Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, Lynch, McNeice and Robinson, City Manager Smith and City Attorney Andrews..present on roll call . The Invocation was given by Councilman Brown.. . II The minutes of the regular meeting of February 27, 1967, having been duly certified accur -. ate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . An Ordinance appropriating $1,595,751 within the Airport Improvement Fund to Construction Expenditures, having been read in its entirety, was ordered laid on the table for one week or until the next regular Council meeting to be held on March 13, 1967. MOVED by Lynch, seconded by Robinson that Ordinance No. 888 creating a traffic advisory board and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. City Manager Smith referred to the minutes of the Yakima Traffic Advisory Board in which it was recommended that the Traffic Advisory Board be increased to include a member of the City Bus Lines and suggested assistant City Manager Martin Friedline as the logical member to be appointed. Mr. Smith further explained that Ordinance No. 8$$ merely amends the Code to include a representative of the Transit Department on the .Traffic Advisory Board. ORDINANCE NO. 888, AN ORDINANCE creating a traffic advisory board and specifying the mem- bership thereof; and amending Section 1.67.010 of the City of Yakima Municipal Code. MOVED by Robinson, seconded by Brown that Ordinance No. a 9.relating to traffic control and repealing a Section of the Yakima Municipal Code, be passed as read: carried, Brown, Kur- bitz, Lambert, Larson., Lynch, McNeice and Robinson voting aye on roll call. City Manager Smith explained that by repealing this section of the Code, it will be permissible for driver training instructors to give instruction to their students in the Central Business District in daylight hours only, which they have been unable to do under the present ordi- nance. ORDINANCE NO. $$9, AN ORDINANCE relating to traffic control.; and repealing Section 9.72.050 of the City of Yakima Municipal Code. MOVED by Brown, seconded by Robinson that Ordinance No. $90 relating to the classification plan for professional and related technical personnel and amending a subsection of the Yakima Municipal Code, be passed as read: carried, Brown,_Kirbitz,.Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call; City Manager Smith explained that this is being done to add the new classification of Civil Engineer IV, which establishes a new category, allowing Al Ray to move into this category, having now earned his license to II II practice as a professional engineer. ORDINANCE NO. 890, AN ORDINANCE relating to personnel and salaries; designating the classi -• fication plan and salary ranges for professional and related . technical personnel; and amending Subsection 2.20.100(c) of the City of Yakima Municipal Code. MOVED by Brown, seconded by Lynch that Resolution No. D -1053 authorizing refunds of certain L.I.D. assessments to property owners and transferring $36,23$.64 from the 1962 Street Improvement Bond Construction Fund to L.I.D. Nos. 917 and 920, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch,.McNeice and Robinson voting aye on roll call. City Manager Smith explained that it has been adjudged by the Superior Court of the State of Washington, in causes numbered 4$467 and 4$4$1, that assessments levied.in similar local improvement districts are illegal and void and that reimbursements of assessments have been made in these districts pursuant to court order. He further stated._.tYiat in :View oj' these facts, this Resolution is merely to treat these two districts on the same basis with- out the property owners having to bring court orders against the districts. RESOLUTION NO. D -1053, A RESOLUTION authorizing refunds of certain Local Improvement Dis- trict assessments to property owners, and transferring $36,23$.64 from the 1962 Street Improvement Bond Construction Fund to Local Improvement Districts 917 and 920. ** (The following two paragraphs were inadvertABntly left out here) MOVED by Robinson, seconded by McNeice that Resolution No. D -1052 authorizing the execution of an agreement with the Federal Aviation Agency in order to relocate a power cable serv- ing the Instrument Landing System Localizer Facility at the Yakima Municipal Airport, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson vot- ing aye on roll call. RESOLUTION NO. D -1052, A RESOLUTION authorizing and directing the City Manager and the City Clerk of the City of Yakima to execute an agreement with the Federal Aviation Agency. An Application for a Water & Sewer Utility Connection outside Yakima City Limits, having been filed with the City Clerk on March 3, 1967 by Perry G. Hayes,. and the City Manager indicating that the Staff recommends that this Outside Hookup be allowed, it was MOVED by McNeice, seconded by Kurbitz that said Outside Hookup'be allowed if and when the Outside Hookup Agreement is signed by the applicant: carried, Brown,•Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. An Application for a Sewer Utility Connection outside Yakima City Limits, having been filed with the City Clerk on March 3, 1967, by Ralph C. Coffey, and the City Manager indi- cating that the Staff recommends that this Outside Hookup be allowed, it was MOVED by Robinson, seconded by McNeice that said Outside Hookup be allowed if and when the Outside Hookup Agreement is signed by the applicant: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. . . . Mayor Larson requested permissiomi t@�' attend the Third Annual National Legislative Confer- ence in Washington, D. C. from MUa:r'-`c 12 to 14, 1967. It was MOVED by Robinson, seconded by Lynch that the Mayor be authorized to attend said Conference: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Mayor Larson congratulated Councilman Lambert on being selected as Woman of the Month of February. . • • Councilman Lynch commented on receiving calls regarding the dust problem on 56th Avenue and was assured by John Mayo, Public Works Director, that this street is being sprinkled as often as possible, until work can begin on it. Mayor Larson informed the Council that Tuesday, March 14, 1967, will be Girl Scout Day and since he will be out of town on that day, asked if Councilman Lambert would like to volunteer to welcome the Girl Scouts to City Hall, and Councilman Lambert volunteered to fill in for him. City Manager Smith informed the' Council of a problem that the Airport had during the past week when there was a short in a cable which had created a thre.e =phase fire, and that it looks like the project of putting in a new line will cost about 53,000. City Manager Smith referring to legislative material on Substitute House Bill #113 received by Council members; explained that this Bill establishes one retirement system for firemen and policemen instead of two separate systems as we now have and recommended that the Council support this bill, with an amendment placed on the Bill that they can retire after . 25 years of service upon reaching the age of 50, (the Bill states age of 55). After due discussion, it was MOVED by Robinson, seconded by Lynch that the Yakima City Council go on record as supporting House Bill #113 as recommended by the City Manager: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Mayor Larson stated that there will be a ground breaking ceremony for the Southeast Yakima Center on Sunday, March 12, 1967 at 2:00 P.M. and that. Councilman McNeice will represent the Mayor at this Ceremony.
