DECEMBER 5, 1966 In accordance with action taken at the last regular Council meeting on November 2$, 1966, and Councilman Robinson being authorized to act as Presiding Officer at this meeting, the City Council met in regular session. Councilmen Kurbitz, Lambert and Lynch, City Manager Smith and City Attorney Andrews were present on roll call. Mayor Larson and Councilman Brown absent on roll call, having been formally excused at the last regular Council meeting on November 2$, 1966. (No action taken to replace Councilman Brazier at this meeting). The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of November 2$, 1966, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Presiding Officer Robinson declared said minutes approved as recorded. Presiding Officer Robinson welcomed and presented to the Council members, Mr. Brian Cox, an Engineer from Hartfordshire, England, who is in the United States to observe engineering practices and in Yakima for this one day. This being the time fixed for the Hearing on Resolution No. D -101$, being a resolution of intention to improve property by the construction of a pipe sewer and creating L.I.D. No. 961, N. 56th and Other Sewers, and there being no protests in writing or otherwise, it was MOVED by Lambert, seconded by Lynch that Ordinance No. $56 creating said District, be passed as read: carried, Kurbitz, Lambert, Lynch and Robinson voting aye on roll call. Brown and Larson absent. ORDINANCE NO. $56, AN ORDINANCE providing for the improvement of certain property by con- structing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. MOVED by Lynch, seconded by Lambert that Resolution No. D -1020 authorizing the execution of a license and agreement for the use of the Marine Corps Reserve Training Center by the Yakima Police Department, be passed as read: carried, Kurbitz, Lambert, Lynch and Robinson voting aye on roll call. Brown and Larson absent. RESOLUTION NO. D -1020, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute a license and agreement with the United States of America, Department of the Navy, for use of the Marine Corps Reserve Training Center. The City Engineer having submitted Architect Don Rothe's report on the construction work on Fire Station No. 4 at the Yakima Municipal Airport and requesting that the second pay - ment amounting to $20,334.32 be made, it was MOVED by Lynch, seconded by Lambert that said report be accepted and payment of $20,334,32 be made: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vote. Brown and Larson absent. Washington Ave. 16" Watermain October 3, 1966 16th Ave. to 10th Ave. DeBlasio Brothers. 520 - 39,532.83 it was MOVED by Lynch, seconded by Lambert that the report of the City Engineer dated December 1, 1966, with respect to the progress on the various construction projects of the City of Yakima, be approved and that the progress estimates therein set forth be approved and payment of the same authorized: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vote. The City Engineer reporting that the one year period for a one per cent hold -back has expired on the construction of the Yakima Sewage Treatment Plant and Industrial Waste Pump Station additions by the G. L. Leischner Construction Company, and recommending that the final payment of retainage in the amount of $11,6$5.0$ as per letter from CH2M engineering firm dated November 2, 1965, be made, it was MOVED by Lambert, seconded by Lynch that the City Engineer's report on said project be accepted and payment of same authorized: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice. vote. A letter having been received by the Council from Roche Fruit, requesting permission to cross the right -of -way of a City irrigation transit line in order to extend their packing line, and stating that they are prepared to replace wooden irrigation pipe with steel pipe at their expense, meeting City specifications, it was MOVED by Lambert, seconded by Lynch that said matter be referred to the City Manager and Staff for study and recommenda- tion: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vote. Brown and Larson absent. 0 An Application for. Outside Utility Hookup having been filed with the Planning Department on November 29, 1966, and the City Clerk on December 1, 1966, by John T. Haas, Inc., and .. :.. since Resolution No. D -791 requires that Outside Utility Applications for commercial and industrial users be reviewed by the City Planning Commission and said item has been placed on the Agenda for the Planning Commission meeting on December 6, 1966 it was MOVED by Lynch, seconded by Lambert that a decision on this matter be postponed until after a report and recommendation from the Planning Commission is received: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vote. Brown. and Larson absent. 230 DECEMBER 5, 1966 - Damage Claims having been filed with the City Clerk by Frank and Myrtle McKinley on November 29, 1966, and Carl W. Livingston on November 30, 1966, it was MOVED by Lynch, seconded by Lambert that said Damage Claims be referred to the City Manager and Staff for sty and recommendation: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vo Brown and Larson absent. City Manager Smith reported that an emergency had arisen the previous week in which it was necessary to send one of our Police officers along with•a County Sheriff to Burns, Oregon to bring back a suspect involved in a local robbery. In view of the fact that this was an emergency and it was not possible to clear with the Council members on matters of travel outside of the State, it was MOVED by Lynch, seconded by Lambert that the travel of said Police Officer with .expenses paid, be ratified and approved: carried, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vote. Brown and Larson absent. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Lynch that we do now adjourn at the hour of 3 :45 P.M.: carried, Kurbitz, Lam- bert, Lynch and Robinson voting aye voice vote.
