HomeMy WebLinkAbout07/18/1966 Business Meeting • 187 • • JULY 18, 1966 The -City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll • calf. Kurbitz - absent on roll call. It was MOVED:by Robinson, seconded by Brazier that Councilman Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz present after. 8:15 P.M. The Invocation was given by Councilman Lambert. The Minutes of the regular meeting of July 11, 1966, having been duly certified accurate by two. Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . This being the time fixed for continuation of the hearing on Petition No. 427, as filed by Marguerite and Will J. Hackett, requesting the vacation of a portion of Hamm Avenue, said.' matter having been continued from . March 21, 1966, I'4ayor Larson opened the meeting for dis- cussion. Mr. Fred Halverson, Attorney representing the Hacketts., stated that there is a discrepancy in the legal description of said vacation and requested a continuation of said hearing in order to complete all the necessary legal work on this matter. After due dis- cussion, it was MOVED by Brazier, seconded by Brown that said matter be continued until • August 1, 1966: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. In the matter of the reconsideration of Ordinance No. 816, providing for the vacation of a . portion of W. Walnut Street, City Manager Smith reported that all the necessary deeds from property owners involved in said vacation are now on file. Councilman Brazier.stated that • he would not move for the reconsideration of said Ordinance as previously stated at the regular Council meeting on July 11, 1966, since all the necessary easement deeds are on file. Mayor Larson. stated that Ordinance No. 816 stands as passed on July 5, 1966. Councilman Kurbitz present after 8:15 P.M. . Petition No. 478, having been filed with the City Clerk on July 14, 1966, by Donald L. Wolf stone, requesting rezone of.property located at.24th and Nob Hill Boulevard, and Mr. Wolf- stone being present, spoke to the Council on matters relating to this Petition. Mr. Wolf- stone, representing the Wolfstone Investment and Real Estate Company, Seattle, Washington, who are the developers of the Nob Hill Plaza development, (Montgomery Ward Plaza), discusses the zoning ordinance relative to uses allowed under B -2 and B -3 zoning and specifically dis - cussed the matter of sale of alcoholic beverages by a retail tenant under the existing zon- ing regulations'. Mr. Wolfstone stated that he has a prospective tenant for an Italian type restaurant, .who wishes to locate in the Nob Hill Plaza development and serve beer on the premises in connection with the restaurant. He further indicated that he realizes that action on his request may not help his situation because the buildings are almost finished, • • but feels that in any large shopping center such as this, •provision should be made for a restaurant which will be able to serve beer and /or liquor in connection with food, and woulc hope.that investigation of this matter will be made. Council members discussed various • phases of the zoning code in connection with serving of beer or liquor on premises and limitations with regard to residential zoning, and indicated that they would like to have the Planning Commission study the matter, making inquiries of other cities to find out how they handle similar situations, and report their findings and make recommendations back to the Council. After due discussion, it was MOVED by Lynch, seconded by Brazier that the • matter of Petition No. 478 and the zoning in connection with shopping centers, and the possibility of changing the zoning code to accommodate restaurants wishing to serve beer and /or liquor in connection with food, be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson votin• aye by voice vote. . Petition No. 479, A Notice of Intention to Commence Annexation Proceedings, having been • filed with the City Clerk on July 18, 1966, by Edward L. Daniel, requesting annexation of property located on N. 58th Avenue, North ofEnglewood Avenue, it was MOVED by Robinson, seconded by Lynch that this date, July 18, 1966, be set as the time for a meeting with Mr. Daniel, who signed said Notice of Intention No. 479, dated 7/18/66: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Mr. Daniel, being present, and indicating that the area to be annexed is willing to assume its share of the city's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by Petition No. 479, (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought-to be annexed be required to assume • the City's existing indebtedness. The above notion was made by Robinson, seconded by Lam- bert and carried: Brazier,. Brown, Kurbitz,. Lambert, Larson, Lynch and Robinson • voting aye by voice vote. • The following bids having been received on July 5, 1966, and considered by the Bid Board for Nob Hill Boulevard Paving, 4th Avenue to 12th Avenue, L.I.D. No. 916: Yakima Cement and Asphalt Paving Co. $ 93,387.50 • DeBlasio Brothers 97,292.00 and the letter from the City Engineer recommending the bid of Yakima Cement and Asphalt Paving Company as being the lowest bid, was read and discussed, and since all of the right - of -way on Nob Hill Boulevard has not been obtained, it was MOVED by Robinson, seconded by Brown that the matter of awarding said bid be continued to a date not later than August. 1, 1966: carried, Brazier, Brown, Kurbitz, Lambert, Larson, lynch and Robinson voting aye by • voice vote. Mr. Fred Sweitzer of Sweitzer Aircraft, being present, spoke on a matter of safety of air • traffic at the Yakima Municipal Airport. He stated that Yakima has been very lucky in not having any plane accidents Airport, but stated that recently, there could have been a very bad one, had not the. alert pilot been able to avoid it. Mr. Sweitzer further indi- cated that he feels that the Airport rules and regulations being used at the present time are out of date for modern airplanes and suggested that the Council work tith the Airport Manager, the FAA, the Airlines Companies and Base operators to up -date rules and regulation pertaining to flight patterns and other safety factors. After due discussion, it was MOVED by Lynch, seconded by Brazier that this matter be referred to the City Manager and Staff for study and recommendation: carried,_ Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. City Manager Smith explained that the Airport is work- ing under rules set up more recently than those mentioned by Mr. Sweitzer. • p 188 JULY 1$, 1966 . City Manager Smith reported that the Airport Study Committee has recommended that the City Council authorize Bond'..Attorney, Richard Thorgrimson of Preston, Thorgrimson, Horowitz, Starin & Ellis, to prepare the necessary Bond Ordinance to submit to the voters of the City of Yakima at the Primary Election on September 20, 1966, the matter of a Bond Issue of some 3698,000 for the purpose of improving the Yakima Municipal Airport. After due discussion, it was MOVED by Robinson, seconded by Lambert that the staff be authorized to proceed with this matter and have the necessary Ordinance prepared: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
