The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. The Invocation was given by Councilman Lynch. • The minutes of the regular meeting of January 17, 1966, having been duly certified accurate by two councilmen and no one present wishing to have said; :mi.nutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time set for the continuation on the Hearing on a General Plan for the City of Yakima and the Readoption of the existing Zoning Ordinance, Mayor Larson opened the • meeting for discussion. Mr. V. 0. Nichoson, Attorney, spoke again on behalf of the Union • Pacific. Railroad Company and the Yakima Valley Transportation Company, stating that the Railroad Company. and Y.V.T. had studied the General Plan carefully and are requesting that the City Council strike from the General Plan the following: Page 7, lines 21 to 24 in- elusive; Page 10, the first seven lines; Page 19, the last three lines; and Page 20, the first six.lines. .These excerpts refer to removal of railroad tracks, discouraging Industry . from locating near YVT tracks, etc. If these passages are removed from the General Plan, then the Railroad will favor the General Plan as proposed. Mr. Ernest Falk, representing the shippers, concurred with the Railroad in the deletion of excerpts from the Gen- . eral Plan, and stated that.as far as the fruit industry is concerned, it is important to •Yakima to have the continuation of the YVT line. The Council members assured the represen- tatives of the railroad that their suggestions would be studied and considered. Mr. Floyd • Paxton, President of the Committee of 1000 of Yakima, was present and read and filed with the Mayor, a letter from the Committee of 1000 stating their opinions and suggestions on the adoption of the General Plan, and on.federally financed and federally controlled "urban renewal". He also read an article written by Margaret Shott of Olympia, Washington, re- garding her opinion as to what the approval of .a comprehensive plan can mean to the citizens of any City in the State of Washington. Mr. Don Tait was again present and pointed out the many parts of the General Plan with which he was not in agreement, but did not offer specific suggestions for improvement. He did suggest all references to Federal Urban Re- newal be deleted from the plan as he is against all zoning and urban renewal. Mr. Tait does not live within the City Limits. Councilmen spoke at various times in answer to Mr. Tait, Councilman Robinson explained the process of zoning and annexation. Councilman Lambert indicated she did not wish to comment on Mr. Tait's suggestions at this meeting, • but assured him that council members will take into consideration his remarks and give it more thought and study. Mr. Rudy Gast, Planning Director, discussed matters of annexation and zoning in connection with the General Plan. Councilman Robinson indicated that the council members will study all suggestions for changes in the General Plan and will no doubt have suggestions of their own. It was brought to the attention of the council members that Mrs. Konda and Mrs. Lane, interested citizens, had been present, but had to leave be- fore Mr. Tait was through speaking. After discussion as to further proceedings, it was MOVED by Kurbitz, seconded by Brazier that the.Hearing on a General Plan for the City of Yakima, be continued for two weeks to February 7, 1966: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch. and Robinson voting aye by voice vote. • A Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on January 21, 1966 by Fred Hammerstad for United Builders :; Inc., for property located between Tieton Drive and Nob. Hill Boulevard, and west of 48th Avenue, and Mr. • Hammerstad being present at this meeting, it was MOVED by Lambert, seconded by Brown, that iqa, . this date, January 24, 1966, be set as the time of meeting with the initiating party: /q carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Mr. Fred Hammerstad,•Vice President of United Builders, Inc., having stated to the Council that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was MOVED by Robinson, seconded by Lynch that the annexation proposed by said party be accepted by the City of Yakima and that the area to be annexed be required to • assume its share of the City's existing indebtedness: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. It-was MOVED by Brown, seconded'by Lambert that the Ordinance prohibiting the sale or dis- tribution of obscene literature and amending the Yakima Municipal Code, be passed as read. Mr. Mauno Saari of the American Civil Liberty Union group suggested action on the said Ordinance be postponed until it can be studied further by them. Reverend Turner, Minister of the Unitarian Church and a member of the same group, discussed the problem of passing such an ordinance. • This group believes such an ordinance may lead to censoring good literature in the schools. Who decides what is decent literature and what is obscene, are some questions that were raised. Attorney Fred Andrews explained that there is already an ordinance in the City of Yakima Municipal Code, but that the Committee for Decent Litera- ture, Yakima Chapter, has requested that the existing Section 6.04.4$5 be amended so' as to comply with the State Code, as the language of the existing City Ordinance is cumbersome and outmoded, and not as helpful as it could be to that Committee in its efforts to prevent the widespread distribution of obscene literature in Yakima, particularly to minors. Councilman Brazier also suggested that action on this Ordinance be postponed so that more study might be given to it. After due discussion it was MOVED by Robinson, seconded by Brazier that action on the Ordinance prohibiting sale or distribution of obscene literature and amending the Yakima Municipal Code be postponed for one week, until the next meeting of the Council on January 31, 1966: oarried,' Brazier, Brown, Kurbitz, Lambert, Larson, Lynch • and Robinson voting aye by voice vote. It was MOVED by Lynch, seconded by Brown that Resolution No. D -901 authorizing the purchase . of copper tubing without calling for bids, be passed as read: carried, Brazier,. Brown, = Kurbitz, Lambert Lynch and Robinson voting aye on roll call. City Manager Smith explained that no advance bids are available from suppliers because of a shortage of copper tubing due to federal government requirements, and it- appears that such shortage will exist throughout the current year. Knobel and Richard A. Stiles, M.D., in connection with Petition No..431 requesting rezone of property located at 211, 213 and 215 N. Crescent Drive, it was MOVED by Robinson, seconded by Lynch that February 21, 1966 'be: set as the date of hearing on said Appeal: carried, Brazier, Broom, Kurbitz, Lambert, Lar- Son, Lynch and Robinson voting aye by voice vote. A Damage Claim having 'been filed with the City Clerk on January 17, 1966 by Ray L. White, 1$05 Hartford Road, for damages to his car resulting from a man hole cover flipping. against his car while he was travel :i.ng on the City streets, it was MOVED by Lynch, seconded by Robinson that said damage claim be referred•to the Staff for study and recommendation: . carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and' Robinson voting aye by voice vote. • An Application for water hookup outside the city, having been filed with the City Clerk by Frank Rosetti, for property located on - the south side of River Road, between 34th and Power House Road, it was MOVED by. Robinson, seconded by Brazier that said application be accepted and the staff process the necessary agreement for this hookup: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Robinson voting. aye by voice vote. Lynch voting No by voice vote. Mr. Rosetti being present, indicated he is willing to sign the outside hookup - agreement. • .Mr. Fred Hammerstad, representing. United Builders, Inc., having made three applications for • sewer connections outside the City, for property located West of 16th Avenue and North of King Street, and indicating they are willing to sign the outside hookup agreement and are in favor of annexing to the City, it was MOVED by Brazier, seconded by Kurbitz that said - applications be accepted and the staff process the necessary agreements for these hookups: .carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson " voting aye by voice vote. • City Manager Smith •recommended that George Mullins, .Judge of the •Municipal Court, be granted permission to attend the. Western Regional Traffic Court Conference. at Los Angeles, California on January 31 - February 4, 1966, stating that the total cost will be approxi- mately $350. Mr. Mullins has requested $100 from the County. It was MOVED by Kurbitz, seconded by Robinson that authorization be given to I`-lr. Mullins for said request with ex penses of approximately $250 paid: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting•aye by voice vote. • City Manager Smith recommended on behalf of himself and Chief Pete Moore, that Rothe & Rothe, Architects, be authorized to do the architectural work in connection with•the de- sign for. the Fire Station at the Airport. After discussion, it was MOVED by Brazier, seconded by Robinson that Rothe & Rothe,.
