HomeMy WebLinkAbout06/20/1966 Business Meeting 176 JUNE 20, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Lambert, and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Brazier, Kurbitz and Lynch absent. It was MOVED by Robinson, seconded by Lambert that Councilmen Brazier, Kurbitz and Lynch be excused from this meeting: carried, Brown, Lambert, Larson and Robinson voting aye by voice vote. Brazier present after $:35 P.M. The Invocation was given by Councilman Lambert. . The minutes of the regular meeting of June 13, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Before proceeding with the business on the regular Agenda, Mayor Larson referred to a letter from the Yakima Chamber of Commerce explaining that the Board of Directors of the Chamber had unanimously approved the flag that they are presenting tonight, June 20, 1966, as the official flag of the City of Yakima. He further stated that a Resolution describing and.adopting the official flag of the City of Yakima has been drawn up, and introduced Mr. Armand Taylor and Mr. Forrest Brewer, members of the Yakima Chamber of Commerce. Mr. Taylor explained that the design for the flag had been selected from over three dozen flag entries and was submitted by a 13 -year old boy, Ted Tanasse, who has received a 525.00 savings bond for his creative efforts. Mr. Taylor also explained that if adopted as the official flag of the City of Yakima, that it will be one of the first city flags in the State of Washing- ton, and will be carried to the top of Mt. Adams on July 10, 1966, when some 200 people will be climbing this mountain. Mr. Taylor then presented the flag to Mayor Larson and the City Council members. It was MOVED by Robinson,,: seconded by Brown that Resolution No. D -96$ describing and adopting the official flag of the City of Yakima, be passed as read: carried, Brown, Lambert, Larson and Robinson voting aye by roll call.. Brazier, Kurbitz and Lynch absent. . RESOLUTION NO. D -96$, A RESOLUTION describing and adopting the official flag of the City of Yakima . This being the time fixed for the continuation of the hearing on Petition No. 456, as filed by Ruby W. Harrison, requesting rezone of property situated at 24th and Washington Avenues, and City Manager Smith requesting that this matter again be continued as there is still some legal work to be done, and an appraisal is being made of said . property in connection with the relocation of Washington Avenue, it was MOVED by Robinson, seconded by Lambert that said hearing be continued to July 11, 1966: carried, Brown, Lambert, Larson and Robin- son voting aye by voice vote. Brazier, Kurbitz and Lynch absent. . The Council deviated from the regular Agenda, to consider the matter of the continuation of the hearing on Petition No. 453, as filed by Neal Turner and Others, requesting vacation of a portion of W. Walnut Street. Councilman Robinson suggested that this hearing be contin- ued for at least two more weeks, in view of the fact that . not all of Council members are present, a memo from the. Fire Department has been received that should be studied and con - sidered, and the Engineering Department wants to study this situation more thoroughly. Mayor Larson asked the Petitioners present if they objected to having this matter post - po.ned. Mr. Charles Countryman, property owner, suggested that in view of the fact that there is not a full council and the importance of this vacation to the people involved, that this matter be postponed to a later date. Mr. Krieger, property owner, stated that he does not agree that this matter should be postponed because he has been trying to build on his lots for six months and does not feel that a further postponement is necessary. Mr. Turner, another property owner in this vicinity affected by this vacation, indicated that it is agreeable with him to continue said hearing. He further indicated that he would pre- fer an evening meeting, but stated that his wife could represent him at an afternoon meet- ing. After due discussion, it was MOVED by Robinson, seconded by Lambert that said hearing be continued to July 5, 1966: carried, Brown, Lambert, Larson and Robinson voting aye by voice vote. Brazier, Kurbitz and Lynch absent. This being the time fixed for the continuation of the hearing on Summitview Avenue Parking, Mayor Larson opened the meeting for discussion by all present wishing to speak on said matter. (Councilman Brazier present after $:35 P.M.) Mr. Syd Orkney requested that this • hearing be postponed until July 1$, 1966, when Mr. Dittmar, who is out of town, will be present, and possibly more Councilmen will be present. Mayor Larson stated that this hear- ing had been continued until today's date and that many people are present wishing to be heard'on this matter and might be inconvenienced if this were to be continued. He stated that the Council will hear from all people present wishing to present new information, then possibly some decision will be made to vote on the matter, or continue said matter. .Mr. Perry Robinson, Attorney, stated that he has been designated by the Roosevelt P.T.A. to speak in their behalf and also that the St. Paul P.T.A. has indicated that they support the recommendation of the Roosevelt P.T.A. He further stated that the Roosevelt P.T.A. and the St. Paul P.T.A. favor the adoption of the proposed ordinance to remove the parking from the North side of Summitview, but wish an amendment to be added which would create a buffer zone on both sides of Summitview of 3 ft. wide and adjacent to the street. •Mr. Robinson reviewed further the recommendations of all of the groups that have studied this matter and stated that, of course, the main concern of all groups, even the opposition, is the promo- tion of the greatest safety for children. He also stated that Mr. Dittmar, who has led the opposition to removing the parking & have a buffer zone, has indicated to the P.T.A. group that he is willing to go along with them in recommending that the ordinance be passed with the suggested amendment. City Manager Smith stated he has received a letter on this date, June 20, 1966, from Mr. Dittmar again stating that he is against removing the parking. Mr. Britt spoke in favor of leaving the parking as it is, stating that when the street was first widened, it called for no parking lane and it was only because the property owners acted, that a parking lane was put along Summitview. Others speaking for leaving the situation as it is were Mrs. Bob Adamson, Mrs. F. E. Millay and Mr. Walter Ewald. Dr. • _Patton, speaking for the Kamiakin Kiwanis Club of Yakima, stated that they are happy to support the idea of protecting the children. Councilman Lambert, in referring back to the memo from the Traffic Advisory Board, the report of the Safety Council, and the petitions of the property owners, stated that after taking all the matters into consideration, it seemed to her that the majority of the people want to leave the parking as it now is. She further stated that the primary concern of all of us is to promote the greatest safety to children and feels that the only solution to the problem at present is to leave the parking on Summitview Avenue as it is. It was then MOVED by Lambert, seconded by Brown'that the . parking on Summitview Avenue be left as it is. Councilman Broom stated that he is afraid of buffers, and further stated that the greatest and most serious accidents to children are AL 172 JUNE 20, 1966 when they dart out behind parked cars, and with the parking lane as it now is, and very few cars parking there, the children at least have some place to walk. He indicated that he believes the very narrow side streets are going to be jammed up, if all the parking is removed from Summitview Avenue, and stated that he sincerely feels that we should leave it as it is. Councilman Robinson stated that he disagrees with his colleagues. He indicated that he feels that the parking should give way to splitting the lane to buffer zones on each side of the street and having them marked. He stated that he feels there are really only two solutions to the Summitview parking problem and they are, . to either leave it as it is, or remove the parking completely and divide the lane to have buffer zones on each side and is inclined to believe that the parking should be removed. After due discussion by Council members, Mayor Larson called for the roll call vote on the Motion to leave the Summitview parking lane as it is; Brazier, Brown, Lambert and Larson voting aye on roll call. Robinson voting nay on roll call. Kurbitz and Lynch absent. Motion carried. Mr. Robert Strausz, being present at this time, and having filed with the City Clerk on June 17, 1966, Petition No. 474, Notice of Intention to Commence Annexation Proceedings, requesting annexation of property located between Glacier Way-and Summitview, East of N. 61st Avenue, the Council deviated from the regular agenda to meet with Mr. Strausz on matters of annexation of certain property. It was MOVED by Robinson, seconded by Brazier that this date, June 17, 1966, be set as the time for a meeting with Mr. Strausz, who signer Petition No. 474, the Notice of Intention to Commence Annexation Proceedings, dated June 1.7 1966: carried, Brazier, Lambert, Larson and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Brown not voting. Mr. Strausz, indicating that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by Petition No. 474, (Notice of Intention to Com- mence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. This Motion was made by Robinson, seconded by Lambert: carried, Brazier, Lambert, Larson and Robinson voting aye by voice. vote. Kurbitz and Lynch absent. Brown not voting. Mr. Roy Johnson and Mr. Eldon Broetje, property owners on Summitview, being present, requested information about this requested annexation. Councilman Robinson explained the annexation procedure to those present. In answer to the question asked as to why Haven Way property has been left out of this requested annexation, Public Works Director, John Mayo, stated that a canvass has been made of the property owners on Haven Way and it indicates that the majority of them do not wish to be annexed to the City. An Ordinance appropriating $3,500 to the 1966 Budget for the Water -Sewer Fund to pay a settlement of pending litigation against the City of Yakima, having been read in its en- tirety at the regular meeting on June 13, 1966, and being read by Title only at this meet- ing, it was MOVED by Brazier, seconded by Brown that Ordinance No. 809 providing for said appropriation, be passed as read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and Lynch absent. City Attorney Andrews explained that the damage suit against the City of Yakima was by Henry E. and Rubye H. Neer.as a result of injuries Rubye Neer received when she fell to the sidewalk after tripping over a water meter. • ORDINANCE NO. 809, AN ORDINANCE appropriatin .the amount of $3,500 from unappropriated monies in the Water -Sewer Fund to Account 7 -890, Miscellaneous, of the Maintenance and Op- eration classification, in the 1966 appropriation for 520 - Water -Sewer Fund. An Ordinance appropriating $6,350 to the 1966 Budget for the Street Fund for the payment of a judgment rendered against the City of Yakima, having been read in its entirety at the regular meeting on June 13, 1966, and being read by Title only at this meeting, it was MOVED by Brazier, seconded by Lambert that Ordinance No. 810 providing for said appropria- tion, be passed as read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and Lynch absent. City Attorney Andrews explained that this approp- riation is to pay a judgment rendered against the City of Yakima by Alfred J. Staff, who was injured in fall when the motor bike on which he was riding struck a large hole in the pavement. ORDINANCE NO. 810, AN ORDINANCE appropriating the amount of $6,350 from unappropriated monies in the Street Fund to Account 7 -890, Miscellaneous, of the Maintenance and Operation classification, in the 1966 appropriation for 310 - Street Fund. • In accordance with action taken at the previous Council meeting on June 13, 1966, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 811, amending Section 1, deleting certain streets, of Ordinance No. .802 passed May 9, 1966, providing for the improvement of certain streets and creating L.I.D. No. 953, South 20th Avenue and Other Streets, be passed as read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and Lynch absent. (deleted streets in accordance with protests) ORDINANCE NO. 811, AN ORDINANCE amending Section 1 of Ordinance No. 802, passed May 9, 1966 entitled "An Ordinance providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, to- gether with necessary drainage features; establishing a Local Improvement District, provid- ing for the method of payment thereof, and creating a special fund ". In accordance with action taken at the previous Council meeting on June 13, 1966, it was MOVED by Brown, seconded by Robinson that Ordinance No. 812, amending Sections 2 and 3, deleting certain alleys, of Ordinance No. 803, passed May 9, 1966, providing for the im- provement of .certain property . and creating L.I.D. No. 954, 1966 Street and Alley Paving District, be passed as read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz,and Lynch absent. (deleted alleys in accordance with protests) ORDINANCE NO. 812, AN ORDINANCE amending Sections 2 and 3 of Ordinance No. 803, passed May 9, 1966, entitled "An Ordinance providing for the improvement of certain property by grad- ing ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, pro - viding for the method of payment thereof, and creating a special fund". Petition No. 473, having been filed with the City Clerk on June 16, 1966, by G. Dick Martin and Dorothy Martin, requesting rezone of property located at 1013 and 1017 South 28th Ave., it was MOVED by Robinson, seconded by Lambert that said Petition be referred to the Plannin C for study and recommendation: carried, Brazier, Brown, Lambert, Larson and Robin' son voting aye by voice vote. Kurbitz and Lynch absent. 178 JUNE 20, 1966 : , . . An Ordinance appropriating $11,000 to the 1966 Budget for the Water -Sewer Fund, having been read in its entirety, was ordered laid on the table to be read and considered at the next regular meeting of the City Council on June 27, 1966. City Manager Smith explained that this appropriation is to pay for the purchase of equipment for harvesting the hay crop on the Industrial waste area of the Sewage Treatment Plant. In answer to questions by Council members as to why the City needs to purchase this equipment and do the work, instead of selling the hay as previously done in 1965, Mr. Frank Stein, Utilities Director, explained that Mr. Glen Johnson, who bought the hay and did the work in 1965, does not wish to renew his option. Mr. Stein explained that a purchaser was found to take off the first .cutting this year at a disasterous price and a bid call was sent out by the Purchasing Agent to possible interested buyers of the second cutting, for which no bids were received, so it seems that the only alternative is for the City to purchase its own equipment for such pur- poses. Mr. Stein further stated, that according to the consulting engineers' advice as to the proper and best operation of the waste disposal system, the City's main problem is to maintain a properly operating waste disposal system, and agricultural practices should only be used as a means to increase the effectiveness of the area for this purpose, not operated specifically to produce a crop. There was some discussion by Council members as to the possibility of renting out this machinery, when not in use by the City. MOVED by Brazier, seconded by Robinson that Resolution No. D -969 authorizing the Auction Sale on July 23, 1966, of city owned surplus equipment, be passed as read: carried, Brazier Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and Lynch absent. City Manager Smith explained that this Auction.Sale is to be held to dispose of City owned surplus equipment that was not traded in on new equipment purchased in 1966. In answer to questions by Council members as to whether the City has ever held this type of .Auction Sale before, Mr. Smith stated that the City has not,.but that Seattle and Spokane have had good success with such auction sales. . RESOLUTION NO. D -969, A RESOLUTION authorizing and directing the auction of surplus persona property owned by the City of Yakima. MOVED by Robinson, seconded by Lambert that Resolution No. D -970 granting permits for retai sale of fireworks for 1966, be passed as read: carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and Lynch absent. Fire Marshall Schoonover, - being present, stated that the places listed in said Resolution have applied for permits and have been checked out to be sure that they are operating, according to the City Fire Code and under the State Law for Safe and Sane Fireworks, before the permits are granted to them. . RESOLUTION NO. D -970, A RESOLUTION granting permits for the retail sale of fireworks within the City of Yakima for 1966. . City Manager Smith reported that a number of legal defects have been found in Petition No. • 470, as filed by United Builders, Inc., requesting annexation of property located between Nob Hill Blvd., and Tieton Drive and West of 47th Avenue, and a new Notice and Petition will have to be filed. Councilman Brazier excused at 10:00 P.M. City Manager Smith reported that on Wednesday and Thursday evenings, June 22 and 23, 1966, volunteers will start a house to house canvassing on Petition No. 226, State Sales Tax Sharing. He stated that we are still about 3,000 signatures short of reaching our goal of 9,060 and are hoping for 100 volunteers to canvass each night. There being no further business to come before the Council., it was MOVED by Robinson, seconded by Brown that we do now adjourn at the hour of 10:15 P.M.: carried, Brown, Lambert Larson and Robinson voting aye by voice vote.
