The minutes of the regular meeting of February 14, 1966, having been duly certified accur- ate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. -ar M�. 5 In accordance with action - taken by the City Council on February 14, 1966 regarding Petition;. -r* No. 446, as filed by the Roosevelt Parent - Teacher Association, requesting relocation of the parking lane on Summitview Avenue from the North side to the South side, and said petition being held over until this meeting, Mayor Larson opened the meeting for discussion by those .. for and against this change. Mrs. Joe Davidson, Mr. Claude Brannon, Mrs. Braden, Mrs. Roberts, Mrs. Salatino and Mr. John Vanderbrink indicated that they believe it is vital to • the safety of their children to have this parking lane changed. They stated that a survey has been made and there are 170 children at Roosevelt that use this street, as well as children oing to other schools. They also mentioned that next year there will be approxi- • mately 168 kindergarten students traveling on Summitview. They further indicated that the children are well oriented by Sgt.. Pennell and the School Patrol, but feel that many more children walk on the south side than on the north side and need the parking lane next to the sidewalk as a safety measure. Many people were in attendance,' who had signed the ori- ginal petition to put the parking lane on the North side, and still believe that for the safety of the children, it should be left where it is. They stated that there is more pro- tection with the sidewalk on one side and the parking lane on the other. Speaking for: leaving it as it is were Mrs. Adamson, Mr. Howard Gerritson, Mr. Britt, Gladys Lakey and • others. Several people mentioned that the biggest problem is the high speed -of cars traveling on Summitview. Mr. Claude Brannon, in working with Sgt. Pennell and the School Patrol, mentioned concern for safety of the children, and stated that he believed the park- ing lane should be changed, and also mentioned that there has not been an accident where there has been School Patrols. John Mayo, Public Works Director, in answering questions about what the Safety Council and the engineers considered the safest walking area, said the ideal situation would be to have a sidewalk on both sides, but since that is impossible: • •suggested that consideration might be given to taking the parking lane and dividing it, • 3 ft. on one side and 4 ft. on the other side, forming a buffer lane on each side. Council men discussed the situation and agreed that everyone wants the most safety for the children' • but they do not agree as to the best way to arrive at the solution to the problem. Courril members indicated that they want to do the best thing for the safety of the children and that the problem should be given more study by the Staff. It was MOVED by Lynch, seconded by Lambert that we ask the staff to study this situation and give us their recommendation, exploring all possibilities of changing this around, leaving it as it is, dividing the parking area for a buffer, or any other suggestions, and contact all persons possible that are concerned: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. This being the time set for the Hearing on Petition No. 429, as filed by Monarch Stations, Inc. requesting vacation of a portion of the Northwest corner of the intersection of Tieton Drive and S. 11th Avenue as postponed from January 10, 1966, and Mr. Harvey Block of Mon- arch Stations, not being able to be present at this meeting, it was MOVED by Robinson, seconded by Lynch, that said hearing be held over for two weeks or until the regular coun- cil meeting on March 7, 1966: carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye by voice vote. Kurbitz absent. This being the time set for the hearing on the appeal from the Planning Commission's deci- sion on Petition No..431, as filed by Myrtle 0. Keller and Others requesting rezone of property located at 211, and 215 N. Crescent Drive, it was MOVED by Robinson, seconded by Brown that Resolution No. D -916 affirming the action of the Planning Commission in deny- ing application for said rezone, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier voting nay on roll call. Kurbitz absent. IVIr. Jim Van Nostern, }property owner in this vicinity, asked what kind of business is planned for this area. Mr. Keller, being present representing the petitioners, stated that they did not have anything in detail planned, but if it were to be rezoned to B -1, then it probably would be used for Medical Buildings., as Dr. Stiles, one of the petitioners has been approached by. other doctors regarding a medical center in this vicinity. Councilmen discussed the reasons for affirming the action of the Planning Commission in denying this rezone. They agreed on encouraging medical centers in this west side area, but advised Mr. Keller that more definite plans and drawings should be presented to the Planning Commission and then to the Council. • RESOLUTION NO. D -916, A RESOLUTION affirming the action of the Planning Commission in deny- ing the application of Myrtle 0. Keller, and others, to rezone property located at 211, 213 and 215 N. Crescent Drive in the City of Yakima from R-3, Multiple Family Zone, to B -1, • Modified Business Zone. This being the time set for the hearing on Resolution No. D -905, being a Resolution of Intention to improve property by constructing sewers to serve portions of Fairbrook Addi- tion, Coonse State Addition, Rasmussen Addition, Washington Avenue Addition and Chandler Addition, in accordance with Petitions No. 400, 426, 437 and 439, and there being no pro- tests in writing or other wise, it was MOVED by Lynch, seconded by Robinson, that Ordinance No. 773 creating L.I.D. No. 950, Fairbrook Addition and Other Sewers, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kur- bitz absent. Mr. Mark Wilson, property owner in this vicinity, being present, asked for information on the forming of this L.I.D. and how it would affect him, as he had just. bought property in the area and has been informed that his septic tank is in good-condition ivlr. John Mayo, Public Works Director, explained that the property owner need not - hook on to • the sewer until he has problems with the septic tank. Boise Cascade Corp., requesting vacation of a portion of East "G" Street, it was MOVED by Robinson, seconded by Brown, that Ordinance No. 774, providing for said vacation, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. This being the time set for the hearing on the Assessment Roll for L. 1. D. No. 936, Blossom Domestic Water, and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Brown that said Assessment Roll and every part thereof; be • passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. • ORDINANCE NO. 775, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 936 as created and established by Ordinance No. 634 of. the Ordinances of the City of Yakima. . This being the time set for the hearing on the Assessment Roll for L.I.D.. No. 937,. Tri- Skool.Domestic Water, and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Robinson, that said Assessment Roll and every part thereof, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 776, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 937 as created and established by Ordinance No. 635 of the Ordinances of the City of Yakima. . A Notice of Intention to Commence Annexation Proceedings, as filed by 0. L. Burnham, for property located West of Minnesota between Englewood and Lincoln Avenue, having been contin- ued from February 14,. 1966, 1966, and Mr. Burnham still not being able to attend this meet- ing, it was MOVED by Lynch, seconded by Brazier that this matter be further continued to the council meeting of March' 14, 1966: carried, Brazier, Brown, Lambert, Larson, Lynch and . Robinson voting aye by voice vote. Kurbitz absent. Councilman Lynch suggested that possibly arrangements could be made to have a proxy act for Mr. Burnham in this matter. Petition No. 44$, as filed by Ted Haubrich and Others, requesting construction of a water main in the vicinity of South 42nd Avenue - Mount Vista Addition, and Petition No. 449, as filed by Ted Haubrich and Others requesting construction of curb, gutter and surfacing of E. 2, of 42nd Avenue, Arlington to Nob Hill Blvd., both petitions having been filed with the City Clerk on February 17, 1966, it was MOVED by Robinson, seconded by Lynch, that said _ Petitions be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. RESOLUTION NO. D -91$, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Lease Agreement with Frigid Fruit Co., Inc. • • . D -919, A RESOLUTION of intention to create a.local improvement district. In accordance with Resolution No. D -909 prescribing a form of contract for City advertising and directing publication of notice for proposals, one bid and one bid only was submitted by the Yakima Daily Republic for the City printing for the period commencing February 21, 1966 and ending on the third Monday in February, 1967, it was MOVED by Robinson, seconded by Brown that said bid be awarded to the Yakima Daily Republic and that the City Manager be and is hereby authorized to enter into an agreement with said Yakima Daily Republic: carrie.l, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. r 131 • FEBRUARY 21, 1966 • rCity Manager Smith. reported that a letter had been prepared regarding the North Cascade Study Report on all water shed area, in accordance with Council action on February 14, 1966. He further reported that Mr. I. 0. Barrett, Forest Supervisor of Snoqualmie National Forest. spoke at the Chamber of Commerce luncheon and from Mr. Barrett'.s presentation he'is now satisfied that all the questions have been answered,. and that since the councilmen were present and heard Tir. Barrett's presentation, there is no present need to send the letter. Mr. Hal Foss,.being present, protested this action and urged council members to make known • their concern about the'future development of the areas involved in the City Water shed. Mr. Foss also urged the council members to study further the whole matter. After discus- sion by councilmen, it was MOVED by Lynch, that the letter that has been drafted not be sent, but be re- worded to say that the proposed plan is satisfactory to the City of Yakima now, but if roadways or logging would be brought into these areas in the future, that the City of Yakima would be concerned with the purity of our water. This motion lost for want of a second. Councilman Brazier stated that he is against sending a letter at all. Coun- cilman Robinson stated that he had confidence in the Forest Service to protect the areas vital to our community, and that he is not in favor of any program that cannot be changed and indicated that a program favored today, might be improved by changes in the future. There being no further business to come before the Council, it was MOVED by Brazier, secon- ded by Lynch that we do now adjourn at the hour of 10:45 P.M.: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson v.ting aye by voce vote.
