -1075, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a Lease Modification Agreement with James A. Sellers.
• The following bids were received and considered by a bid board on this date, for the con-
struction of Englewood Heights and.Other Sanitary Sewers, (L.I..). No. 963):

The City Engineer recommended that the bid.be awarded to Larry DeBlasio of DeBlasio Bro-
thers, the low bidder. After due discussion, it was MOVED by Robinson, seconded by Lynch
that the Engineer's recommendation be accepted and the bid be awarded to Larry DeBlasio in
the amount of 536,1$$.14 and that the City Manager be and is hereby authorized to enter
into a contract with said contractor upon the filing of the proper bond and insurance:
carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice
vote.
Mr. Vern Couch, 1319 S. 3rd.Avenue, and Mr. W. G. Carter, 1309 & 1311 Broadway, being
present, asked questions regarding work to be done on South 3rd Avenue Curb, Gutter and
Surfacing District, (L;.I.D. No. 955). They stated that when the preliminary assessments
came out, that'they understood that the project was for four lanes, and now they note that
there is to be a fifth lane, or parking lane, which .they do not think is necessary and want
to know why this is being done, and object to part of their property being used for this
fifth lane. City Manager Smith explained that originally when the L.I.D. was proposed, it
was for four lanes. He further explained that since that time, there has been discussion
and some controversy on several other Arterials, and Council members have decided, wherever
possible, that all Arterials should have a sidewalk and a parking lane,•at least on one
side of the street, with four lanes of moving traffic. . Council_•members explained that they
feel it is better to plan for future traffic where you can actually widen the:lanes, rather
than to plan just for.the present. They further stated that they realize that there isn't •
any solution that will make 'everyone happy, but have studied the situation thorougly and .
have tried to do the best that can be done.
Councilman Robinson asking to be excused from.Council meetings for the next four weeks, it
was MOVED by McNeic.e, seconded by Brown that he be excused: carried, Brown, Kurbitz, Lam-
bert, Larson, Lynch and McNeice voting aye by voice vote.
In. accordan .ce,.with.Police'.C.hief Campbell's request, :City.., Manager recommended that Lt.
Richard Clark and Officer Dorrance Lattimer be given authorization to attend the Western
- States Crime Conferende from May 21 to 24, 1967, at Gleneden Beach, Oregon, with expenses •
'Paid, After . due discussion, it was MOVED by Kurbitz, seconded by Lynch that said trip be
. allowed with expenses paid: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and
Robinson voting aye by voice vote. •
City Manager Smith recommending that Fire Chief Jules Shockley be authorized to attend the
Regional Fire Department Management School for two weeks from May 2$ through June 10, 1967,
at Dallas, Texas, at an approximate cost of 5650.00, it was MOVED by Lambert, seconded by
Robinson that said trip be allowed with expenses paid: carried, Brown, Kurbitz, Lambert,
Larson, Lynch,.McNeice and Robinson voting aye by voice vote.
• There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Lynch that we do now adjourn at the hour of 9:20 P.M.: carried, Brown, Kurbitz, •
