HomeMy WebLinkAbout09/26/1966 Business Meeting 209 . • SEPTEMBER 26, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith_and City Attorney Andrews present on roll call. • Kurbitz absent on roll call. It was MOVED by Robinson, seconded by Lambert that Councilman Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. - The Invocation was given by Councilman Lynch. The minutes of the regular meeting of September.19, 1966, and the recessed meeting thereof, having been duly certified accurate by two. Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on Petition No. 427, as filed by Marguerite and Will J. Hackett, requesting vacation of Hamm Avenue between 17th and 18th Avenues, and a. request to continue said Hearing for one week, having . been received from Attorney Fred Halverson, it was MOVED by Robinson, seconded by Brown that said Hearing be continued until October 3, 1966: carried, Brazier, Brown, Lambert, Larson, Lynch and Robin- son voting aye by voice vote. Kurbitz absent. This being the time fixed for the Hearing on Petition No. 473, as filed by G. Dick Martin, requesting rezone of property located at 1013 and 1017 South 28th Avenue, and the Planning Commission having recommended denial of said rezone request, it was MOVED by Robinson, seconded by Lambert that Resolution No. D -1003 denying said application for rezone, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. In discussion, Mr. Martin stated that he still feels that the property is worthy of consideration for business uses and that it is too narrow for most any other uses. He further stated that he wants to put in a music business and feels that it will not be a handicap in this vicinity. He also mentioned that there are two houses on this property, but that there is a lot of rubbish from Cahoon's grocery store that blows all over the property, which does not make it condusive for residential use. Mrs. Ruby Anderson, property owner next to Mr. Martin's property, spoke in favor of this rezone. Council members indicated that they agree with the recommendation of the Planning Commis- sion that the present zoning, R -2, Two - Family Zone and R -3, Multiple Family Zone, is the proper zoning for this area, and informally suggested that the Staff check the matter of the rubbish problem in connection with Cahoon's grocery store. RESOLUTION NO. D- 1003, A RESOLUTION denying an application for rezoning property situated at 1013 and 1017 South 28th Avenue from R -2, Two- Family Zone, and R -3, Multiple Family Zone to B -2, Local Business Zone. MOVED by Lambert, seconded by Lynch that Ordinance No. 834, creating the Transit Department and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Brown, Lambert Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. 834, AN ORDINANCE relating to administrative departments of the City of Yakima; creating the Transit Department as a new department; designating a department head; defining the duties of such department; amending Section 1.18.100 of the City of Yakima Municipal Code; adding Section 1,18.195 as a new section to the City of Yakima Municipal Code; and declaring an emergency. MOVED by Lynch, seconded by Brown that Ordinance No. 835, creating the Transit Fund and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. 835, AN ORDINANCE creating a special fund to be known as the Transit Fund; specifying the purpose of such fund; specifying the sources of revenue for such fund; specifying expenditures to be made from such fund; adding Chapter 3.68, "Transit Fund ", as a new chapter to the City of Yakima Municipal Code; and declaring an emergency. An Ordinance appropriating and authorizing the expenditure of, money, within the Transit Fund, having been read in its entirety, and the attached Exhibit A itemizing said appropria- tion having been read in full, said Ordinance and Exhibit A was ordered laid on the table for one week or until the regular meeting of the City Council to be held October 3, 1966. MOVED by Brown, seconded by Robinson that Ordinance No. 836, relating to the classification and compensation plan for employees of the City Transit Department and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 836, AN ORDINANCE relating to City employees; specifying the work week and hours of duty for City employees; specifying a classification plan for City Transit Depart- ment employees; amending Section 2.40.090 of the City of Yakima Municipal Code; amending Section 2.20.100 of the City of Yakima Municipal Code by adding thereto a new Subsection (1); and declaring an emergency. MOVED by Lynch, seconded by Lambert that Resolution No. D -1004 authorizing a temporary loan not to exceed $15,000, to the Transit Fund from the Domestic Water Supply Development Reserve Fund, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robin- son voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -1004, A RESOLUTION authorizing a temporary loan, not to exceed $15,000.00, from the Cumulative Reserve Fund for Domestic Water Supply Development to the Transit Fund, and providing for repayment. MOVED by Robinson, seconded by Brown that Resolution No. D -1005 establishing a schedule of I/ routes and fares for the public bus transportation system operated by the City of Yakima, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. D -1006, A RESOLUTION authorizing the settlement of pending litigation en- titled Florence L. Johnson, Plaintiff vs. City of Yakima, Defendant, in the Superior Court of the State of Washington in and for Yakima County.
