MARCH 28, 1966
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll
call. Councilman Brazier absent on roll call. It was MOVED by Robinson, seconded by Brown
that Councilman Brazier be excused from this meeting: carried, Brown, Kurbitz, Lambert,
Larson, Lynch and Robinson voting aye by voice vote.

The minutes of the regular meeting of March 21., 1966, having been duly certified accurate
by two councilmen and no one present wishing to have said minutes read publicly, Mayor Lar-
son declared said minutes approved as recorded.
An Ordinance appropriating S1,400 to the 1966 Budget for the Police Department for the pur-
chase of two motorcycles, having been read in its entirety at the regular meeting of March
21, 1966, and being read by title only at this meeting, it was MOVED by Robinson, seconded
by Lambert that Ordinance No. 784 providing for said appropriation, be passed as read:
carried, Brown, Kurbitz, Larson, Lynch and Robinson voting aye on roll call. Bra-
zier absent.
ORDINANCE NO. 784, AN ORDINANCE appropriating the amount of 51,400 from unappropriated
monies in the Current Expense Fund to Account 940, Machinery and Equipment, of the Capital
Outlay Classification, in the 1966 appropriation for 121 - Police Department.
This being the time set for the hearing on Petition No. 441, as filed with the City Clerk
on February 1, 1966, by John A. Lanik, praying for annexation of property located on the
West side of 58th Avenue, it was MOVED by Robinson, seconded by Brown that Ordinance No.
785 providing for said annexation, be passed as read: carried, Brown, Kurbitz, Lambert, ,
Larson, Lynch and Robinson voting aye on roll call. Brazier absent.
ORDINANCE NO. 785, AN ORDINANCE providing for the annexation by the City of Yakima of cer-
tain property contiguous to the City of Yakima and zoning the same as R -1, One- Family Zone.
Petition No. 458, . having been filed with the City Clerk on March 24, 1966, by Lambert
Benoit, President of Valley Dental Plaza, and Others, requesting the paving of the alley in
the middle of Block 390, Capitol Addition, between N. 10th and llth Avenues, it was MOVED
by Robinson, seconded by Lambert that said Petition be referred to the City Manager and
Staff: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice
vote. Brazier absent. Discussion indicated that this project is to be accomplished by
formation of a Local Improvement District.
MOVED by Lynch, seconded by Brown that Ordinance No. 786, relating to Utility Taxes and
amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert,
Larson, Lynch and Robinson voting aye on roll call. Brazier absent. City Manager Smith
explained that the section regarding the utility tax on the telephone business is being
amended to bring it in line with the tax rates charged the other utilities.
ORDINANCE NO. 786, AN ORDINANCE relating to business and occupation taxes upon certain
utilities, fixing tax rates, providing for a surcharge, saving certain taxes and amending
Section 5.50.050 of the City of Yakima Municipal Code; and declaring an emergency.
MOVED by Robinson, seconded by Kurbitz that Ordinance No. 787 fixing the time of delinquency
and prescribing the form of Installment Notes for the payment of the unpaid portion of L.I.B.
No. 935, South 8th Avenue Sanitary Sewer, be passed as read: carried, Brown, Kurbitz, Lam-
bert, Larson, Lynch and Robinson voting aye on roll call. Brazier absent.
ORDINANCE NO. 787, AN ORDINANEE fixing the time of delinquency of installments of assess-
ments levied for the payment of the cost of the improvement in Local Improvement District
No. 935, and providing for the issuance of Local Improvement District Installment Notes for
the payment of the unpaid portion thereof.
MOVED by Lynch, seconded by Brown that Ordinance No. 788 fixing the time of delinquency and
prescribing the form of Installment Notes for the payment of the unpaid portion of L.I.D.
No. 938, Blossom Hill & Others Sewer, be passed as read: carried, Brown, Kurbitz, Lambert,
Larson, Lynch and Robinson voting aye on roll call. Brazier absent.
ORDINANCE NO. 788, AN ORDINANCE fixing the time of delinquency of installments of assess-
ments levied for the payment of the cost of the improvement in Local Improvement District
No. 938, and providing for the issuance of Local Improvement District Installment Notes for
the payment of the unpaid portion thereof.
MOVED by Lambert, seconded by Robinson that Resolution No. D -926 authorizing filing of an
application for a grant to aid in financing construction of a domestic water treatment and
filtration plant, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and
Robinson voting aye on roll. call. Brazier absent. City Manager Smith explained that this
authorization from the Council is necessary to complete the final application which is to
be taken to Seattle on Wednesday, March 30, 1966.
RESOLUTION NO. D -926; A RESOLUTION authorizing filing of application with the Department of
Housing and Urban Development, United States of America, for a grant under P.L. 89 -117.
MOVED by Lynch, seconded by Robinson that Resolution No. D -927 adopting a land acquisition
policy statement in connection with the filing of an application for a grant to aid in
financing the construction of a domestic water treatment and filtration plant, be passed as
read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz
not voting, stating that he was not familiar enough with the material on this Resolution.
Brazier absent. City Attorney Andrews explained that as a part of the application, there
is a requirement that the City give assurance to the Housing and Urban Development Depart-
ment, that the City will follow certain recommended practices in acquiring land if neces-
sary for the . purpose of carrying out said project, and in accordance with this requirement,
the City is to file with its application, a statement of policy as to how the City will
acquire this land. He further stated that the requirements have to do with negotiation
with the land owners in order to obtain property by negotiation without condemnation or
court action.
RESOLUTION NO. D -927, A RESOLUTION adopting a land acquisition policy statement in com-
pliance with section 402 of the Hou sing and Urban Development Act of 1965.

MOVED by Robinson, seconded by Brown that Resolution No. D -92$ authorizing the purchase of
two motorcycles for use by the Police Department, without calling for bids, be passed as
read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call.
Brazier absent. City Manager Smith explained that the Washington State Patrol has made
these two motorcycles available for purchase by governmental agencies up until April 1,
1966, after which time they will put them up for bids to the general public, so in order
for the City to take advantage of this opportunity, they ask for the authorization of the
Council to purchase without calling for bids. .
RESOLUTION NO. D -92$, A RESOLUTION authorizing the purchase of equipment without calling
for bids. .
Mr. Remie N. Jaussaud, Land Surveyor, representing Mr. Ronald Poole and Mr. D. A. Fellows,
in replatting certain properties in Yakima, having filed with the City Clerk on March 25,
1966, a written request to refer this matter to the City Planning Commission, it was MOVED
by Robinson, seconded by Lynch that the proposed replatting of said property be referred to
the Planning Commission as requested: carried, Brown, Kurbitz, Lambert, Larson, Lynch and
Robinson voting aye by voice vote. Brazier absent. Planning Director, Rudy Gast, presente.

Manor, and explained the purpose of this proposed replatting is to vacate a street, redesig
the lots and create a new access so that the lots can become more accessible and be develop
ed. . .

Mayor Larson read a communication from the Department of Health inviting the Council member -
to attend a meeting on the benefits of Fluoridation at the Health Institute in Seattle on
Friday, April 22, 1966.
City. Manager Smith, on behalf of Fire Chief Jules Shockley, requested authorization for
Eldon Mantey and Ed Rumsey of the Fire Department, to travel to Portland, Oregon, for one
day 'on March 30, 1966, at an approximate expense of $6.00. It was MOVED by Robinson,
seconded by Brown that authorization be given for Eldon Mantey and Ed Rumsey to make said
trip with expenses paid: carried, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson votin&
aye by voice vote. Brazier absent. Mr. Smith explained that the purpose of this trip is
for these men to observe the operation of some new fire equipment.
City Manager Smith, on behalf of Frank Stein, Utilities Director, requested authorization
for Glen Perkins and Al Burleson of the Water Department, to make two trips, with expenses
:paid; one, a one -day meeting of the Association of Water Works at Pendleton, Oregon at an
approximate cost of $5.00 each, and the other, to attend the Northwest Conference of
American Water Works Association from April 26 - 30, 1966 in Vancouver, B. C., Canada, at
an approximate cost of S95.00 each. It was MOVED by Robinson, seconded by Brown that said
trips be allowed with expenses paid: carried, Brown, Kurbitz, Lambert, Larson, Lynch and
Robin voting aye by voice vote. Brazier absent. .
City Manager Smith, in referring to the Bulletin and card received by the Council members
from the Association of Washington Cities, in reference to the Annual Statewide Convention
to be held in Yakima on May 11, 12 and 13, 1966, suggested that all Council members get
their registrations in early and mail in the cards with suggested topics for the Roundtable
discussions. He further suggested that the names of the two voting delegates need to be
sent in to Seattle. Mayor Larson suggested that the Council members be thinking about thes:
suggestions and try to attend this Convention, and that selection of the two voting dele-
gates be put off for one more week until it is known who will be attending.
A request to transfer from Nob Hill Water Company service to Yakima domestic water service,
having been filed with the City Clerk on March 16, 1966, by Mr. Ted Haubrich, 915 S. 41st
Avenue, and Frank Stein, Utilities Director, stating that this request is in line with
Ordinance No. 747, relating to the transfer of water consumers from private domestic water
supply companies to the municipal domestic water system, as passed by the City Council on
November 29, 1966, and recommending that this transfer be allowed, it was MOVED by Robinson,
seconded by Lambert, that a Resolution be prepared as authorized in Ordinance No. 747, auth
orizing said transfer of water service: carried: Brown, Kurbitz, Lambert, Larson, Lynch and
Robinson voting aye by voice vote. Brazier absent.
There being no further business to come before the Council, it was MOVED by Kurbitz, secon-
ded by Robinson that we now adjourn at the hour of 4:05 P.M.: carried,. Brown, Kurbitz, Lam -
