The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Kurbitz absent on roll call. It was MOVED by Robinson, seconded by Brazier that Councilman Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The Invocation was given by Councilman Lynch. The minutes of the regular meeting of November 21, 1966, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. An Ordinance appropriating $2,500 from the Water -Sewer Fund to Interest Debt Redemption, having been read in its entirety at the regular meeting on November 21, 1966, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by Brazier that'Ordi- nance No. $52 providing for said appropriation, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. $52, AN ORDINANCE appropriating the amount of $2,500 from Unappropriated monies in the Water -Sewer Fund to Accounts 981, Bond Redemption, and 991, Bond Interest, of the Interest and Debt Redemption classification, in the 1966 appropriation for 520, Water - Sewer Fund. This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 942, High - view Courts and Others Sewers and there being no one present to protest said confirmation, it was MOVED by Lynch, seconded by Brown that Ordinance No. $53 confirming said Assessment Roll be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent (One protest in writing was filed by Elmer L. and Elizabeth M. Archer, 207 S. 47th Ave., on November 25, 1966). ORDINANCE NO. $53, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 942 as created and established by Ordinance No. 672 of the Ordinances of the City of Yakima. _ MOVED by Robinson, seconded by Lambert that Ordinance No. $54 relating to classification and compensation plan for 1967 and amending the Yakima Municipal Code, be passed as read. After due discussion, it was MOVED by Robinson, seconded by Lambert that Ordinance No. $54 be amended by deleting - "No payment shall be made for fractions of an hour, and" from the first part of the last sentence in "Section 6. Section 2.40.100A(2)(c) Fire Department personnel ": carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. Mayor Larson then called for the roll call vote on the motion to pass Ordinance No. $54 as amended, and Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call, Motion carried. Kurbitz absent. ORDINANCE NO. $54, AN ORDINANCE relating to City personnel; designating job classifications/ and salary ranges for certain City positions; establishing the length of a work day and work week for certain City employees; authorizing special assignment and overtime pay; pro- viding for and regulating sick leave; amending Sections 2.20.088(b), 2.20.088(d), 2.20.100, 2.40.030A(1), 2.40.090 and 2.40.100A(2)(c); and repealing Sections 2.20.090 and- 2.20.095 of the City of Yakima Municipal Code. MOVED by Lambert, seconded by Robinson that Ordinance No. $55, providing for the position of Assistant City Manager and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. $55, AN ORDINANCE relating to City administration; providing for the appoint- ment of, and specifying the duties of, an Assistant City Manager, and enacting Section 1.1$.015 as a new section to the City of Yakima Municipal Code. Bids having been received and considered by a Bid Board on November 2$, 1966, for the Washington Avenue Interceptor Sewer Extension No. 2, and the following bids having been received: DeBlasio Bros. 3$,634.76 Tony Russell Constr. Co. 43,201.32 N. L. Kimball 4$,551.99 Oxford and Cook, Inc. 59,941.05 and the City Engineer recommending the bid of DeBlasio Bros., as being the low bid, it was MOVED by Robinson, seconded by Brazier that the recommendation of the City Engineer be accepted and said bid be awarded to DeBlasio Bros. in the amount of $3$,634.76, and that the City Manager be and hereby authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried,. Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. In accordance with statutory requirements of R.C.W. 35.22.420 regarding the appointment of the Municipal Court Judge to fill an unexpired term, Mayor Larson appointed Judge George H. Mullins to fill said unexpired term of Municipal Court Judge, to be effective until January 9, 1967, at which time Judge Mullins officially takes office because of his re- election at the November 11, 1966 Election. City Attorney Andrews recommended that Judge Millins' appointment as Municipal Judge be reaffirmed by the Mayor on January 9, 1967, in order to I/ satisfy all requirements which might possibly flow from the statute, and in order to pre - clude any question which might otherwise be raised by the Auditor. Mayor Larson read a letter of resignation from the Yakima City Council, from Councilman Brazier, to be effective December 1, 1966. Councilman Brazier stated that this decision is made with reluctance, but because of his recent election to the State Legislature, he feels that he should resign and allow the appointment of a new Councilman, who can give the position the regular attendance which it deserves. After much discussion in which each Councilman expressed regret at losing Councilman Brazier from the City Council, stating that he has contributed greatly to the meetings and City government and wishing him success i State Legislature, it was MOVED by Lambert, seconded by Robinson that the resignation of Councilman Brazier be accepted: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. 228 NOVEMBER 2$, 1966 Mayor Larson and Councilman Brown asking to be excused from the next Council meeting on December 5, 1966, to attend meetings out of town, it was MOVED by Brazier, seconded by Robinson that said requests be granted.: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote.. Kurbitz absent. It was then MOVED by Lynch, seconded by Lambert that Councilman Robinson be appointed Presiding Officer for the next. Council meeting on December 5, 1966, in the absence of Mayor Larson: carried, Brazier, Brown, Lambert, Larson and Lynch voting aye by voice vote. Kurbitz absent. An Application for an Outside Utility Hookup, having been filed on this date by Lawrence Moreau, 1$15 S. 12th Avenue, John Mayo, Public Works Director, stated that a Notice of Intention to Commence Annexation Proceedings No.. 493, which includes this property, has . been filed with the City Clerk. He further stated that the Petition to annex has not yet been received, but is expected within the 'next few weeks, and recommended that this outside hookup be granted. Planning Director, Rudy Gast, reported that there is some reluctance on the part of one property owner, the applicant's father, to sign the annexation Petition unless he is assured that the zoning will be as he wishes it, and that as yet . the required 75% of assessed valuation of the property involved in this annexation has not been acquired and this signature will give them over the 75%. Mr. Gast further stated that in view of this information, he is against recommending the granting of said outside agreement. Council members indicated that they felt that Mr. Moreau should not be kept from receiving the requested City services because of the unwillingness of others to sign a petition to annex, since he is willing to sign an outside hookup agreement and is in the process of trying to annex to the City. After due discussion, it was MOVED by Robinson, seconded by Lambert that said outside utility hookup be granted, providing an outside hookup agreement is signed by the applicant: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. There being no further business to come before the Council, it was MOVED by Brazier, seconded by Lynch that we do now adjourn at the hour of 4 :05 P.M.: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson vot'•e aye by voice vote.
