March 7, 1966 .
The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown,
Kurbitz, Lambert, Lynch and Robinson, City. Manager Smith and City Attorney Andrews present
on roll call.
The Invocation was given by Councilman Brazier.
The minutes of the regular meeting of February 2$, 1966, having been duly certified accurat:
by two councilmen and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded. .
In accordance with action taken by the Council on February 7, 1966, the hearing on a Genera
Plan for the City of Yakima having been recessed until the Council meeting on today's date,
namely March 7, 1966, it was MOVED by Lynch, seconded by Lambert that Ordinance No. 779
adopting the General Plan for the City of Yakima and providing for amending the Yakima
Municipal Code, be passed as read. Discussion followed. Mr. Don Tait, Editor of the Yakim.
Eagle, opposing the General Plan, read a letter offering the services of this paper to print
a questionnaire asking the people of Yakima whether or not they favor the passage of the
Proposed General Plan, offering to collect the signed answers and pay for counting them.
Mr. Tait stated he believes this would be quick and accurate and would obtain the true sen-
timents of the citizens of Yakima concerning this plan. Councilmen Lynch and Lambert
stated their disapproval of this suggestion and indicated that they did not believe a poll
of this sort would be accurate .and that the people of Yakima have had over a year and had
several hearings in which to express their opinions. Others speaking against the passage
of the Proposed General Plan were Mr. Gene Land and Mr. Philip Robbins, who indicated that
they did not like the references to use of federal funds. .Those present and speaking for
the passage of the Ordinance to adopt the General Plan, were Gerald Latham of the Central
Labor Council, who stated that at their recent meeting they could find, no opposition to thi-
General Plan and felt that Yakima should have this plan; Mr. Forrest Brewer, President of
the Yakima Chamber of Commerce, stated that the Chamber of Commerce supports the orderly
growth of Yakima and are for the passage of this Plan; H. A. O'Reilly representing Teamster-
Union #524, stated that this organization supports the General Plan and feel it is real
progress and urged the Council to adopt said General Plan; and Mrs. Syverson, former Art
Director in the City Schools, indicated she is very much in favor of adopting the General
Plan. After due discussion, Mayor Larson called for the vote to pass Ordinance No. 779:
carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll_
call. Councilman Kurbitz stated he believes that the General Plan is a sincere effort on
the part of a great many people to benefit. Yakima. He further stated that although this
Plan seems to be acceptable to the majority of the people, it will not be completely what
everyone wants. He indicated he is disappointed in some aspects of the plan and felt that
more specific plans should have been made in the plan for a Civic Auditorium and Stadium
and more'specific information on the moving of traffic. He also stated he is disappointed
that our own Planning Commission did not prepare this Plan as he is confident that they
could have done the job. Councilman Brazier stated that the General Plan shows sound pro-
gressive thinking and offers a.framework for the future of our community. He also stated
his concern and disapproval of the concerted effort which has been made to oppose this
Plan and the remarks that these people have made against the Council, and stated that it
would seem that the so- called Committee of 1000, many of whom do not live in the City,
rather than spending so much time and money in planting seeds of distrust, would work to-
ward more constructive ideas for the good of the City. Councilman Brown stated that the
adoption of the General Plan is the proper step toward better future planning for this
area so that we may be proud of our City.
This being the time set for the continuation of the hearing on Petition No. 429, as filed
by Monarch Stations, Inc., said Petition requesting vacation of a portion of the Northwest
corner of the intersection of Tieton Drive and S. llth Avenue, and having been first heard
on February 21, 1966, Mayor Larson read a letter from Mr. Harvey Block of Monarch Stations,
Inc., stating that since this property has been sold, there is no longer need for this
vacation. It was MOVED by Robinson, seconded by Lynch that this matter be postponed in-
definitely: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson. voting
aye by voice vote.
This being the time set for the hearing on. Petition No. 43$, as filed with the City Clerk
by Yakima School District #7, requesting vacation of a portion of Spruce Street, and the
architect and others concerned with this vacation not being present at this time, it was
MOVED by Brown, seconded by Robinson that this hearing be dropped to later on the agenda:
carried, Brazier, Brown, Lambert, Larson, Kurbitz, Lynch and Robinson voting aye by voice
vote.
A notice of intention to commence annexation proceedings, as filed by 0. L. Burnham for
property located West of Minnesota between Englewood and Lincoln Avenue, and Mr. Francis
Jaeger .having filed with the Clerk of the .Council, a Power of Attorney executed by Otto L.
Burnham and Gertrude Burnham, appointing him Attorney -in -fact, and stating that Mr. and
Mrs. Burnham authorize Mr. Jaeger to act for them in all matters of this annexation, and
that Mr. and Mrs. Burnham agree to assume their share of the city's existing indebtedness
in the matter of this annexation, it was MOVED by Robinson, seconded by. Lynch that this
date, March 7, 1966, be set as the time for a meeting with Mr. Jaeger acting for the
initiating party, Mr. 0. L. Burnham who signed the Notice of Intention to Commence Annexa-
tion Proceedings dated February•2, 1966: carried, Brazier, Brown, Kurbitz, Lambert, Larson,
Lynch and Robinson voting aye by voice vote. Mr. Jaeger, having stated to the Council that
the area to be annexed is willing to assume its share of the city's existing indebtedness,
it was MOVED by Robinson, seconded by Lambert that the annexation proposed by said party be
accepted by the City of Yakima and that the area to be annexed be required to assume its
share of the city's existing indebtedness: carried, Brazier, Brown, Kurbitz, Lambert, Larson,
Lynch and Robinson voting aye by voice vote.

ORDINANCE NO. 779, AN ORDINANCE relating to planning; adopting a comprehensive plan for the
City of Yakima; providing a procedure for amending such plan; and repealing Section
1.42.070 of the City of Yakima Municipal Code.

Petition No. 450; having been filed with the City Clerk on March 1, 1966, by Henry Hamberg
and Others, praying for annexation of property located in the Coonse State Addition and a
portion of Cornell Avenue and King Street, it was MOVED by Robinson, seconded by Brown
that said petition be referred to the City. Manager and the Planning Commission for study
and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson
voting aye by voice vote.
Petition No. 451, having been filed with the City Clerk on March 2, 1966, by Robert P.
Moriarty and Others, requesting vacation of a'portion of Barge Street between 41st and 42nd
Avenues, it was MOVED by Lynch, seconded by Brown that said Petition be referred to the
City Manager and Planning Commission for study and recommendation: carried, Brazier, Brown,
Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
MOVED by Robinson, seconded by Lambert that Ordinance No. 781 relating to parking motor
vehicles, making registered owner responsible for parking violations and amending Yakima
Municipal Code, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch
and Robinson voting aye on roll call. City Attorney Andrews explained that the reason the
amendment is proposed and made necessary is because it has just come to the attention of
the City that the existing ordinance is partly unconstitutional and legally unenforceable.
ORDINANCE NO. 781, AN. ORDINANCE relating to parking motor vehicles, and making the regis-
tered owner thereof prima facie responsible for parking violations; amending Section
9.36.240 of the City of Yakima Municipal Code; and declaring an emergency.

Councilman Lambert called to the attention of the Council that Mr. Rollo Goold, Assistant
Superintendent of Schools and Wm. Phipps, Architect now are present representing Yakima
School District #7 in the matter of vacating of a portion of Spruce Street and which was
set ahead earlier in this meeting, Mayor Larson opened the hearing on this matter. It was
MOVED by Lambert, seconded by Robinson that Ordinance No. 780 providing for the vacation of
a portion of Spruce Street, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert,
Larson, Lynch and Robinson voting aye on roll call. Mr. Phipps had a scale model of the
Davis High School as it now is and scale models t� show where the new buildings will be,
and he and:Mr. Goold explained how this vacation gives them more room for expansion and
parking.
ORDINANCE NO. 780, AN ORDINANCE providing for the vacation of a portion of Spruce Street
in the City of Yakima, Washington.
MOVED by Lynch, seconded by. Robinson that Resolution No. D -920 authorizing the filing of an
application for a grant to aid in financing the purchase of equipment in .connection with
the Yakima City Bus lines, Inc., be passed as read: carried, Brazier, Brown, Lam e r t . , -

It was explained by.City Manager Smith that this resolution is.one.of the requirements for
filing the final application for a Federal grant under the Urban Mass Transportation Act
of 1964. He further explained that a preliminary application was submitted January 4, 1966
and notice of approval of this preliminary application was received indicating that the bus
transit project would qualify for the maximum Federal grant of .two- thirds of the net project
cost. Mr. Knopff, interested citizen, spoke on the bus situation stating that the buses
should run oftener and be better scheduled timewise for older people. Councilman Kurbitz
stated he is opposed to this application for Federal funds. He further stated he did not
believe that the buses carried many people, and since we are engaged in a war, he does not
believe we should ask for Federal funds to finance this project. Councilman Robinson state.!
he is not in favor of just having the money to go Washington, D. C., in the way of taxes
and not have some of it some back for such worthy project.
RESOL'UTICN.NO. D -920, A RESOLUTION authorizing the filing of an application with the Housing
and Home Finance Agency, United States of America, for a grant under the Urban Mass Trans-
portation Act of 1964.
Ir. V. 0. Nichoson, attorney for the Yakima Valley Transportation Company, being present,
indicated that the Yakima Valley Transportation Company is having its Board meeting on
March 7, 1966, and copies of Resolution No. D -920 and other information were handed to him
for this meeting.
MOVED by Brown, seconded by Robinson that Resolution No. D -921 authorizing the purchase of
used equipment, Power Saw and Mower for the Airport, without calling for bids, 'be 'passed as
read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on
roll call. City Manager Smith explained that this equipment had been allowed for in the
budget for new equipment, but some used equipment that is in very good condition can be
bought for approximately $400 less.
RESOLUTION NO. D-921, A RESOLUTION authorizing and directing the purchase of personal prop-
erty without calling for bids.
The Planning Commission having reported on Petition No. 441, as filed by John H. Lanik,
praying for annexation of property located on the west side of 58th Avenue, it was MOVED by
Robinson, seconded by Lambert that said Petition be approved as meeting the requirements
of law, that the City Manager and Mayor be authorized to obtain waivers of a meeting of a
Review Board, as authorized by law; and that an order be prepared fixing March 28, 1966,
as the time for a public hearing by the City Council on this petition: carried, Brazier,
Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
The Planning Commission reporting on Petition No. 444, as filed by Ralph E. Sundquist and
Morrie Stotsenberg, requesting rezone of property located on the north side of Lincoln
Avenue, between N. 24th and N. 25th Avenues, and Petition No. 445, as filed by Yakima Schoo
District #7, requesting rezone of property located between W. Walnut St. to W. Pine St. and
S. 6th Ave. to S. 7th Ave., it was MOVED by Brazier, seconded by Robinson that March 21,
1966, be set as the time for a hearing by the City Council on the matter of rezone of cer-
tain real property as petitioned by said petitions, and that the City Clerk give notice of
such hearings as required by law: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch
and Robinson voting aye by voice vote.

City Manager Smith requested that Fire Chief Jules Schockley be given permission to make a
trip to California to visit San Jose, Sacramento and San Francisco, on March 10 - 12, 1966,
for the purpose of investigating the snorkel trucks that they have in these cities, at an
approximate cost of $161. It was MOVED by Kurbitz, seconded by Robinson that Fire Chief
Schockley be authorized to make said trip with expenses paid: carried, Brazier, Brown,
Kurbitz, Lambert, Larson, Lynch and. Robinson voting aye by voice vote.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Lynch that we , do now adjourn at the hour of 4:40 P.M.: carried, Brazier, Brown,
