HomeMy WebLinkAbout06/27/1966 Business Meeting 179 JUNE 27, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith, and City Attorney Andrews present on roll call. Brazier absent. It was MOVED. by Robinson, seconded by Lynch that Councilman Brazier be excused from this meeting: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of June 20, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the hearing on Petition No. 459, as filed by Chris L. Bickler, requesting vacation of a portion of East Nob Hill Boulevard, it was MOVED by Robinson, seconded by Lynch that the Ordinance providing for said vacation be readi carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Councilman Robinson stated that in view of the information received from the Planning Commission, this property was originally deeded to the City by Mr. Bickler, then not used by the City, and the recommendation made by the Planning Commission to provide for • said vacation, that he does not see how the Council can deny this request. After due dis- cussion, it was MOVED by Lynch, seconded by Robinson that Ordinance No. $13, providing for said vacation, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robin= son voting aye on roll call. Brazier absent. ORDINANCE NO. $13, AN ORDINANCE providing for the vacation of a portion of East Nob Hill Boulevard in the City of Yakima, Washington. An Ordinance appropriating 311,000 to the 1966 Budget for the Water -Sewer Fund, to purchase equipment to harvest the hay crop on the Industrial Waste Area at the Yakima Sewage Treat- ment Plant, having been read in its entirety at the regular meeting on June 20, 1966, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by Lambert that Ordinance No. $14 providing for said appropriation, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz voting nay on roll call. Brazier absent. Councilman Kurbitz stated that he hates to see the City go into the . hay business and feels there should be some other way to handle this situation. Councilman Lambert indicated that she does not like the idea of going into the hay business either, but feels that we must do this to have.a better operating sewage disposal plant. Council- man Lynch stated that he votes aye to pass the Ordinance to make possible the purchase of this hay equipment, with the remarks that we are attempting to make a better sewage disposai so we must do this. Councilman Robinson stated that he .joins Mr. Lynch in his re- marks, with the added hope that if the time comes that we can handle the disposal plant mor: economically by not doing this haying, that we will do so. ORDINANCE NO. $14, AN ORDINANCE appropriating the amount of 311,000 from unappropriated monies in the Water -Sewer Fund to Account 940, Machinery and Equipment, of the Capital Out- lay Classification, in the 1966 appropriation for 520, Water -Sewer Fund. Petition No. 475, having been filed with the City Clerk on June 20, 1966, by Ben Huck and Others, requesting improvement of certain streets by constructing concrete curbs, gutters and surfacing of Lewis Avenue, between Folsom and Lincoln Avenues, it was MOVED by Robin- son, seconded by Lambert that said Petition be referred to the City Manager and Staff: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier absent. MOVED by Lambert, seconded by Brown that Ordinance No. $15, relating to water service rates when domestic water is used for irrigation, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier absent. City Manager Smith explained that the reason for this Ordinanc: is that this will make it possible for Government agencies outside the City Limits, to use domestic water for irrigation, without . having to amend the entire Water Code. ORDINANCE NO. 815, AN ORDINANCE relating to water service rates; providing for a special irrigation rate to be charged to governmental agencies and municipal corporations; and amending Subsection 7.68.252(g) of the City of Yakima Municipal Code. MOVED by Lambert, seconded by Robinson that Resolution No. D -971 authorizing the execution of a pipeline crossing agreement with the Oregon - Washington Railroad & Navigation Company and the Union Pacific Railroad Company, be passed as read: carried, Brown, Kurbitz, Lambert Larson, Lynch and Robinson voting aye on roll call. Brazier absent. Public Works Director John Mayo, explained that this agreement is in connection with the Washington Avenue Inter- ceptor Sewer Extension. He further explained that there will also be a pipeline crossing agreement with the Northern Pacific Railroad Company, but that it has not been returned to us. RESOLUTION NO. D -971, BE IT RESOLVED, by the City of Yakima, a municipal corporation of the State of Washington, that the act of the Mayor and Clerk of the said City in signing an agreement in writing dated June 16, 1966, between Oregon- Washington Railroad & Navigation Company and its lessee, Union Pacific Railroad Company, corporations, and said City of Yakima, licensing and permitting the latter, under the terms provided in said agreement to construct, maintain and operate a sixteen (16) inch water pipe line underneath and across the right of way and under the roadbed and track or tracks of the. Railroad Company, in the location indicated in said agreement, in the said City of Yakima, Washington, shall be and the same is hereby authorized by, and said agreement. is adopted as the agreement and under- taking of, the said City of Yakima, Washington. MOVED by Lambert, seconded by Brown, that Resolution No. D -972, transferring $1,500 within the 1966 Budget for the Municipal Airport, in order to hire architectural services for re- modeling the airport terminal building, and appraisal costs in connection with the reloca- tion of Washington Avenue, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. City Manager Smith explained that this amount of money was originally included in the 1966 Budget to install the sprink- ler system around the parking lot and that they can get by for another year and use this money for said purpose. • 1.80* JUNE 27, 1966 RESOLUTION NO. D =972, A RESOLUTION transferring the amount of S1,500 within the 1966 Budget appropriation for 390 - Municipal Airport. •• An Application for Outside Utility Connection for fire service, having -been filed with the City Clerk, by Lester W. Lewis, Jr., •on behalf of Yakima Properties, Inc., City Manager Smith referred to a letter from Mr. Lewis regarding his application, in which Mr. Lewis stated that he does not wish to sign the Outside Agreement because he does not agree with some of the restrictions listed on this agreement. Mr. Lewis, being present, stated that he believes that legally he does not have to sign said outside agreement, and will still be entitled to receive the fire service he has applied for. He further stated that the reason for not wishing to sign an outside agreement'is because he does not know what the building codes and restrictions might be when this property is annexed. Councilman Lambert explain- ed that in the past the.Council has agreed to accept these applications for Outside Utility Connections, providing the applicant signs an Outside Utility Agreement; and that she does not feel that it will be fair to. all the people who have already signed such an agreement, to accept this application from Mr. Lewis, if he does not sign an Outside Agreement. Coun- oilman. Robinson explained to Mr. Lewis, that the restrictions referred to in the outside utility agreement have to do with building codes,, and also the electrical code which is a State code that has to be complied with. Mr. Lewis explained that he will be glad to annex, should this property come up for annexation, and is not really against signing the outside agreement, but thought he would see what the Council would say, as he still thinks that legally the City has to hook him up, whether he signs an outside agreement or not. After due discussion, it was MOVED by Robinson, seconded by Lambert that the Council accept this application for outside hookup, providing Mr.'Lewis signs the Outside. Hookup Agreement; carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Lynch not voting. Brazier absent. • A damage claim, having been filed with the City Clerk, by D. S. Billington, $02 N. 53rd Avenue, for damages caused to his electric driveway matts by the City water department when they were working on a water valve and cut a hole in his driveway, it was MOVED by Robinson, seconded by Lambert that said damage claim be 'referred to the •City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, Lynch and • Robinson voting aye by voice vote. Brazier absent. City Manager Smith reported that it is hoped that there will be an Ordinance and other materials prepared,in connection with a bus proposal from National City Lines, for the • next regular Council meeting on July 5, 1966. He further stated that because of the time factor,, it will not be possible to hold a special election until September 20, 1966, the date of the Primary Election. Rudy Gast, Planning Director, reported on the first meeting of the City and County Planning Commissions on Thursday, June 23, 1966. City Manager Smith reported that we are near our 'goal of 9,060 signatures on Petition No. 226, State Sales Tax Sharing. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Lynch that we now adjourn at the hour of 4:15 P.M.: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
