Andrews present on roll call. '.Councilman Kurbitz absent on roll. call. It was MOVED by Robinson, seconded by Brown that Councilman Kurbitz be excused from this meeting: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz present after 3:04 P.M. The Invocation was given by Councilman Brown. The minutes of the regular meeting of December 5, 1966, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . Petition No. 496, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on December 2, 1966, by Howard Hettinger, Attorney, representing Max Seals, President, Englewood Heights, Inc., requesting annexation of property located south of Englewood, between N. 58th and N. 60th Avenues, it was MOVED by Robinson, seconded . by Lynch that this date, December 12, 1966, be set as the time for a meeting with Mr. Hettinger, representing Englewood Heights, Inc., who signed said Petition No. 496, Notice of Intention to Commence Annexation Proceedings, dated 12 /2/66: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. Mr. Hettinger, indicating that the area to be annexed is willing to assume its share of the City's exist- ing indebtedness, it was duly moved, seconded and passed that the annexation proposed by Petition No. 496, (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above Motion was made by Robinson, seconded by Lynch and carried: Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. Kurbitz present after 3:04 P.M. Petition No. 496, Petition for Annexation, having been filed later in this meeting by Howard Hettinger, Attorney representing Englewood Heights, Inc., requesting annexation of Englewood Heights Plat, it was MOVED by Lambert, seconded by Brown that said Petition for Annexation be referred to the City Manager and the-Planning Commission for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. 0 The following Petitions, having been filed with the City Clerk on December 2, 1966, by Howard Hettinger, Attorney representing Max Seals, President, Englewood Heights, Inc., requesting improvement of property located in the Englewood Heights Plat: No. 497, by the construction of water mains, No. 498, by the construction of a sewer, and No. 499, by the construction of curbs, gutters and surfacing of streets, it was MOVED by Lynch, seconded by Lambert that said Petitions be referred to the City Manager and Planning Commission for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. MOVED by Lambert, seconded by Brown that Ordinance No. 857 relating to public safety and morals, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. City Attorney Andrews ex- plained that this Ordinance is to amend an Ordinance passed in 1937 and would cover more thoroughly problems relating to items not specifically listed. ORDINANCE NO. 857, AN ORDINANCE relating to public safety and morals; declaring the malicious or wanton defacing, damaging or destruction of property of another to constitute disorderly conduct; and amending Section 6.04.235 of the City of Yakima Municipal Code. MOVED by Lynch, seconded by Robinson that Ordinance No. 858 relating to travel and ex- penses of City employees and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson; Lynch and Robinson voting aye on roll call. ORDINANCE NO. 858, AN ORDINANCE providing for and restricting reimbursements to City em- ployees for certain expenditures; requiring prior authorization for travel outside the City by City employees; and amending Subsection 2.20.086 (c) of the City of Yakima Munici- pal Code. MOVED by Lynch, seconded by Robinson that Resolution No. D -1021 of appreciation and commendation to Don Brazier for service as a member of the Yakima City Council, be passed as read: carried, Brown,. Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D -1021, A RESOLUTION of appreciation and commendation for service performed by Don Brazier during his tenure as a member of the Yakima City Council. MOVED by Lambert, seconded by Lynch that Resolution No. D -1022 authorizing the engaging of Ralph Korn for appraisal services in connection with the relocation of Washington Avenue, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D-1022, - A RESOLUTION authorizing the City Manager of the City of Yakima to engage Ralph Korn,•M.A.I., for appraisal services. MOVED by Lynch, seconded by Brown that Resolution No. D -1023 authorizing payment of $24.03 to Mrs. Howard V. Wiley in settlement of a sewer backup damage claim, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D -1023, A RESOLUTION authorizing payment of a claim for damages filed by Mrs. Howard V. Wiley. MOVED by Lynch, seconded by Lambert that Resolution No. D -1024, transferring $3,000 within the 1966 Budget for the Municipal Airport, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D -1024, A RESOLUTION transferring the amount of $3,000 within the 1966 appropriation for 390 - Municipal Airport. 232 DECEMBER 12, 1966 MOVED by Robinson, seconded by Lambert that Resolution No. D -1025, transferring $3,.700 within the 1966 Budget for the Police Department, be passed as read: carried, Brown, Kur- bitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D -1025, A RESOLUTION transferring the amount of $3,700 within the 1966 III appropriation for 121- Police Department. . In accordance with action taken at the last regular Council meeting on December 15, 1966, and the Planning Commission having submitted their report on the Application for Outside Utility Hookup, filed by John T. Haas, Inc., and recommending approval of said hookup, it was MOVED by Robinson, seconded by Brown that the recommendation of the Planning Commission be accepted and said Outside Hookup be granted when and if the Outside Hookup Agreement is signed by the applicant: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson vot- ing aye by voice vote. . The Planning Commission reporting on the following Petitions requesting annexation: No. 474, filed by Robert W. and Mary M. Strausz, No. 481, filed by Glascam Builders, Inc., and • No. 495, filed by J. Grant McDaniel, and the date of Hearings on the Strausz and Glascam Petitions having been fixed previously for December 19, 1966, it was MOVED by Robinson, seconded by Lambert that the Petition for Annexation filed by J. Grant McDaniel, being Petition No. 495, be approved as meeting the requirements of law'; that the City Manager and the Mayor be authorized to obtain waivers of a meeting of a Review Board, as authorized by law; and that an order be prepared fixing January 3, 1967 as the time for a public hearing by the City Council on this petition: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. An Application for Outside Utility Hookup having been filed by Chester S. Meyer and City Manager Smith explaining that an Outside Hookup Agreement has already been signed by Mr. Meyer, that a Notice of Intention to Commence Annexation Proceedings has been duly filed and processed by said applicant and the City Council, and that the Staff is recommending that this application be approved and said outside hookup be granted,•it was MOVED by Lambert, seconded by Robinson that said outside hookup be granted: carried, Brown, Kur- bitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Councilman Don Brazier having resigned from his City Council position on December 1, 1966, it was MOVED by Robinson, seconded by Brown that Don W. McNeice be appointed to fill said vacancy on the Council, to serve until the next regular election in the Fall: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. A vacancy having been created in the office of Assistant Mayor by the resignation of Don Brazier, it was MOVED by Lynch, seconded by Kurbitz that Walter J. Robinson, Jr., be appointed Assistant Mayor: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson not voting. . Damage Claims having been filed by Norman A. Rustvold and Thomas E. Carrico, it was MOVED by Lynch, seconded by Brown that said Damage Claims be referred to the City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. City Manager Smith referred to a written request from Roche Fruit Company, and a Memo from Frank Stein, Utilities Director, that had been referred to the Staff, and stated that the Staff would like to recommend the approval of granting their request to expand their Plant over existing Irrigation Pipe Line Right of Way, providing they sign a Hold Harmless Agreement for any damages or loss of profit that may result from any breaks that occur in the pipe line and for any repairs to their structure or floor that may be caused by necessary repairs -to the pipe line. After due discussion, it was MOVED by Robinson, seconded by'Lambert that said request be approved providing the Roche Fruit Company signs such an agreement and that a Resolution and Agreement be prepared: carried, Brown, Kur- bitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Mayor Larson announced to the Council - that City Manager Smith has just been elected Presi- dent of the Washington State City Managers' Association and congratulated him on his election to this position.
