The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Lambert, and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Council- men Brazier, Kurbitz and Lynch absent on roll call. It was MOVED by Robinson, seconded by Brown that Councilmen Brazier, Kurbitz and Lynch be excused from this meeting: carried, • . Brown, Lambert, Larson and Robinson voting aye by voice vote. The Invocation was given by Councilman Brown. The minutes of the regular meeting of October 3, 1966, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . This being the time fixed for the continuation of the Hearing on Petition No. 482, as filed by Albertson's, Inc., requesting vacation of the alley between 5th and 6th Avenues from "B" Street to Lincoln Avenue, and the City Attorney reporting that the Ordinance has been corrected and rewritten as ordered at the previous Council meeting on October 3, 1966, it was MOVED by Brown, seconded by Lambert that Ordinance. No. 840, providing for said vaca- tion, be passed as read: carried, Brown, Lambert, Larson and Robinson voting aye on roll call. Brazier, Kurbitz and Lynch absent. . ORDINANCE NO. 840, AN ORDINANCE providing for the vacation of an alley in the City of Yakima, Washington. . MOVED seconded by Lambert that Resolution No. D -1007 vacating a public utility easement across property located off 58th Avenue on Marilane, as requested in Petition No. 485, filed by Ernest Wurl, be passed as read: carried, Brown, Lambert, Larson and Robinson voting aye on roll call. Brazier, Kurbitz and Lynch absent. City Manager Smith explained that this easement was in the original plat of this property, but when the water and sewer were put in, they were put in a different place on this property and there will never be any need for the City to use this easement. RESOLUTION NO. D -1007, A RESOLUTION vacating a public utility easement across Lot 17, Scenicview Terrace, City of Yakima, Washington. MOVED by Brown, seconded by Robinson that Resolution No. D -1008 consenting to the assign- ment of contract L.I.D. No. 952, Fairbrook Addition and Other Streets Paving, from -:— Bohannon Asphalt Paving, Inc., to Yakima Asphalt Paving Co., and extending the completion date, be passed as read: carried, Brown, Lambert, Larson and Robinson voting aye on roll call. Brazier, Kurbitz and Lynch absent. RESOLUTION NO. D -1008, A RESOLUTION consenting to the assignment of a public improvement contract from Bohannon Asphalt Paving, Inc., to Yakima Asphalt Paving Co.; and extending the completion date thereof. . A Resolution authorizing payment of a Claim for Damages filed by Donald L. Duckey, d /b /a_ D. L. Duckey Auto Freight, was read and discussed by Council members. City Attorney Andrews explained that this claim was filed in the amount of $305.52 for damages caused to claimant's truck by an overhanging limb of a tree, and that there has been an investigation which shows that the limb was hanging too low, and he therefore is recommending payment of said claim. Public Works Director, John Mayo, reported that North 8th Street on which this accident happened is a State Highway and indicated that the State might also have some responsibility in the upkeep of the street. After due discussion, it was MOVED by Robinson, seconded by Lambert that this matter be continued for one week, until October 17, 1966, to allow the Staff to further investigate said matter: carried, Brown, Lambert, Larson and Robinson voting aye by voice vote. Brazier, Kurbitz and Lynch absent. • . The City Engineer having reported on the completion of L.I.D. No. 958, Edgecliff Manor - Horizon Heights Replat Domestic Water Project and L.I.D. No. 959, Edgecliff Manor - Horizon Heights Replat Sanitary Sewer Project, it was MOVED by Robinson, seconded by Brown that November 7, 1966 be set as the time for a Hearing on the Assessment Rolls of said Districts, and that the City Clerk give notice by publication and to each property owner, as required by law: carried, Brown, Lambert, Larson and Robinson voting aye by voice vote. Brazier, Kurbitz and Lynch absent. The Planning Commission having reported on the following Petitions, requesting annexation: No. 479, filed by Mr. and Mrs. Earl J. Olson and Mr. and Mrs. Edward L. Daniel -- property located at the Northwest corner of Englewood Avenue and 58th Avenue; No. 484, filed by Mr. and Mrs. Pete Calza -- property located at the Southwest corner of Laurel and North 16th Avenue; and No. 486, filed by Mr. and Mrs. Albert Bales -- property located between Mead Avenue and Loren Avenue and West of South 18th Avenue, it was MOVED by Robinson, seconded by Brown that said •Petitions No. 479, 484 and 486 be approved as meeting the requirements of law; that the City Manager and the Mayor be authorized to obtain waivers of a meeting of a Review Board, as authorized by law; and that orders be prepared fixing October 24, 1966 as the time for a public hearing by the City Council on said Petitions: carried, Brown, Lambert, Larson and Robinson voting aye by voice vote. The Planning Commission having reported on Petition No. 487, filed by Bruce Rose, request- ing annexation of property between Nob Hill Blvd. and Mead Avenue, and 1st Street and the west right -of -way of the Union Pacific Railroad, it was MOVED by Lambert, seconded by Brown, that Petition No. 487 be approved as meeting the requirements of law; that the City Manager and Mayor be authorized to convene a Review Board, as required by law, for a hearing and review of this proposed annexation; and that an order be prepared fixing October 24, 1966, as the time for a public hearing by the City Council on this petition: carried, Brown, Lambert, Larson and Robinson voting aye by voice vote.
