HomeMy WebLinkAbout07/05/1966 Business Meeting 181 JULY 5, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Kurbitz absent. It was MOVED by Robinson, seconded by Lynch that Councilman Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz present after 3:05 P.M. The Invocation was given by Councilman Lynch. The minutes of the regular meeting of June 27, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes' approved as recorded. Mayor Larson stated that we would deviate from the regular Agenda to present an item of special interest to the Council members to the Council members and the people of Yakima. A special Resolution of commendation and appreciation to Police Chief Oscar Soderstrom, having been read, it was MOVED by Lynch, seconded by Robinson that Resolution No. D -973 commending and stating the appreciation of all the citizens of Yakima and extending the best wishes of all to Chief Soderstrom in his retirement from the Yakima Police Force and in his continued law enforcement career, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. Each of the Councilmen expressed his regrets at the loss of Chief Soderstrom from the Yakima Police Force and commended him on the fine work he has done for the City of Yakima in his 29 years of service. .• Mayor Lar- son then presented Chief Soderstrom with a copy of Resolution No. D-973. Chief Soderstrom accepted the Resolution and stated he is leaving with mixed emotions, and thanked the Coun- cil and the people of Yakima, but said that without the fine Police Force, City personnel and all the other people he has worked with, his work could not have been accomplished. Kurbitz present after 3:05 P.M. RESOLUTION NO. D -973, A RESOLUTION of commendation and appreciation to Oscar Soderstrom, Chief, Yakima Police Department. . Mayor Larson stated that again we will deviate from the regular Agenda, as members of the Park Board, being present, have a presentation to make. Mr. Ed Putnam, Superintendent of Parks, introduced J. F. Chesterly and Jim Nolan, members of the Park Board. Mr. Nolan stated that he is present to make an appeal to the City for more money in the budget upkeep of the City parks. He further stated that the Park Board has gone to the County Commissioners, who said "No" and have hopes of finding some way to get more money for the City Parks, than by having to take the problem to the people in the form of a levy. He pointed out, that as in everything else, park costs have gone up and more money is needed to maintain them, and that he is asking the Council's help in making the problem known to the people of the City of Yakima, so that they will realize that if they want the parks, they will have to pay for them. Council members indicated that they are aware of the park difficulties and have noticed how much these parks are used by the people. They further indicated that they appreciate Mr. Nolan expressing the view of the Park Board to the Coun- cil, but that the City is in the same position as the County in that there is not enough money allowed in the Budget for additional funds for the Parks Department at the present time,: They indicated that there is nothing that can be done at the present time and this matter will probably have to be taken to the people for a special levy. Mr. Nolan expressed thanks to the. Council for listening to him and suggested that a long range study be made on the problem and asked if a member of the Council would serve on a committee to make this study. Mayor Larson indicated that if the Park Board will make a formal request to the Council, when such a committee is formed, that the Council no doubt will want to partici- page in such a program. This being the time fixed for the continuation of the hearing on Petition No. 453, as filed by Neal Turner and Others, requesting vacation of a portion of West Walnut Street, Mayor Larson opened the meeting for discussion on said vacation. Mr. Countryman, property owner, stated that he has two of the quit claim deeds required, to tender to the City to make . possible the cul -de -sac in this vacation, and regarding the church property, the transaction . has to be passed on by the Church Board members, but he is positive that this will be passed and the quit claim deed given to him in a short time. He also 'stated that he has assurance by the other property owner that he will obtain this deed also. Councilman Lynch stated that he is against vacating the portion of W. Walnut street from Bel Air to 44th Avenue, but would be willing accept . the vacation of the portion east of Bel Air Drive. He further stated that he believes that this portion of the road should be kept open to 44th Avenue in case it should be needed in the future and will vote against the Ordinance providing for said vacation for these reasons. Councilman Robinson stated that he is against vacating all of the requested area. He further indicated that though this area is something the City may never need, it should be available to the City if they do need it in the future. He also stated that the proposed Ordinance does not state where the easement for a pedestrian walk- way in the requested vacation should be allowed for and suggested that the Ordinance be amended. Councilman Lambert stated that the Council members agreed, as stated in the minutes of June 13, 1966, "that an Ordinance be drawn in accordance with the Planning Commission's recommendation in their letter to the Council of May 6, 1966, changing it to read, from Bel Air Drive to 44th Avenue for the pedestrian easement to be retained." After due dis- cussion, it was MOVED by Brazier, seconded by Lambert that Ordinance No. 816 be amended in Section 2, to add after "together with an easement for a pedestrian walk -way" the sentence, "on the vacated portion of Walnut Street from Bel Air Drive to 44th Avenue," etc.: carried, Brazier, Brown, Kurbitz and Lambert voting aye by voice vote. Larson, Lynch and Robinson voting nay by voice vote. There was some discussion by Council members about the requested cul -de -sac. Councilman Kurbitz stated that he cannot see why the cul -de -sac is needed on this amount of property. Planning Director, Rudy Gast, explained that if a cul -de -sac is not put in, one parcel of property would not have access to the street and further stated that we would not want to create land - locked property. Mayor`Larson called for the roll call vote to pass Ordinance No. 816 as amended: carried, Brazier, Brown, Lambert and Larson voting aye on roll call. Kurbitz, Lynch and Robinson voting nay on roll call. Councilman Robinson again expressed concern about vacating property that possibly may be needed in the future, and also indicated he felt that the other two quit claim deeds should be acquired before any such vacation would go into effect. Councilman Brazier announced his intention to move for reconsideration of Ordinance No. $16 providing for said vacation, at the next regular Council meeting on July 11, 1966. ORDINANCE NO. 816, AN ORDINANCE providing for the vacation of a portion of West Walnut Street in the City of Yakima. 0 , IL 182 • JULY 5, 1966 This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 944, High View Courts and Various Others Domestic Water, and there being no protests in writing or otherwise, it was MOVED by Robinson, seconded by Brown that Ordinance No. $17 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. $17, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 944 as created and established by Ordinance No. 705 of the Ordinances of the City of'Yakima. Petition No. 476, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on June 30, 1966, by Fred Hammerstad for United Builders of Washington 1 Inc., requesting annexation of property located between Nob Hill Blvd. & Arlington, West of 47thlAvenue, it was MOVED by Robinson, seconded by Lynch that this date, July 5, 1966, be set as the . time for a meeting with Mr. Fred Hammerstad, who signed said petition No. 476, the Notice of Intention to Commence Annexation Proceedings, dated 7/5/66: carried, Brazier, Brown, Kurbitz, Lambert, Larson , Lynch and Robinson voting aye by voice vote. Mr. Hammer - stad, indicating that the area to be annexed is willing to assume its share of the city's existing indebtedness, it was duly moved, sedonded and passed that the annexation proposed by petition No. 476, (Notice of Irtention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above motion was made by Robinson, seconded by Lynch and carries: Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Petition No. 477, having been filed with the City Clerk on July 1, 1966, by Ronald W. Poole, requesting improvement of streets by constructing concrete curbs, gutters and surfacing of property located in Horizon Heights, it wag MOVED by Lyn*, seconded by Robinson that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier!, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. An Ordinance appropriating $5,000 to the 1966 Engineer's Budget to construct partitions and install new lighting in the City Engineer's Office, having been read in its entirety, was ordered laid on the table to be read and considered at the next regular meeting of the City Council on July 11, 1966. • MOVED by Brown, seconded by Robinson that Resolution No. D -974, a Resolution of Intention to improve property by constructing a pipe sewer . and create a local improvement district, . in accordance with Petition No. 469, and fixing the date of hearing for July 25, 1966, be passed as read: carried, Brzier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. MOVED by Robinson, seconded by Lambert that Resolution No. D -975 authorizing the purchase o materials and hiring work and labor, without calling for bids to construct a domestic water main on 56th Avenue, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye on roll call. Brown excused from voting. RESOLUTION NO. D -975, A RESOLUTION authorizing the purchase of materials and hiring work, labor and materials without calling for bids. MOVED by Kurbitz, seconded by Robinson that Resolution No. D -976 authorizing payment of a damage claim to Edward C. Rumsey in the amount of S72.40, for the loss of eye glasses in the performance of duty with the Fire Department, be passed as read: carried, Brazier, Bro Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye on roll call. An application for Utility Connection Outside Yakima City Limits, as filed by Mr. andMrs. John Allmon, having been received, Mr. Rudy Gast, Planning Director, reported that this request is for addition of 1" meter for water hookup in addition to existing 3/4" meter, to add five trailer spaces to the present 410 Motel and Trailer Park. He further stated that the applicants, who are the new owners, are willing to sign an outside hookup agreement and to pay the approximate cost of 8200 for this connection. Councilman Robinson reminded the staff they shaild see that the proper owners sign the outside agreement. After due discussion, it was MOVED by Kurbitz, seconded by Robinson that said application for utility connection outside the City limits be accepted and the staff process the necessary agreement for this hookup: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. . City Manager Smith reported that he had received several phone calls from Charles Drysdale, District Airport Manager, stating that he would like to arrange a meeting with Mr. Smith, John Mayo and Al Ray, to discuss several items of interest to them, and that said meeting 1as been arranged for Thursday, July 7, at 10:00 A.M. in Seattle, Washington. City Manager Smith stated that they will also be attending a meeting on Friday afternoon, July $, 1966 with Ed Thoman, Chairman of the Airport Development Committee, regarding the Airport runway extension. City Manager Smith reported that the application for Federal Funds for the water grant is still pending in Washington, and that there is still a possibility that this might be granted.
