The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney present on roll call. Kurbitz absent on roll call. It was MOVED by Robinson, seconded by Lynch that Councilman Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz present after 3:12 P.M. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of May 23, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 464, as filed by Orman E. Arnold and Others, requesting annexation of property located south of Mead Avenue, between Voelker and Rock Avenue, and City Manager Smith explaining that there may be some doubt as to the legality of the original petition and suggesting that this matter be postponed, it was MOVE 11 by Robinson, seconded by Lynch that the hearing on said matter be postponed indefinitely: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kur bitz absent. City Attorney Andrews indicated that according to State Statute, the names of the people wishing to have their names removed from an original annexation petition, cannot legally do so after the date of hearing has been set. He also explained that in checking the petition No. 464, there is some question as to the validity of some of the signatures and suggested that this matter be postponed indefinitely in order to further study the situ ation. In discussion mention was,made of the fact that Mr. Arnold had originally filed for the annexation of a smaller area and that since other people in the vicinity showed interes • in being annexed, the matter had been referred back to Mr. Arnold and a new Notice of Inten tion.arid Petition to annex completed, after which time some eight persons who signed Peti- tion No. 464 filed their desire to withdraw,in writing, from this annexation. Councilman Kurbitz present after 3:12 P.M. This being the time fixed for the continuation of the hearing on Edgecliff Manor No. 2 and Horizon Heights No. 2 Replats, and Planning Director, Rudy Gast, explaining that because more work needs to be done on this matter because of existing water and sewer L.I.D.'s, and suggesting that this matter be continued for two weeks, it was MOVED by Robinson, seconded by Lambert that said hearing be continued until June 13, 1966: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. City Attorney And - rews explained that because some L.I.D. assessments are still being paid on the original plats in this vicinity and in replatting there would be different amounts on different size. plats, that*this.should all be straightened out before these plats are sold and replat file.l. He further explained that he felt the only way to straighten the matter out, is to prepare an Ordinance which will repeal the Confirmation of the Assessment Roll on the existing L.I.D.'s,(Nos. 904, 905, 907 and 90$), then have the engineers reapportion the assessments according to the replats, and hold another hearing to confirm the new assessment roll. Petition No. 472, having been filed with the City Clerk on May 26, 1966, by Ernest L. Mober- ly and. Others, requesting improvement of streets by constructing concrete curbs, gutters and surfacing of the area fronting on Garrett Street between North 9th and North 15th Ave- nues, it was MOVED by Lambert, seconded by Brown that said Petition be referred to the City • Manager and staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. MOVED by Brown, seconded by Lambert that Resolution No. D -961 authorizing the temporary closure of a portion of Naches Avenue for a. political rally, be passed as . read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. City Manager Smith explained that this request was made by the Washington State Republican Party for the purpose of conducting a political rally and dinner. RESOLUTION NO. D -961, A RESOLUTION authorizing the temporary closure of a portion of Naches Avenue for a political rally. . The following bids having been received on this date and considered by a Bid Board for the construction of Fairbrook Addition and Others Paving as provided for in L.I.D. No. 952: SCHEDULE I SCHEDULE II Bohannon Asphalt Paving, Inc. 8 74,619.25 DeBlasio Bros. S 19,306.25 DeBlasio Bros. $2,156.00 Superior Asphalt & Conc. Co. 19,62$.50 Superior Asphalt & Conc. Co. $4,170.00 Yak.Cem. & Asph. Pay. Co. 22,197.25 Yak.Cement & Asphalt Pay. Co. $5,312.75 Bohannon Asphalt Co. 24,105.50 and the City Engineer recommending the bids of Bohannon Asphalt Paving Company, Inc., on Schedule I, and of DeBlasio Brothers on Schedule II, as being the lowest bids, it was MOVED by Robinson, seconded by Brazier that the recommendation of the City Engineer be accepted and the bids be awarded to Bohannon Asphalt Paving Co., Inc. on Schedule I, in the amount of 574,691.25 and of DeBlasio Brothers on Schedule II, in the amount of S19,306.25 and that the City Manager be and is hereby authorized to enter into a contract with said contractors upon the filing of the proper bonds and insurance: carried, Brazier, Brown, Kurbitz, Lam - bert, Larson, Lynch and Robinson voting aye by voice vote. A damage claim having been filed by Joe Hinson for damages in the amount of $179.$2, it was II MOVED by Robinson, seconded by Brown that said damage claim be referred to the City.Manager and staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Councilman Robinson asking to be excused from the next two council meetings on June 6 and June 13, 1966, as he will be out of town, it was MOVED by Brazier, seconded by Lambert that Councilman Robinson be excused from said two meetings: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. 169 . MAY 31, 1966 City Manager Smith referred to the Petition filed by Mr. Robert McGee and Others at the last council meeting on May 23, 1966, after the hearing on the Hayes- Comstock rezone peti- tion, which was denied. This petition requested the City Council to ask the City Planning Commission to review the present zoning in the general area of the north side of Tieton Drive and the east side of 40th Avenue. Councilman Lynch stated that he is not convinced that the B -2 zone should be removed. Councilman Brazier stated that although he voted against the B -2 zoning for this area in 1962, he does not feel it should now be changed lir from B -2 to residential zoning as the petition requests. City Attorney Andrews explained the three ways of rezoning property are: (1),petition by individual owner or owners, to the Planning Department; (2) City Council itself can pass a Resolution of Intention to rezone and refer to Planning Commission; (3) the Planning Commission can pass a resolution to re- zone property, and make recommendation to Council. After due discussion, it was MOVED by Lambert, seconded by Robinson, that said petition as filed by Mr. Robert McGee & Others, be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. City Manager Smith reported that he had received a letter from Robert Harder, Manager of the Spokane City Bus lines, expressing an interest in our local bus problem and in discuss- ing it further with the City. Mr. Smith also indicated that Mr. Harder, Mr. Diaz of El Paso, Texas, Manager of the National City Bus Lines, and their attorney will be able to meet in Yakima Thursday, June 2, 1966, for the purpose of going over the system and probably will make a proposal at that time. Mr. Smith further indicated that Mr. Diaz will be able to make this trip providing the expenses of Mr. Diaz up to $300.00 can be paid and stated that there are funds available in the 1966 Budget of approximately S700. After due dis- cussion, it was MOVED by Robinson, Mconded by Brown that the expenses not to exceed 8300.00 for Mr. Diaz to come to Yakima on Thursday regarding the bus situation be allowed: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz Voting nay by voice vote. There being no further business to come before the Council, it was MOVED by Kurbitz, secon- ded by Lynch that we do now adjourn at the hour of 4:00 P.M.: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
