OCTOBER 3, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilmen Kurbitz and Lynch absent on roll call. •It was MOVED by Robinson,. seconded by Brown that Councilmen Kurbitz and Lynch be excused from this meeting: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote. The Invocation was given by Councilman Lambert. . The minutes of the regular meeting of September 26, 1966, having been duly certified . accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. An Ordinance appropriating and authorizing the expenditure of, money, within the Transit Fund and attached Exhibit A, having been read in its entirety at the regular meeting on September 26, 1966, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 837 providing for said appropriation, be passed as read; Carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye on roll call. Kur- bitz and Lynch absent. ORDINANCE NO. 837, AN ORDINANCE appropriating and authorizing the expenditure of money, within the Transit Fund. This being the time . for the continuation of the Hearing on Petition No. 427, as filed by Marguerite and Will. J. Hackett, requesting vacation of Hamm Avenue between 17th and 18th Avenues, and said Hearing having been continued from time to time, Mayor Larson opened the hearing for discussion. Mr. Fred Halverson, Attorney representing the Hacketts, stated that all the required deeds have been acquired, with the exception of one. He indicated that this 20 foot property does not belong to Mr. Hanson, who has been objecting to this vacation, as previously believed, but by the former owner, Mrs. Woods, and that he has been unable to contact her so far. City Manager Smith, stated that the Staff feels that the Hacketts certainly have done everything they can to try to get this street through, and that we have sufficient assurance that we have all the necessary property, and recommends that this vacation be granted. An Ordinance granting said Vacation and a Resolution denying, having been prepared by. the City Attorney, it was MOVED by Robinson, seconded by Lambert that the Ordinance granting the Vacation of Hamm Avenue, be read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Councilman Robinson stated that as long as the Council will try to get the right of way deed from Mrs. Woods, he feels that this street and cul de sac will be a great improvement as far as the property is concerned. After due discussion, it was MOVED by Lambert, seconded by Brown that Ordinance No. 838 providing for the vacation of Hamm . Avenue between 17th and 18th Avenues, be passed as read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and Lynch absent. ORDINANCE NO. 838, AN ORDINANCE providing for the vacation of a public street in the City of Yakima, Washington. This being the time fixed for the continuation of the Hearing on Petition No. 456, as filed by Ruby W. Harrison, requesting rezone of property situated at 24th and W. Washingtor Avenues, and City Manager Smith reporting that there are still some areas involved on which all the legal work is not finished and requesting a continuation of this matter until all details can be worked out with property owners, it was MOVED by Robinson, seconded by Brown that said Hearing be continued for one month, or until the regular meeting of October 31, 1966: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by . voice vote. Petition No. 490,. Notice of Intention to Commence Annexation Proceedings, having been file with the City Clerk on September 29, 1966, By Robert P. Lewis for HYCO and Harvey T. Block for Block Distributing Company, requesting annexation of property located between Fruitval, Blvd., Madison Avenue, and East of 16th Avenue, it was MOVED by Robinson, seconded by Brazier that this date, October 3, 1966, be set as the time for a meeting with Mr. Lewis and Mr.Block, who signed said Petition No. 490, the Notice of Intention to Commence Annexation Proceedings, dated 9- 29 -66: carried, Brazier, Brown, Lambert, Larson and Robin- son voting aye by voice vote. Kurbitz and Lynch absent. Mr. Lewis and Mr. Block, indi- cating that the area to be annexed is willing to assume its share of the city's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by Petition No. 490, (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above Motion was made by. Robinson, seconded by Lambert and carried: Brazier, Brown, Lambert, Larson, and Robinson voting aye by voice vote. Kurbitz and Lynch absent. 0 Petition No. 491, Notice of Intention to Commence Annexation Proceedings, having been file. with the City Clerk on September 30, 1966, by Chester S. Meyer, requesting annexation of property located between Nob. Hill Blvd. and Viola Avenue East of South 45th Avenue, it was MOVED by Robinson, seconded by Brown that this date, October 3, 1966, be set as the time for a meeting with Mr.Meyer, who signed said Petition No. 491, the Notice of Intentiot to Commence Annexation Proceedings, dated 9- 30 -66: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Mr. Meyer, indicating that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was duly moved, seconded and passed that the annexation pro- posed by Petition No. 491, (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. Petition No. 493, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on September 30, 1966, by Lawrence Moreau, requesting annexation of property located between King Street and Washington Avenue, and 12th Avenue and Pleasan:, it was MOVED by Robinson, seconded by Lambert that this date, October 3, 1966, be set as the time of meeting with Mr. Moreau, who signed said Petition No. 493, the Notice of Intention to Commence Annexation Proceedings, dated 9- 30 -66: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote. This being the time fixed for a Hearing on the 1967 Budget, Mayor Larson opened the meeting for discussion. City Manager Smith referred to the suggested changes in the 1967 Budget that have been prepared for the consideration of the Council, since the adoption of the preliminary budget. He explained that since the Preliminary Budget had been prepared, which provided for approximately 21 percent salary increase for all City employees, the employment situation has become more critical as we are losing some of our personnel to higher paying positions and we are not attracting and obtaining trained people with our existing level of salary. Therefore in order to help this situation some revisions have been made which will make it possible to provide funds within the existing Budget to allow approximately a 5% increase in salary for all City Employees. He further explained that some needed items had to be deleted, because it is felt that it would be more im- portant to provide the additional range in salaries. Mr. Smith also explained that there will be an addition to the preliminary budget total, because of the addition of the • Transit Department, but therewill also be increased revenue shown in the estimated amount that will be received from bus fares and the Transit tax. Ken Groth, representing the City Fire Fighters, stated that although the City Fire Fighters are not ungrateful with the provisions made in the budget for the additional raise, they feel that the City Police and Fire Department employees are still not getting enough salary in comparison with other cities. -He further stated that they are losing employees to other cities and are unable to recruit new members at present salaries, and feel they will still have difficulty with the raises being allowed. He indicated that he would like to take back to the Fire Fighters some assurance that if more funds become available than are now anticipated in the budget, that another look will be at the budget at that time. Council members indicated that they realized that the City of Yakima does not compare in salaries to many cities and that we are losing employees to the Coast and other higher paying jobs, as are most'industries in Yakima, but that unless some other funds become available, they feel the City is spending its money to meet the key needs the best it can. They further indi- cated that they feel the budget has been well and carefully prepared, . by allocating the funds that are limited, to "the priority needs and are hopeful that 226 passes, so that in the future.it will be possible to more nearly meet the needs of the City of Yakima and its City employee After due discussion, Mayor Larson stated that this meeting.. will ~' be- continued until Thursday, October 6, at 9:00 A.M., as far as the budget is concerned, . when we will meet to pass the final budget. He further stated that it is necessary to have an ordinance prepared that will incorporate the adjustments. • This being the time fixed for the hearing on Petition No. 482, as filed by Albertson's Inc.,. requesting vacation of the alley between 5th and 6th Avenues from "B" Street to the north line of Lots 5 and 12 and City Attorney reporting that the Ordinance that had been prepared needs to be re- written, it was MOVED by Robinson, seconded by Lambert that said Hearing be continued for one week or until October 10, 1966: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote. Petition No. 488, having been filed with the City Clerk on September 28, 1966, requesting improvement of property by the construction of a sewer on lots on the west side of N. 56th Avenue in the first block South '."of,Scenic Drive, it was MOVED by Lambert, seconded by Brown that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown;- Lambert, Larson and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Councilman Brazier excused at 4:10 P.M. Petition No. 489, having been filed with the City Clerk on September 29, 1966 by Evelyn E. Wilts & Others, asking the Council to reconsider and rescind Ordinance No. 833, changing the name of a portion of Fair Avenue to South 10th Street, and to restore the name to Fair Avenue, Mayor Larson opened the meeting for discussion. Mrs. Evelyn Wilts stated that quite a number of the people who had signed this petition are present and that they want Ordifmce N.o. 833 reconsidered . and rescinded and the name of Fair Avenue be left as it is and /changed to South 10th Street as the Ordinance states. She further indicated that they believe it would be better for the County to change the short portion of 10th Street in the County to Fair Avenue to make the street name uniform. Others speaking in favor of leaving this street named Fair Avenue were Mrs. Pleasant, Mrs. Volavka, and Mrs. Katherine Chandler. City Manager Smith explained that the request to change this portion of Fair Avenue to So. 1Oth Street had not originated with the City Council, but that the request had come from a Mr. Tom Kilbury of the Post Office Department, and since this petition has been filed, with so many people against this name change, that possibly more investigation should be done on this matter. Councilman Robinson pointed out that the Post Office Department had made the request of the City Council to change street names whereever it would help the post office department, delivery people and others to find addresses easier, and that an effort has been made to do this. Councilman Brown indicated that he feels that there should be a blend of some of the streets, but agrees with the people of Fair Avenue, that it should be Fair Avenue. After due discussion, it was MOVED by Lambert, seconded by Robinson that this matter be referred back to the City. Manager and Staff for further study and recommendation: carried, Brown, Lambert, Larson, and Robinson voting aye by voice vote. Brazier,Kur'bitz,:and Lynch absent. The people will be informed when there is another hearing on this matter. Petition No. 492, having been filed with the City Clerk on September 30, 1966, by Edward D. Johnson, requesting the vacation of a water and sewer easement, portion of Nelson's Nob Hill Addition, and City Attorney Andrews informing the Council members that in most cases a request for water and /or sewer easement vacation does not need to have a hearing as do other vacation requests and that a resolution can be prepared for the Council's consideration, it was MOVED by Robinson, seconded by Lambert that said petition be referred to the City Manager and Staff: for study and recommendation and that a resolution be pre- pared and presented to the Council at the next regular Council meeting: carried, Brown, Lambert, Larson, and Robinson voting aye by voice vote. Brazier, Kurbitz and Lynch absent. 213 OCTOBER 3, 1966 An application for city water service outside the City Limits, having been tiled by Bernard Wine on September 19, 1966, and the Planning Department having recommended approve of said request,it was MOVED by Robinson, seconded by Brown that said application be grantld upon the condition that Mr. Wine sign the outside hookup agreement: carried, Brown, Lambert, Larson, and Robinson voting aye by voice vote. Brazier, Kurbitz, and Lynch absent. John Mayo, Public Works Director . stated that Mr. Wine had indicated that he will sign the out - side hookup agreement, but had indicated he planned to use plastic line, which cannot be used according to the City Code. The Council asked Mr. Mayo to inform Mr. Wine of this fact, and in signing the outside hookup agreement, he agrees to use materials acceptable to. the City Code. Mr. Mayo stated he was sure this would be agreeable to Mr. Wine and that he would sign the outside hookup agreement. The following bids having been received on October 3, 1966 and considered by a Bid Board, for the construction of the Washington Avenue 16" Domestic Watermain with Grid Mains - 16th Avenue to 10th Avenue; DeBlasio Brothers $54, 252.48 Oxford & Cook 55, 597.37 . Kreager. Constr. Co. Spokane 66, 487.36 Lester N. Johnsln Co., Spokane • 68, 588.19 and City Engineer recommending the bid of DeBlasio Brothers as being the low bid, it was MOVED by Robinson, seconded by Brown that the recommendation of the City Engineer be accepted and said bid be awarded to DeBlasio Brothers in the amount of $54,252.48, and that the city Manager be and is hereby authorized to enter into contract with said con - tractor upon the filing of the proper bond and insurance: carried, Brown, Lambert, Larson, and Robinson voting aye by voice vote. City Manager Smith recommending and requesting authorization for Frank Stein, Director of Public Utilities, and Paul Page to attend the Pacific Northwest Polution Control Conference to be held in Portland, Oregon from October 19 to 21, 1966 at an approximate cost of $65.0 , it was MOVED by Lambert, seconded by Robinson that said trip be allowed with expenses paid; carried, Brown, Lambert, Larson and Robinson voting aye by voice vote(:. Brazier, Kurbitz, and Lynch absent. ._. There being no further business to come before the Council, it was MOVED by Robinson, seconded by Brown that we do now recess at the hour of 5:00 P.M. , to continue the hearing on the 1967 Budget on Thursday morning, October 6, 1966, at the hour of 9:00 A.M. carried, Brown, Lambert, Larson and Robinson voting aye by voice vote. Brazier, Kurbitz and Lynch absent. RECESSED MEETING, THURSDAY, OCTOBER 6, 1966 The City Council met on this date pursuant to recession, Mayor Larson convening the meeting at the hour of 9:00 A.M. Councilmen Brazier, Brown, Lambert, Larson and Robinson and City Manager Smith present on roll call. Councilmen Kurbitz and Lynch and City Attorney Andrews absent on roll call. It was MOVED by Robinson , seconded by Brown that Council- men Kurbitz and Lynch be excused from this meeting: ((City Attorney Andrews was in Court at this hour.\) Carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote. After due discussion and consideration, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 389 adopting a budget for the year of 1967, and fixing and levying the amount of taxes necessary to balance said budget, be passed as read: carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye on roll call. Kurbitz and Lynch absent. . ORDINANCE NO. 389, AN ORDINANCE adopting a budget for the City of Yakima, Washington, for the year of 1967, appropriating funds for the estimated expenditures, and fixing and levying the amount of taxes necessary to balance the estimated revenue with the . estimated expenditures. Public Works Director John Mayo, reported on a meeting with the County Engineers and County Commissioners on the matter of a permanent signal light on Nob Hill Blvd. and S. 10th Street. He indicated that County officials passed a resolution wherein they will assume three - fourths of the cost for such a safety signal and the City be asked to par- ticipate by paying one - fourth. After due discussion, it was MOVED by Robinson, seconded by Brown that the City join with the County in the cost, and install . the ::.traffic• . signal at Nob Hill Blvd. and S. 10th Street: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote.
