MAY. 1966
The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown,
Kurbitz, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present
on roll call. .
The Invocation was given by Councilman Brown.
The minutes of the regular meeting of May 2, 1966, having been duly certified accurate by
two councilmen and no one present.wishing to have said minutes read publicly, Mayor Larson
declared said minutes approved as recorded.
This being the time fixed for the continuation of the Hearing on Petition No. 456, as filed
by Ruby W. Harrison, requesting rezone of property situated at 24th and Washington Avenues,
it was MOVED by Robinson, seconded by Lambert that this Hearing be continued for one week,
or until the regular Council meeting on May 16, 1966: carried, Brazier, Brown, Kurbitz,
Lambert, Larson, Lynch and Robinson voting aye by voice vote.
This being the time fixed for the hearing on Petition No. 447, as filed by Charles M. Hunt
and Others, requesting vacation of Prasch Avenue between llth Avenue and Pleasant Avenue,
it was MOVED by Lambert, seconded by Lynch that Ordinance No. $Ol providing for said vaca-
tion be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robin-
son voting aye on roll call. In answer to Councilman Robinson's question about easement
requirements, City Attorney Andrews explained that Section 2, in Ordinance No. 801 states
that . all necessary easements and rights -of -way are reserved by the City of Yakima for con-
struction and installation of necessary utilities, and that no building can be constructed
on said vacation without the approval of the City. John Mayo, Public Works Director, ex-
plained that there is a private water line under this proposed vacation. Charles Hunt,
being present, stated that he does not plan to construct any type of building on said vaca-
ted street, but the main intention of the requested vacation is so that he can build closer
to the property line. Mr. Hunt filed with the City Clerk, a letter from Clinton Brush,
property owner in this vicinity, stating that he favored said vacation.
ORDINANCE NO. 801, AN ORDINANCE providing for the vacation of a portion of Prasch Avenue in
the City of Yakima, Washington.
This being the time fixed for the Hearing on Petition No. 451, as filed by Robert P.
Moriarty & Others, requesting vacation of a portion of Barge Street between 41st and 42nd
Avenues, and the Planning Commission recommending denial of said petition for vacation, it
was MOVED by Robinson, seconded by Lambert that the Resolution denying said Petition to
vacate a portion of Barge Street be passed as read. Mr. Don Picatti, a signer of Petition
No. 451, being present, stated that he and Mr. Robert Moriarty did not receive notice of
the Planning Commission's hearing and they were not represented to present reasons for the
requestion vacation, and recommended that this be referred back to the Planning Commission
for further study and recommendation. Mr. Rudy Gast, Planning Director, explained that
notices had been sent to Petitioners and concurred with M.r. Picatti's request to refer this
matter back to the Planning Commission. After due discussion, it was MOVED by Robinson,
seconded by Lambert that this hearing be continued to June 13, 1966, and that said Petition
be referred back to the Planning Commission for further study and recommendation: carried,
Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
This being the time fixed for the hearing on Resolution No. D -940, being a Resolution of
Intention to improve certain streets by constructing concrete curbs and gutters and surfac-
ing in accordance with Petitions No. 255 271, 404, 42$, 433 and 442, it was MOVED by Brown
seconded by Lynch that the Ordinance providing for said improvement and creating L.I.D.
No. 953 South 20th and Other Streets, be passed as read..: Public Works Director, John Mayo
stated that $.7o protests has been filed with the City Clerk on the South 20th Ave. part of
this project. Questions were asked about the grade of the street and how the cost of the
project was figured, by Mrs. Orville Robbins, Mr. Floyd C. Riemenschneider, Dave McClellan,
Mrs. Minnie Bierly, William Laupp and Mrs. Swallow, property owners in this vicinity. Mr. .
Mayo explained the procedure of L.I.D.'s and the schedule of cost based on the size of lot
and the size of the improvement, and answered other questions by property owners by stating
that the street grade is constructed as much as possible to blend in with the landscaping
and the various grades of the property abuting the improvement. The next street in the pro
posed L.I.D. to be considered, was 22nd Avenue. Mr. Mayo stated that there is 56.7% protest'
filed with the City Clerk, against the.22nd Avenue portion. Councilman Robinson explained
that for anything to be protested out, 60o protest is required, but that the Council member -
usually feel that if over 50% of the property owners do not want an L.I.D., the Council wil
vote it out. After due discussion, it was MOVED by Robinson, seconded by Kurbitz, that the
22nd Avenue project be deleted from the Ordinance as read: carried, Brazier, Brown, Kurbitz
Lambert, Larson, Lynch and Robinson voting aye by voice vote. Mr. Mayo reported that there
is 5.4% protest against the project on S. 19th :Avenue. Mrs. Anderson, 1119 S. 19th Avenue,
spoke in favor of this project and no one was present to speak against it. On the W. Viola
Avenue from S. 20th Ave. to S. 24th Ave. project, Mr. Mayo reported 15.0% protest is filed
with the City Clerk and explained the work to be done on 24th and W. Viola in answer to
questions by Mrs. Lehn, property.. owner. There were no protests in writing or otherwise on
the W. Prasch Avenue and Willow Street projects in this proposed L.I.D., or the West Chest-
nut Avenue widening project. After due discussion, Mayor Larson called for the roll call
vote on the motion to pass Ordinance No. $02 as amended: carried, Brazier, Brown, Kurbitz,
Lambert, Larson, Lynch and Robinson voting aye on roll call.
ORDINANCE NO. $02, AN ORDINANCE providing for the improvement of certain property by gradin v,
ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters,
together with necessary drainage features; establishing a Local Improvement District, pro-
viding for the method of payment thereof, and creating a special fund.
This being the time fixed for the Hearing on Petition No. D -941, being a Resolution of In-
tention to improve certain streets and alleys by constructing concrete, curbs and gutters
and surfacing, in accordance with Petitions No. 45$,460, 465 and 466, it was MOVED. by Lynch
seconded by Brown that Ordinance No. $03 providing for said improvement and creating L.I.D.
No. 954, 1966 Street. and Alley Paving, be passed as read: carried, Brazier, Brown, Kurbitz,
Lambert, Larson, Lynch and Robinson voting aye on roll call. John Mayo reported that there
is 32.6% protest in writing on the Alley, Block 390, Capitol Addition project and 33.1% on
Alley Block 10$. Present and protesting two of the projects in the proposed L.I.D. were

Mrs. Gene Cahoon and Mrs. Thomas Kerns, representing Junior Aid, owner of the Day Nursery
on N. Third Avenue, and Mr. Perry Thornton, representing his mother, property owner in this
vicinity. - The other property owner is the May Nursery Company, who petitioned for both
projects -- the widening of N. 3rd Avenue from West Lincoln Avenue to West "B" Street and
the paving of the Alley Block 24$ in the same vicinity. The property owners protesting
this improvement state that they do not feel it is needed in their vicinity and cannot
afford the cost. Others present asking questions about how the cost is figured and what
work will be done, were Russell Mann, Albert Kloster and Mrs. George Aisted. Council mem-
bers indicated that since all the property owners, other than the May Nursery, were present
and protesting this improvement that their property should be deleted from the proposed
L.I.D. After due discussion, it was MOVED by Brazier, seconded by Robinson that all the
property except that owned by the May Nursery be deleted from these two projects in the
proposed L.I.D. No. 954: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robin-
son voting aye by voice vote. .
ORDINANCE NO. $03, AN ORDINANCE providing for the improvement of certain property by grading,

Petition No. 470, having been filed with the City Clerk on May 6, 1966, by United Builders
of Washington, Inc. and Others, requesting annexation of property located between Nob Hill
Blvd. & Tieton Drive.and West of 47th Avenue, it was MOVED by Robinson, seconded by Lynch
that said Petition referred to the City Manager and the Planning Commission for study
and recommendation: carried, Brazier, Brown, Kurbitz, . Lambert, Larson, Lynch and Robinson
voting aye by voice vote.
MOVED by Robinson, seconded by Brown that Resolution No. D -949 authorizing execution of an
agreement with Cornell, Howland, Hayes and Merryfield for water system improvements, be
passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting
aye on roll call. John Mayo, Public Works Director, explained the attached addendum to saic
agreement becomes a part of the contract authorizing Cornell, Howland, Hayes and Merryfield
to do the design study of said project and makes it possible for the City to have an oppor-
tunity to make the final decision on the design study or can terminate said agreement at
any time before the design study is approved.
RESOLUTION NO. D -949, A RESOLUTION authorizing and directing the City Manager and City Clerk
of the City of Yakima to execute an agreement with Cornell, Howland, Hayes & Merryfield for
professional engineering services for water system improvements..
MOVED by Lambert, seconded by Robinson that Resolution No. D -950 authorizing refunds of
duplicate payments of 1966 Irrigation Maintenance Assessments, be passed as read: carried,
Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. City
Manager Smith explained that some Mortgage Companies had paid the Irrigation Maintenance
Assessments for properties they hold and some of these payments had already been made by
the home owner.
RESOLUTION NO. D -950, A RESOLUTION authorizing refunds of duplicate payments of 1966 Irri-
gation Maintenance Assessments.
The Planning Commission reporting on Petition No. 464, as filed by Orman E. Arnold & Others
praying for annexation of property located south of Mead Avenue, between Voelker and Rock
Avenue, it was MOVED by Brazier, seconded by Lynch that said Petition for Annexation be
approved as meeting the requirements of law; that the City Manager and the Mayor be author-
ized to obtain waivers of a meeting of a Review Board, as authorized bylaw; and that an
order be prepared fixing May 31, 1966 as the time for a public hearing by the City Council
on this petition: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson
voting aye by voice vote.
The Planning Commission reporting on Petitions No. 453, as filed by Neal D. Turner and
Others, requesting vacation of W. Walnut Street from Chisholm Trail, west to S. 44th Ave.
and Petition No. 459, as filed by Chris L. Bickler, requesting vacation of a portion of the
right -of -way of East Nob Hill Blvd., between Fair Ave., and S. 8th Street, it was MOVED by
Brazier, seconded by Lambert that resolutions be prepared setting June 13, 1966, as the time
for a hearing by the City Council on said Petitions: carried, Brazier, Brown, Kurbitz, Lam-
bert, Larson, Lynch and Robinson voting aye by voice vote.
The Planning Commission reporting on the following Petitions requesting rezoning:
Petition No. 444, as filed by Ralph Sundquist & Morrie Stotsenberg -- property
located at the intersection of Powerhouse Road, Lincoln Avenue and 24th Avenue;
Petition No. 461, as filed by Whitechester Heating Co., Inc., -- property
located at 3$03 Nob Hill Blvd.;
Petition No. 462, as filed by Ray Hayes and George Comstock -- property located
at Northeast corner of intersection of 40th Avenue and Tieton Drive; and
Petition No. 463, as filed by Harry E. Borland and Bentley Kern -- property
located at S.W. corner of intersection of Nob Hill Blvd. & S. 2nd Avenue.,
it was MOVED by Lynch, seconded by Brazier that May 23, 1966 be set as the time for a hear-
ing by the City Council on the matter of the rezoning of certain real properties according
to said petitions and that the City Clerk give notice of such hearings as required by law:
carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice
vote.
The Planning Commission reporting on the Final Plat of the Rasmussen Plat, it was MOVED by
Robinson, seconded by Lynch that said Final Plat be approved and that the Mayor be author-
ized to sign said Plat: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robin-
son voting aye by voice vote.
