Councilmen Brazier and Lynch absent on roll call. It ..was MOVED by Robinson, seconded by Brown that Councilmen Brazier and Lynch be excused from this meeting: carried, Brown, Kur- bitz, Lambert, Larson and Robinson voting aye by voice vote. The Invocation was given by Councilman Brown. The minutes of the regular meeting of March 2$, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Lar- son declared said minutes approved as recorded. In accordance with action taken at the regular Council meeting on March 2$, 1966, it was. MOVED by Lambert, seconded by Brown that Resolution No. D- 929 a.transfer from Nob Hill Water Company service to City domestic water service for Mr. Ted Haubrich, 915 South 41st Avenue, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call. Brazier and Lynch absent. RESOLUTION NO. D -929, A RESOLUTION authorizing a tranfer from Nob Hill Water Company servic T to City domestic water service for property at 915 S. 41st Avenue, Yakima, Washington. This being the time fixed for the hearing on Petition No.. 454, having been filed with the. City Clerk on March $, 1966, by the J. M. Perry Institute requesting rezone of property lo- cated at the Northeast corner of 24th Avenue and West Washington 'Avenue, it was MOVED by Lambert, seconded by Brown that Ordinance No. 7$9 accepting the recommendation of the Plan- ning Commission and rezoning said property, be passed as read. After due discussion, it wa- MOVED by Robinson, seconded Lambert that Section 4 of Ordinance No. 7$9 be amended to read: "This Ordinance is one to provide for the immediate preservation of the public peace, prop- erty, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this.Ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by and by the City Charter ". Motion carried: Brown, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Brazier and Lynch absent. Also, this property being involved in,and a part of, the reloca- tion of Washington Avenue, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 7$9 be amended by adding to Section 1, just below the property description, an independent paragraph reading as follows: "EXCEPT that portion of Parcels 1 and 2 lying South of the following described line: Beginning at a point on the North right of way line of West Wash- ington Avenue which is 450 feet East of the East right of way line of South 24th Avenue;. thence Northwesterly along the arc of a 6° circular curve to the Right with a radius of 954.93 feet, to the intersection of said curve with the East right of way line of South 24t Avenue; ": Motion carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. After due discussion, Mayor Larson called for the roll call vote on the Motion to pass Ordinance 7$9 as amended, .and it carried: Brown, Kurbitz, Lambert., Larson and Robinson voting aye on roll call. Brazier and Lynch absent. ORDINANCE NO. 789, AN ORDINANCE accepting the recommendation of the Planning . Commission and rezoning certain property situated at the northeast corner of 24th Avenue and West Washing- ton Avenue, in the City of Yakima, Washington, from M -3, Airport Industrial Zone, to M -1, Light Industrial Zone. . An Ordinance appropriating 83,000 to the 1966 Budget for City Hall in the Current Expense Fund, for the purchase of lighting fixtures, having been read in its entirety at this meet - ing, was ordered laid on the table for one week or until the regular meeting on April 11, 1966. City Manager Smith explained that this money is to be used for purchasing new light fixtures to replace worn out fixtures for which no replacement parts are available, and to upgrade the lighting in City Hall. An Ordinance appropriating $1,559 to the 1966 Budget for the City Garage Fund, for the pur- chase of new equipment, having been read in its entirety at this meeting, was ordered laid on the table for one week or until the regular meeting on April 11, 1966. City Manager Smith explained that originally enough had been appropriated in the Garage fund to purchase new vehicles, considering trade -ins, but. since we are not.now going to trade in vehicles on new equipment, but will try the auction method for disposing of used vehicles and equipment -, . this request is necessary. . MOVED by Lambert, seconded by Brown that Ordinance No. 790 proposing to the voters of the City of Yakima that the City purchase a motor coach system and calling for a special elec- tion to be held on May 24, 1966, and prescribing the form of ballot for said election, be passed as read. It was MOVED by Robinson, seconded by Kurbitz that Ordinance No. 790 be amended by deleting the following: "and shall have the right to borrow or use any general funds that may be legally available for the purpose of paying the costs necessary for the continued maintenance and operation of said system. In the event the revenues derived from the operation of said transportation system, and the proceeds from the housing unit transit subsidy tax provided for herein, should be insufficient for the adequate maintenance and operation of said system, and when such conditions are found to exist and are set forth in a resolution adopted by the Council, then and in that event the Council shall have and is hereby given the authority to borrow, or use without repayment thereof, any general funds that may be legally available for such purposes," and also delete in the Proposition to be put on the ballot the following: "and expend general funds, if necessary, to pay operating costs;" carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Councilman Robinson explained that he felt that this would be the wisest procedure and that everyone will understand the Ordinance better if it does not II allow any use or borrowing of general funds. Mayor Larson called for a roll call vote on the Motion to pass Ordinance No. 790 as amended, and it carried: Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call. Brazier and Lynch absent. Councilman Brown stated that he hoped the news media would inform the public that this Ordinance is a vehicl: to bring the situation before the public for a vote. Councilman Kurbitz stated that he is not in favor of the City acquiring the Bus Transit system, but voted yes to bring,the situa tion t a vote by the people. Councilman Lambert stated that she is not necessarily in favor the City operating the bus line, but felt it should be brought before the people to vote on. Councilman Robinson explained that he would prefer a private agency to operate the bus system, but it appears that private agencies are not able to do this. He indicated that he believes it is necessary and desirable for a community of our size to have bus ser- vice and that this ordinance should be brought to a vote by the people and that he would I L urge its passage. 146 APRIL 4, 1966 •• ORDINANCE NO. 790, AN ORDINANCE proposing to the voters of the City of Yakima that the City purchase, acquire and" construct all properties, equipment and facilities necessary to es- tablish, operate and maintain a motor coach system for the transportation of passengers for hire; specifying and adopting the system or plan proposed; declaring the estimated cost thereof, as near as may be; providing for the financing thereof; authorizing the levy and collection of a housing unit transit subsidy tax; calling a special election to submit a ill proposition to the voters of the City of Yakima for their ratification or rejection of this ordinance; and declaring an emergency. . MOVED by Brown, seconded by Lambert that Resolution No. D -930 req the Auditor of Yakima County, Washington to hold a special election, May 24, 1966 for the, purpose of sub- mitting to the electors a proposition entitled "Acquiring, Operating, Subsidizing City Transit" be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call. Brazier and Lynch absent. RESOLUTION NO. D -930, A RESOLUTION requesting the Auditor of Yakima County, Washington to hold a special election. . MOVED by Brown, seconded by Robinson that Resolution No. D -931, being a Resolution of Inten- tion to improve certain streets by constructing concrete curbs, gutters and surfacing, creating a local improvement district, in accordance with Petitions No 371, 387, 402, 443 and 449, and fixing the date of hearing on said matters for April 25, 1966, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call. Bra- zier and Lynch absent. RESOLUTION NO. D -931, A RESOLUTION of intention to create a local improvement district. MOVED by Robinson, seconded by Lambert that Resolution No. D -932 authorizing the execution of a Hold Harmless Agreement with the Naches Cowiche Canal Company, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call. Brazier and Lynch absent. Public Works Director, John Mayo, explained that the City contemplates im- provement of South 32nd Avenue along the route of the Canal Company's irrigation pipeline and there is a possibility of some cracking, although the line is in good condition. RESOLUTION NO. D -932, A RESOLUTION authorizing and directing the City Manager and City Cler of the City of Yakima to execute a Hold Harmless Agreement with Naches Cowiche Canal Company.
