HomeMy WebLinkAbout09/12/1966 Business Meeting 205 SEPTEMBER 12, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Kurbitz absent on Roll Call. It was MOVED by Robinson, seconded by Lynch that Councilman Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The Invocation was given by Councilman Brown. The minutes of the regular meeting of September 6, 1966, having been duly certified accur- ate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Resolution No. D -994, being a Resolution of Intention to improve certain streets and alleys by constructing concrete curbs, gutters and surfacing, in accordance with Petitions No. 434, 480, 475, 472, 477 and 467, it was MOVED by Lambert, seconded by Brown that Ordinance No. 831, providing for said improvement, be passed as read. Mayor Larson opened the Hearing for discussion. Attorney Jim Lust, repre- senting property owners in the vicinity of the alley in Block 24, stated that protests • against this portion of the L.I.D. had been filed with the City Clerk amounting to over 60% and feel$ that this portion should be eliminated from the proposed L.I.D. Public Works Director, John Mayo, reported that said protests amount to considerably in excess of.60%. He also reported that protests filed with the City Clerk on the Garrett Street portion of the proposed L.I.D. amount to 47%, with most of this amount concentrated on the East end of Garrett Street. Mr. Art Willoughby, 1003 N. 10th Avenue, spoke against the Garrett Street portion of the proposed L.I.D. He stated that most of the property owners from 9th to llth Avenues are against the proposed L.I.D., and that from llth to 15th, more are for it. He further explained that 10th Avenue has not been included in the proposed L.I.D., and if it were, he•would be in favor of this L.I.D., and possibly some of the ones protesting would also change their minds. Councilman Robinson explained that if a Petition is filed by the property owners on 10th Avenue requesting improvement, it could be included. He also suggested that since the majority of the protests are in one section, Ordinance No. 831 could be amended to eliminate the portion between 9th and llth Avenues and leave in the West portion between llth and 15th Avenues. Mrs. Moberly, 1402 Garrett Street, spoke in favor of this L.I.D. .Mr. Frank Kolb,.property owner in the Alley 24 portion of this L.I.D. stated that he knew of a possible four property owners that had signed the protest petition, that might be swayed to remove their names from this list, which would make the percentage considerably less than 60%, and suggested that this portion not be deleted from Ordinance No. 831 until the allowable thirty -day period to file protests or remove names from protest lists is over. Mrs. Hattie Foley, property owner in this vicinity, spoke against the proposed Alley 24 portion of this L.I.D., stating that she believes this portion should be eliminated. Mr. Fred Baur, property owner in the Lewis Avenue portion of this L.I.D., . spoke, indicating that he understands that they are not going to get curbs on their street and asked if retaining walls will be put in where the lots have a very steep grade to the. street. John Mayo, Public Works Director, explained that this street is only 25 ft. wide, making it impossible to have two-way traffic and curbs and gutters. He further explained that the street would be slanted to the middle for drainage purposes, and that some type . of guard rail would be put up on property that slanted too much to the street, and stated that if retaining walls were put in, it would practically double the cost of the project. Mr. Baur suggested making this a one -way street. Mr. Mayo stated that this could be studied by the Traffic Committee and with the eo le in the vicinity, and suggested that Mr. Baur meet with him after the Council meeting to discuss the possibility of working out a satis- factory agreement with the property owners in this vicinity in regard to one -way traffic, and work out answers to other problems on this portion of the L.I.D. Council members indi- cated that since there may be more protests which may delete other parts of this improvemen, making it necessary to amend Ordinance No. 831, it would be better to vote on the Ordinance as it reads, and wait until the thirty -day protest period is over, to amend it. After due discussion, Mayor Larson called for the roll call vote to pass Ordinance No. 831 as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 831, AN ORDINANCE providing for the improvement of certain property by grad- ing, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, pro- viding for the method of payment thereof, and creating a special fund. Petition No. 486, A Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on September 2, 1966, by Albert. R. and Lydia Bales, requesting annexation of property located West of 18th Avenue, between Mead and Loren Avenues, it was MOVED by Robinson, seconded by Lynch that this date, September 12, 1966, be set as the time for a meeting with Mrs. Bales, who signed said Notice of Intention No. 486, dated 9/2/66: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. 'Mrs. Bales, being present, and indicating that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was duly moved, second- ed and passed that the annexation proposed by Petition No. 486, (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above motion was made by Robinson, seconded by Brown and carried: Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. Petition No. 487, having been filed with the City Clerk, on September 12, 1966, by Bruce R. Rose and others, requesting annexation of property including railroad tracks, and S. 1st Street between E. Nob Hill and Mead Avenues, it was MOVED by Robinson, seconded by Lambert that said Petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. MOVED by Robinson, seconded by Lambert that Ordinance No. 832 relating to building regula- tions, adopting by reference the "National Electrical Code, 1965 Edition ", and amending and repealing certain sections of the Yakima Municipal Code, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. Mr. Dick Wilson, being present, protested the repealing of Subsection 11.16.110 F of the Yakima Municipal Code, which specifies the use of metal conduits. Mr. Don Picatti, electrical contractor, being present, spoke in favor of plastic conduits, indicating that it it used in concrete and costs less for installation. In voting yes on the passage of 206 SEPTEMBER 12, 1966 Ordinance No. $32, Councilman. Lambert stated that since the Ordinance was first read, because of information received during discussion, she has changed her views on this sub - ject and does feel that the improvements that have been made in plastic for such uses as this pipe have proven that possibly the time has come when these changes should be made. Councilman Lynch stated that he feels that we are not lowering the Code of Yakima, in vot- ing for the passage of this Ordinance, and that the restrictions we had in prior years were well established, but improvements have been made. Councilman Robinson stated that he appreciates the activity of the electrical industry and feels we should be in step with the National Code. Mayor Larson.stated that he voted for the passage of this Ordinance because he has been in contact with the use of the plastic pipe and feels it is good. ORDINANCE NO. $32, AN ORDINANCE relating to building regulations;. adopting by reference the "National Electrical Code, 1965 Edition" (National Fire Protection Association Pamphlet No. 70) and the "Rules and Regulations for Installing Electrical Wires and Equipment" of the Electrical Inspection Division of the Department of Labor and Industries of the State of Washington, Edition of March 1, 1966 and making exceptions thereto; deleting certain gen eral wiring specifications; amending Section 11.16.040 and repealing Subsection 11.16.110 F of the City of Yakima Municipal Code. MOVED by Robinson, seconded by Brown that Resolution No. D -996 directing the execution of a right of way crossing agreement with Northern Pacific Railway Company, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kur- bitz absent. RESOLUTION NO. D -996, A RESOLUTION directing the Mayor and City Clerk of the City of Yakima to execute a right of. way crossing agreement with Northern Pacific Railway Company. MOVED by Robinson, seconded by Lynch that Resolution No. D -997 adopting the 1967 Prelimi- nary.Budget, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robin- son voting aye on roll call. Kurbitz absent. City Manager Smith reported that at the time the Preliminary. Budget was prepared, only an estimated property tax assessment had been received from the Assessor's Office, and since that time the final figure of $5$,474,0$2.00 has been received for use in figuring the final Budget, He further stated that since this figure is less than the estimated figure, minor reductions will have to be made in some of the current expense figures, before the final Budget is prepared. RESOLUTION NO. D -977, A RESOLUTION adopting the 1967 Preliminary Budget for the City of Yakima, setting a date for hearing on the adoption of the 1967 Final Budget, and directing the City Clerk to give notice of budget proceedings. MOVED by Lynch, seconded by Robinson that Resolution No. D -99$, being a Resolution of appreciation to the League of Women Voters of Yakima, the Metropolitan Merchants Associa- tion and the Yakima Jaycees for conducting a Political Street Fair, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kur- bitz absent. . RESOLUTION NO. D -998, A RESOLUTION of appreciation to the League of Women Voters of Yakima, the Metropolitan Merchants Association and the Yakima Jaycees for conducting a Political Street Fair. The Planning Commission having reported on Petition No. 4$2, as filed by Albertson's, Inc., requesting vacation of the alley between 5th and 6th Avenues from "B" Street to the North line of Lots 5 and 12, and recommending said vacation, it was MOVED by Robinson, seconded by Lambert that Resolution No. D -999 fixing the time of hearing by the City Council on said Petition for October 3, 1966, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -999, A RESOLUTION fixing the time and place for hearing on petition for vacation of an alley. . The Planning Commission having reported on Petition No. 4?3, as filed by G. Martin, request- ing rezone of property located at 1013 and 1017 S. 28th Avenue, in accordance with the formal Motion passed by the City Council on July 25, 1966, and recommending denial of said rezone, it was MOVED by Robinson, seconded by Lynch that September 26, 1966 be fixed as the time for a Hearing by the City Council for further considering said application: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz ab- sent. A Damage Claim, having been filed with the City Clerk on September $, 1966 by W. C. Britt, it was MOVED by Lynch, seconded by Robinson that said damage claim be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. Mr. Lawrence Morrow, property owner in the vicinity of the new school site in the Broadway district, being present, asked questions about annexing to the City of Yakima. He stated that his property is not contiguous to the City, but is connected to the new School site. Fritz Jaeger, City Engineer, explained that they have been trying to prepare a larger and more orderly annexation in the Broadway area. Council members indicated that they feel that everything possible should be done to help Mr. Morrow work out an annexation or an outside hookup agreement. Councilman Lynch stated that apparently there has been some misunderstanding as to the City Council's position on the issues on the ballot, and to clarify this situation he suggested that the City Council go on record as favoring the three City issues, namely: Tax Levy for Metropolitan Park District Current Expense; Yakima Municipal Airport Bonds -- $69$,000; and Leasing, Operating, Subsidizing City Transit. After due discussion, it was MOVED by Lynch, seconded by Lambert that this City Council endorse the favorable vote on all three City issues that are on the ballot: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. Councilman Lynch further stated that he does not understand why the doubt in people's minds, as Council members have been work - ing for months on all of these issues. He also stated that there has been some feeling that the Council is not behind the bus issue, and he has been trying for months to get busses in the City and has worked diligently for a bus line. ■ 207 `+a SEPTEMBER 12, 1966 City Manager Smith requested that the completion date of the contract with the Department of Commerce and Economic Development relative to the Yakima Central Business Study, be extended from September 15, 1966 to November 1, 1966. He stated that they plan to use the month of October to more thoroughly expose their plan around the City and during the first week or two of November, to finalize their plan. It was MOVED by Robinson, seconded by Brown that the completion date of said contract be extended through October 31, 1966: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent.
