HomeMy WebLinkAbout02/14/1966 Business Meeting 126 - • • FEBRUARY 14, 1966 The City Council met-in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Kurbitz absent. It was MOVED by Lynch, seconded by Robinson that Council- man Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. • The Invocation was given by Councilman Lynch. The minutes of the regular meeting of February 7, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . • This being the time set for the hearing on Petition No. 435,, as filed with the City Clerk on December 14, 1965, by Maude Tesh requesting rezone of property located at 211 East • Lincoln, it was MOVED by Brown, seconded by Lambert that Ordinance No. 769 accepting the recommendation of the Planning Commission and rezoning said property, be passed as read :. In discussion, Mr. Fred Velikanje, attorney for Mrs. Tesh, explained the reason his client - wishes to rezone this property. At present she has a boarding house, that is no longer profitable and is planning to build a two -story apartment house, which cannot be done unlesE the property is rezoned. Mr. V. J. Beaulaurier, attorney, spoke on behalf of the Century Plaza, business building across the alley from 'the Tesh property, protesting the rezoning • of this property because building an apartment house, or any structure, out to the sidewalk on Lincoln would obstruct vision; and there would be an overflow of vehicles parking in their parking lot, that would present a policing problem. Mr. Beaulaurier asked that this be referred back to the Planning Commission for further study as he indicated he felt that the zoning code should be changed to allow apartment houses in the R -3 zone, which would require some setback from the sidewalk in building any structure on the lot. Mr. Eugene Ivy, property owner in this vicinity, objected to the rezone because he felt it would pre- sent traffic and parking problems. Mrs. Desmarais, property owner, also objected to this rezone because of parking facilities. Mr. Peter Bechard; property owner next to the Tesh property, objected to the rezone and apartment house because a high fence or wall next to • his property would block out the .sun on his flowers and garden. Councilman Lambert indica- ted she was opposed to a structure being built out to the sidewalk and thought consideration should be given to rezoning this property to B -l. Other council members indicated that these objections to this rezone should'have been brought out at the Planning Commission meeting prior to this meeting. After due discussion, it was MOVED by Robinson, seconded by Brazier that the Ordinance be amended.by deleting that part which reads "that the majority of property owners in the vicinity do not oppose the change in classification ": carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice. vote. Kurbitz absent. Mayor Larson then called for the vote on the original motion to pass Ordinance No. 769 as amended: carried, Brazier, Brown, Larson, Lynch and Robinson voting aye on roll call. Lambert voting nay on roll call. Kurbitz absent. * ** ORDINANCE N0. 769, AN ORDINANCE accepting the recommendation of the Planning Commission and x rezoning certain property located South of Lincoln Avenue, between North 5th Avenue and 6th • AVenue,.in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -3; General Business Zone. * * ** See Page. 128 for correction. • This being the time set -for the hearing on Petition No. 436, as filed with the City Clerk on December 17, 1965, by Erma Frye and Others, requesting rezone of property located south of Lincoln Avenue between.North 5th Avenue and North 6th Avenue, it was MOVED by Lynch, • seconded by Robinson that Ordinance. No. 770 accepting the recommendation of the Planning Commission and rezoning said property, be passed as read: carried, Brazier, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brown excused from voting. Kurbitz absent. Mr. Richard Newbry, representing the Albertson's Company, explained that this requested rezone is for the:piurpose of building a large Albertson's shopping center in this district, and • that this company would be investing about $60,000 and employing approximately 40 persons. He also described to the council members, the size of the proposed building and filed the proposed plan with the Mayor. ORDINANCE NO. 770, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property located South of Lincoln Avenue, between North 5th Avenue and 6th Avenue, in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -3, General Business Zone. • This being the time set for the hearing on the Assessment Roll for L.I.D. No. 935, South 8th Avenue Sanitary Sewer, and there being no protests in writing or otherwise, it was MOVEL by Brown, seconded by Lynch that Ordinance No. 771 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robin- son voting aye on roll call. Kurbitz absent. ORDINANCE NO. 771, an ORDINANCE confirming the assessment roll covering Local Improvement District No. 935 as created and established by Ordinance No. 628 of the Ordinances of the City of Yakima. • This being the time set for the hearing on the Assessment Roll for L.I.D. No. 93$, Blossom Hill and Others Sanitary Sewer, and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Robinson, that Ordinance No. 772 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brown excused from voting. Kurbitz absent. • ORDINANCE N0. 772, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 938 as created and established by Ordinance No. 637 of the Ordinances of the City of Yakima. . Petition No. 446, having been filed with the City Clerk on February 11,, 1966 by the Roose- velt Parent- Teacher Association, requesting relocation of the parking lane on Summitview Avenue from the North side to the South side, it was'MOVED by Lynch, seconded by Brazier that said Petition be held over one week or until the regular Council meeting on February 21, 1966: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye .by voice vote. Kurbitz absent. • In accordance with action taken by the City Council on February 7, .1966, it was MOVED by Brazier, seconded by Lambert that Resolution No. D -911 fixing the time for hearing for March 7, 1966, on Petition No. 43$, as filed by Yakima School District No. 7, requesting vacation of a portion of Spruce Street, be . passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -911, A RESOLUTION fixing the time for hearing on petition for vacation of street. • MOVED by Lambert, seconded by Robinson that Resolution No. D -912 authorizing filing of application for a grant and /or loan under the terms of Public Law, to aid in financing con - struction of a 16" water main at 16th Avenue to South 1st Street, be passed.as read: car ried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. City Manager Smith explained that this grant, if obtained, would involve 50 per cent of the total cost of said project, or approximately one hundred thousand dollars. RESOLUTION NO. D -912, A RESOLUTION authorizing filing of application with the Economic Development Administration, U. S. Department of Commerce, United States of America, for a grant and /or loan under the terms of Public Law 89 -136. MOVED by Robinson, seconded by Lynch that Resolution No. D -913 authorizing application for • a federal grant in connection with the installation of the Washington Avenue Interceptor Sewer Extension, be passed as read: carried, Brazier, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brown excused from voting. Kurbitz absent. City Manager Smith . explained that this grant, if allowed, would amount to 30 per cent of the total amount of . . said project, or about $32,000, and since the balance, of the x;10$,000 has been allowed in the 1966 budget, it will not be necessary to have any other additional funds. RESOLUTION NO. D -913, A RESOLUTION authorizing and directing the City Manager of the City . of Yakima to make an application for a federal grant in connection with the installation of the Washington Avenue Interceptor Sewer Extension. MOVED by Lambert, seconded by Lynch that Resolution No. D -914 authorizing the filing of a preliminary inquiry concerning federal assistance for the proposed water treatment and filtration plant, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and • Robinson voting aye on roll call. Kurbitz absent. City Manager Smith explained that • filing of a preliminary inquiry is required to find out if the City is eligible to file a request for federal assistance on this project. He further indicated that the Act con - cerned provides for a 50 per cent grant for water. treatment, provided the City is eligible for this Grant. RESOLUTION NO. D -914, A RESOLUTION authorizing the City Manager of the City of Yakima to file a preliminary inquiry concerning federal assistance for the proposed water treatment and filtration plant. . Councilman Brazier asked to be excused from the rest of this meeting, and requested that time be taken from the regular.agenda to. make a few remarks. He suggested that in view of the growth in Puget Sound area recently, and the fact that 60,000. more people are expected in this area this year, that we do everything we can t� keep abreast of any developments that may take place. Brazier excused from the rest of the meeting. MOVED by Lambert, seconded by Robinson that Resolution No. D -915 denying a claim for damages against the City of Yakima, in the amount of $500, as filed by Felix Gray, Jr., be passed as read: carried, Brown, Lambert, Larson, Lynch.and Robinson voting aye on roll call.. Brazier and Kurbitz absent. City Attorney Andrews explained-that this claim for • damages was being denied because said Claim is not properly verified 'and claimant,'s.signa- ture is not properly acknowledged by a Notary Public, as required by law, and that he will inform Mr. Gray of this so he can turn in a proper petition if he wishes. • RESOLUTION NO. D -915, A RESOLUTION denying a Claim for Damages against the City of Yakima. • • 12 • • • FEBRUARY 14, 1966 • • • A damage claim having been filed with the City Clerk on February 7, 1966, by Virginia L. Walters, 1111 Brown Avenue, because the Garbage Collectors picked up . a new Tupperware .Gar- bage. pail valued at $12.95, it was MOVED by Robinson, seconded by Lambert that said damage claim be referred to the Staff for study and recommendation: carried, Brown, Lambert,Lar- ;'f} son, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. • Mrs: Munson, representing.the N.Y.C. program; referred to a letter sent to the City Manager regarding their program of sponsoring 50 boys and girls in finding jobs, who have no oppor- =: tunity to get jobs. City Manager Smith explained that there had not been time to get this information to the Council, and also another program has been•offered for consideration of • the City Council by the University of Washington, where the Federal Government pays 90 per cent of the cost, and that both programs would be given consideration and she would be noti- fied of the Council's decision. • 0 • Councilman .Lynch stated that it had been brought to the attention of the Council members • that the North Cascade Study Report of all Water Shed area includes information concerning future development of areas included in Yakima's watershed. He indicated that this is of considerable interest to the City and that the City should obtain all available information on the subject. It was MOVED by Lynch, seconded by Lambert that the staff be allowed to write a letter to.the Agency in charge, stating that the City concerned-with future development of the area since it involves the City water shed: carried, Brown, Lambert, Larson and. Lynch voting aye by voice vote. Robinson voting no by voice vote. Brazier and • Kurbitz absent. • City Manager Smith requested permission for Puchasing Agent., Kermit Smith, to attend the combined meeting of the Pacific Northwest Buyers' Association Convention and the Western • Conference of Purchasing Agents at Vancouver, B. C.; from March 23rd to 26th, 1966, at an • approximate cost of $75.00. It was MOVED by Lambert, seconded by Robinson that permission • be granted for Kermit Smith to attend said.meeting, with expenses paid: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent.
