Councilman Kurbitz absent. MOVED by Robinson, seconded by Lynch that Councilma Kurbitz be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and, Robinson voting aye by voice vote. II . The Invocation was given by Councilman Brown. The minutes of the regular meeting of December 13., 1965, having been duly certified accuratt by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . In accordance with action taken by the City Council at their regular meeting on December 13', 1965, it was MOVED by Lambert, seconded by Brown, that Resolution No. D -$91, fixing the data• of hearing on Petition No. 427, as filed by Marguerite and Will J. Hackett, requesting the vacation of a portion of Hamm Avenue, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -$91, A RESOLUTION fixing the time and place for hearing on vacation of street. In accordance with action taken by the City Council at their regular meeting on December 13, 1965, it was MOVED by Lynch, seconded by Lambert, that Resolution No. D -$92,- fixing the dat: of hearing on Petition No. 429, as filed by Monarch Station, requesting the vacation of a portion of S. llth Avenue, be passed as read:. carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -$92, A RESOLUTION fixing the time for hearing on petition for vacation of street. Petition #436, having been filed with the City Clerk on December 17, 1965, by Erma Frye and Others, requesting rezone of property situated between N. 5th Avenue and N. 6th Avenue and "B" Street, it was MOVED by Robinson, seconded by Lambert, that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson, voting aye by voice vote. Kurbitz absent. MOVED by Robinson, seconded by Brown that Ordinance No. 752 authorizing condemnation proceedings in the acquisition of property for the widening and improving of the intersection of South 40th Avenue and Tieton Drive, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. 752, AN ORDINANCE authorizing and directing the City Attorney of the City of Yakima to institute and prosecute legal proceedings for the condemnation and acquisition of real property for the widening and improving of the intersection of South 40th Avenue and Tieton Drive, and the installation of curbs, gutters, sidewalks, drainage facilities and public utility facilities related thereto; providing for the condemnation and taking of suc real property and declaring the condemnation and taking thereof to be necessary for a public use required by the public interests; and directing that compensation for such taking be paid from the Arterial Street Fund of the City of Yakima. MOVED by Lynch, seconded by Lambert that Ordinance No. 755 fixing the time of delinquency and prescribing Installment Notes for the payment of the unpaid portion of L.I.D. ORDINANCE NO. 755, AN ORDINANCE, fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District. No. 929, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. MOVED by Brazier, seconded by Brown that Ordinance No. 756 fixing the time of delinquency and prescribing Installment Notes for the payment of the unpaid portion of L.I.D. No. 931, Grant Street Domestic Water District, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. 756, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 931, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. Kurbitz absent. RESOLUTION NO. D -893, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to apply for federal aid to construct an airport fire station. MOVED by Brazier, seconded by Lambert that Resolution No. D -$94 authorizing the City Attorney to commence legal action against Richard Baxter, doing business as Tri --B- Salvage, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson.voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -894, A RESOLUTION authorizing and directing the City Attorney of the City of Yakima to commence legal action against Richard Baxter, doing business as Tri -B- Salvage. Mr. Seipp, being present and asking for a report on the percentage of protests against the McClure Sidewalk L.I.D., Public Works Director John Mayo, reported the percentage of pro- tests had gone up from .last week's figure -of 50.7% to 51.0 %. The deadline for turning in protests or removing names from petitions, is December 22, 1965. In answer to Councilman Brazier's question as to the percentage of protests, with the removal of that portion of 20th and 24th Avenues already having sidewalks in front of their homes, John Mayo indicated • the percentage of protests is slightly over 49 %and under 50%, figured on this basis. Mr. Seipp asked if this portion of the L.I.D. was going to be removed and the L.I.D. re- figured and Mr. Mayo indicated it would be up to the City Council at the next meeting on December 27, 1965, when all figures are processed. • The following .bids having been received on this date and considered by a Bid Board for the purchase of the Old City Hall owned by the City of Yakima, located at 27 North Front Street, Yakima, Washington: • Elwood E. Miller $ 10,100 • • Lloyd Hammerstad $ 5,100 . • and the Bid Board recommending that the City Council accept the bid of Elwood E.• Miller, it was MOVED by Brazier, seconded by Robinson that the City Council accept the bid of Elwood E. Miller of 810,100 for the purchase of the Old City Hall: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting by voice vote. Kurbitz absent. (No bid summary received) City Manager Smith referred to a letter from the employees' committee on medical insurance, that recommended changing the City employees' insurance carrier from Aetna Insurance Company to Blue Cross. They reported there would be some increases in rates with the present carrier and the committee has investigated several Insurance Companies, and of the 12 employee members of the committee, ten voted for changing to Blue Cross and two abstained from voting. Mr. Smith indicated that the Staff would like, to recommend that the City Council give authorization for the change to the Blue Cross and authorize the amending of the Yakima Municipal Code. In answer to questions from the City Council as to the two • not voting for this change, Al Ray, chairman of the committee, stated that the two members were froth the Fire Department and they are interested in having maternity benefits included in the plan. He further explained that the Blue Cross representative is trying to work out such a plan for the fire department only. It was MOVED by Brazier, seconded by Lynch that an Ordinance be prepared according to the staff recommendation.and authorization be given • to execute a contract with Blue Cross for City employees' medical -and life insurance, and to amend the Yakima Municipal Code: carried, Brazier, Brown, Lambert, Larson, Lynch and • Robinson voting aye by voice vote.
