HomeMy WebLinkAbout05/16/1966 Business Meeting 163 MAY 16, 1966 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Brazier absent and excused. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of May 9, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . This being the time fixed for the continuation of the Hearing on Petition No. 456, as filed by Ruby W. Harrison, requesting rezone of property situated at 24th and Washington Avenues, it was MOVED by Robinson, seconded by Lynch that this Hearing be continued for one week, or until the regular Council meeting on May 23, 1966: carried, Brown, Kurbitz, Lambert, Larson Lynch and Robinson voting aye by voice vote. Brazier absent. In accordance with action taken by the City Council at their regular meeting on May 9, it was MOVED by Lynch, seconded by Brown that Resolution No. D -951 fixing the date of hearing for June 13, 1966, on Petition No. 453, as filed by Neal D. Turner &Others, requesting vacation of W. Walnut Street from Chisholm Trail, West to S. 44th Avenue, be passed as read carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier absent. RESOLUTION NO. D -951, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. In accordance with action taken by the City Council at their regular meeting on May 9, 1966, it was MOVED by Lambert, seconded by Robinson that Resolution No. D -952, fixing the date of hearing for June 13, 1966, on Petition No. 459, as filed by Chris L. Bickler, requesting vacation of a portion of the right -of -way of East Nob Hill Blvd., between Fair Avenue and S. 8th Street, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robin son voting aye on roll call. Brazier absent. RESOLUTION NO. D -952, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. This being the time fixed for a hearing on Edgecliff Manor No. 2 and Horizon Heights No. 2 Replats, and having received a memorandum from the Yakima City Planning Department indica- ting that there are some discrepancies in the Replats that need clarification before being considered by the Council, and recommending that the hearing on this matter be continued for two weeks, it was MOVED by Robinson, seconded by Lynch that the hearing on said Replats be continued for two weeks or until the regular Council meeting on May 31, 1966: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier ab- sent. Rudy Gast, Planning Director, explained that due to a number of discrepancies in the Replats as submitted for the Council's action, the Planning Department is recommending that this hearing be continued until such time as the discrepancies can be cleared up with the developers and surveyor. This being the time for the Hearing on Petition No. 446, Relocation of Parking on Summitview Avenue, and a recommendation having been received by the City Council from the Yakima Area Safety Council in writing, stating that the Safety Council recommends elimina- tion of all parking on Summitview between 16th Avenue to 40th Avenue, Mayor Larson opened, . the discussion to those present wishing to speak on said matter. Mrs. Joe Davidson, repre- sentative from the Roosevelt P.T.A., stated that since it seems that their request to have the parking changed from the North side of Summitview to the South side . will not be granted that the Roosevelt P.T.A., after studying the recommendation of the Safety Council, has decided that they will go along with the Safety Council's recommendation to eliminate all parking on Summitview Avenue and divide the parking lane to have a 32 ft. buffer lane on both sides of Summiview. Mr. Francis Millay, • 1709 Summitview, stated that he feels that the parking should be left as it is on the north side of Summitview, so that there will be a buffer area on the North side and so that people will not have to walk in the street to get to a crosswalk. He indicated he would be in favor of the Safety Council's suggestion to remove the parking and have a buffer zone on both the north and south sides of Summit- view. He stated he is definitely against changing the parking from the north side to the south side, because the north side would not have any kind of buffer zone. (Mr. Millay filed a letter with the City Clerk after the meeting, stating his views, observations and conclusions regarding the Summitview Parking situation). Dr. Lambert Benoit read a state- ment from the Yakima Kamiakin Kiwanis Club of Yakima and filed it with the City Clerk, that stated that the Kiwanis International is concerned with the safety of our youth, and that the Yakima Club wishes the Yakima City Council to seriously consider placing the parking lane on the same side of the street as the sidewalk on the south side of Summitview Avenue. Dr. Benoit told of a situation where he almost hit a child who had been pushed off the side walk into the path of his car, and personally believes the parking should be eliminated and a buffer zone allowed on each side. Mr. Robert Ditmar, stated he felt that the parking should be on the north side as it is and had originally signed the petition to put the park ing on the north side, mainly because he felt some kind of buffer zone was needed on that side, but will now go along with the idea of removing the parking and having a buffer zone on each side. Mrs. Sid Orkney, stated that she does not feel there needs to be any change from the present. She further stated that she drives Summitview every morning and has never experienced or seen anything to make herfeel this is a dangerous situation. Mr. Sid Orkney 2$09 Summitview Avenue, also wants the parking left as it is, because if the parking is taken away from the north side of Summitview, he feels it will reduce the value of the homes along this side of the street. Mrs. Perry Robinson, Mr... Warren Sutliff and Mr. Van - denbrink, Principal of Roosevelt School, spoke in favor of eliminating the parking and . having a buffer zone on each side, because they feel it is an extremely dangerous situation as it now is. Mr. Vandenbrink, in answer to Councilman Robinson's questions about the Kindergarten children that will be attending the schools in this vicinity next year, ex- plained that Roosevelt school would only be able to furnish School Patrol servicein the early morning and late afternoon, and that at two other times during the day, the Kinder- garten children would not have Patrol guidance. Councilman Robinson stated that he felt that the parking will have to be removed and the 7 ft. divided into a buffer lane on each side of Summitview. He further stated that we dislike changing it, but feels that there is a hazard and that the expense of making this change does not change his opinion, as the situation is not satisfactory as it is now. Councilman Robinson also stated that the Safety Council had recommended the removal of_the parking on Summitview from 16th to 40th 164 MAY 16, 1966 . Avenues, but that our Engineering people indicated there would be less of a jog by not ex- tending it on past 32nd Avenue. Councilman Lynch indicated he hopes that everyone under- stands that this is a difficult problem . and that there is not any one solution that will satisfy everyone, but that the best solution is changing to no parking on either side and re- striping. Councilman Lambert stated that she feels there is a solution to the situation, but that we are not ready to face it -- that in the future, when new streets are dedicated and areas are opened up, if we all would see that the streets are wide enough to take care of sidewalks on each side and parking on each side of all streets, then we would not have the problems we now have. After due discussion, it was MOVED by Robinson, seconded by Lync that an Ordinance be prepared which will vacate the parking lane on Summitview Avenue betwe_i 16th Avenue and 31st Avenue and that Summitview be re- striped dividing the parking lane, making 32 feet on the south side and 32 feet on the north side of Summitview, with the middle traffic lanes the regular size: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier absent. MOVED by Lambert, seconded by Brown that Ordinance No. 804 repealing Ordinance No. 790, providing for election on the matter of operation of a motor coach system in the City; be . passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier absent. City Manager Smith explained that the City had received word from the Federal Office of Transportation, that it would be impossible for them to give the City any assurance that they would be able to get the information as to whether the Federal Funds asked for in our application will be received, prior to the date of the Special Elec- tion, or May 24th, 1966, and that Ordinance No. 790 was based on the supposition that we would receive a Grant. Mr. Smith further stated that the Federal Office of Transportation indicated that they would like to continue to process the City's application and expressed the hope that perhaps another election can be held when we hear that our application for a grant will be approved. Mr. Bob School, of the Junior Chamber of Commerce, asked about the repeal of said Ordinance No. 790 and was given information indicating to have another election, the City would have to pass another Ordinance providing for a special election an. that said election could be held 45 days from the passage and publication of this Ordinance. ORDINANCE NO. $04, AN ORDINANCE repealing in its entirety, Ordinance No. 790, passed by the Yakima City Council on April 4, 1966, and entitled "AN ORDINANCE proposing to the voter- of the City of Yakima that the City purchase, acquire and construct all properties, equip- ment and facilities necessary to establish, operate and maintain a motor coach system for the transportation of passengers for hire; specifying and adopting the system or plan pro- posed; declaring the estimated cost thereof, as near as may be; providing for the financing thereof; authorizing the levy and collection of a housing unit transit subsidy tax; calling a special election to submit a proposition to the voters of the City of Yakima for their ratification or rejection of this ordinance; and declaring an emergency."; and declaring an emergency. _ There being no further business to come before the Council, it was MOVED by Kurbitz, secon ded by Lynch that we do now adjourn at the hour of 9:05 P.M.: carried, Brown and all voting, aye by voice vote.
