!'The City Council Met in regular session, Mayor Larson presiding, Councilmen Kurbitz, Lam-
bert, Lynch and Robinson, City Manager Smith, and City Attorney Andrews present on roll
call. It was MOVED by Robinson, seconded by Lynch that Councilmen Brown and Brazier be ex-
cused from this meeting: carried, Kurbitz, Lambert; Larson, Lynch and Robinson voting aye
by voice vote. (Brazier present after 4:00 P.M.) ..
The Invocation was given by Councilman Lambert.

The minutes of the regular meeting of November 29, 1965, having been duly certified accurat:
by two Councilmen and no one present wishing to have said minutes read publicly, Mayor
• Larson declared said minutes approved as recorded.
In accordance with action taken by the City Council at the regular meeting .of November 29,
1965, on the matter of Petition No. 425, as filed by Trontech, Inc., praying for the
annexation of property located North of Wide Hollow Creek and West of South 24th Avenue, it
was MOVED by Lambert, seconded by Lynch that Ordinance No. 749 providing for said annexatio
be passed as read: carried, Kurbitz, Lambert, Larson,. Lynch. and Robinson voting aye on roll
call. Brown and Brazier absent..

ORDINANCE NO. 749, AN ORDINANCE providing for the annexation.by the City of Yakima of cer-
tain property contiguous to the City of Yakima and zoning said property.
A Notice of Intention to Commence Annexation Proceedings, having been filed with the City
rClerk on December 6, 1965, by Orman E. Arnold and others, praying for annexation of propert
f located south of Mead Avenue and west of Voelker, and Mr. Arnold and Arthur J. Thompson
O being present, it was MOVED by Robinson, seconded by Lambert that this date, December 6,

Orman E. Arnold and Arthur J. Thompson indicating that they are willing to assume their

■ that the annexation proposed by Orman E. Arnold and others be accepted by the City of
Yakima and that the area to be annexed be required to assume its share of the City's exist- .

Mr. E. N. Altman of West Coast Airlines, being present, it was MOVED by Robinson, seconded
by Lynch that the City Council depart from the Agenda to take up the matter of Resolutions
regarding West Coast Airlines: carried, Kurbitz, Lambert, Larson, Lynch and Robinson voting
•aye by voice vote. Brazier and Brown absent.
It was MOVED by Lynch, seconded by Lambert that Resolution No. D -$$4 authorizing the execu-
tion of an Addendum to Lease Agreement with West Coast Airlines, Inc., be passed as read:.
carried, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by roll call. Brazier II-
and Brown absent. City Manager Smith explained the Addendum to the Lease Agreement, was •
added to take care of the changeover of West Coast Airlines serving Yakima further when
Northwest Airlines, Inc., discontinues its service to and.from the Yakima Municipal Airport
as indicated in a letter from E. V. Folkestad of. Northwest Airlines, Inc.
RESOLUTION NO. D -$$4, A RESOLUTION authorizing and directing the City Manager and City Cler
to execute an ADDENDUM TO LEASE AGREEMENT with West Coast.Airlines, Inc.
It was MOVED by Lynch, seconded by Robinson, that Resolution No. D -$$5 declaring the posi-
tion of the City Council regarding an application by West Coast Airlines, Inc. to the Civil
Aeronautics Board, be passed as read: carried, Kurbitz, Lambert, Larson, Lynch and Robinson ,
voting aye by roll call. Brazier and Brown absent... In answering Councilman Kurbitz's
question as to whether there will be a Coach rate, Mr. Altman stated there would be a one
class fare, which would be between the First class and Coach fare and indicated the rates
could possibly be lowered later on:

RESOLUTION NO. D -8$5, A RESOLUTION declaring the position of the Yakima City Council regard-
ing an application by West -Coast Airlines, Inc. to the Civil Aeronautics Board.
MOVED by Robinson, seconded by Lambert that Ordinance No. 750 relating to irrigation main-
tenance, providing for the preparation of a preliminary assessment roll and amending the .
Municipal Code, be passed as read: carried, Kurbitz, Lambert, Larson, Lynch and Robinson
voting aye on roll call. Brazier and Brown absent. City Manager Smith explained this
Ordinance provides for extending the date for. • completion of the assessment rolls for the
1966 assessment year from December 15,1965 to February 1, 1966. .
ORDINANCE NO. 750, AN ORDINANCE relating to irrigation system maintenance; providing for,
the preparation of a preliminary assessment roll therefore; amending Section 7.24.030 of
the City of-Yakima Municipal Code; and declaring an emergency. .
MOVED by Lambert, seconded by Robinson, that Ordinance No. 751 creating a Traffic Advisory
Board and amending the Yakima Municipal Code, be passed as read. In answer to Councilman .
Lynch's questions about non -city members on this Board, Manager Smith stated there are five
City members and four non -City members. Lynch was not in favor of non -City people advising •
on City traffic problems and also objected to the word coordinate in Section 5 of. this .
Ordinance, about the Advisory Board coordinating all traffic activities and suggested this
word be changed to consider. Councilman Lambert approved of having both City and non -City •
people on this Board as it is an advisory board to make suggestions and not able to pass
any legislation. Councilman Robinson also approved of non -City and City members being on
this Advisory'Board as. it is a study committee to plan and coordinate ideas. It was MOVED
by Robinson, seconded by Lynch that Ordinance No. 751 as read, be amended with the following,
changes: the word coordinate be changed to consider in Section 5, Page 2, and in Section 1,
. insert the word Yakima before "Chamber of Commerce ": carried, Kurbitz, Lambert, Larson,
Lynch and Robinson voting aye.by voice vote. Brazier and Brown absent. Mayor Larson then
called for the vote on the original'motion to pass Ordinance.No. 751 as amended: carried,
Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brown absent. Brazier
present at 4:00 for balance of meeting, but preferring not to vote as he was not present for
all of the discussion on this Ordinance.
ORDINANCE NO. 751, AN ORDINAINICE creating a Traffic Advisory Board; designating members and
officers of said Board; prescribing the duties.of said Board; and amending Sections 1.67.01C,
.020, .030, .040, and .050, all of the City of Yakima Municipal Code.

located south of Lenox Avenue, including the railroad tracks, east to South 1st Street,
and Mr. Rose being present, it was MOVED by Robinson, seconded by Lynch that this date,
.December 6, 1965, be set as the time for a meeting with the initiating party: carried,
Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brown
absent. Mr. Rose indicating that he is willing to assume his share of the City's existing
indebtedness, it was MOVED Robinson, seconded by Lynch that the annexation proposed by •
Bruce R. Rose be accepted by the City of Yakima and that the area to be annexed be required
to assume its share of the City's existing indebtedness: carried, Brazier, Kurbitz, Lambert •

MOVED by Lambert, seconded by. Robinson that Resolution No. D -556 authorizing and directing
sale of surplus crane, accessories and tractor, be passed as read: carried, Brazier, Kur-
bitz) Lambert, Larson, Lynch and Robinson voting aye on roll call. Brown absent. Manager
Smith indicated that money from this sale would be used to acquire some snow removal equip-
ment:

' RESOLUTION NO. D -556, A RESOLUTION authorizing and directing the sale of surplus personal
property. •

MOVED by Lambert, seconded by Lynch that Resolution No. D -557 authorizing the execution of
an Addendum to a Lease Modification Agreement with James A. Sellers and repealing Resolutio
No. D -579, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinsca
voting aye on roll call. Brown absent. City Attorney Andrews explained that this addendum
is a correction in the Lease Modification Agreement as requested by Mr. Sellers, so that •
this property will be returned to him if the proposed Fire Station is not constructed as .
planned. .
RESOLUTION NO.. D -557, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a Lease Modification Agreement, and addendum there-
to with James A. Sellers; and repealing Resolution No. D -579, entitled "A Resolution
authorizing and directing the .City Manager and City Clerk of the City of Yakima to execute
a Lease Modification Agreement with James A. Sellers ", adopted November 22, 1965.
. In accordance with action taken by the City Council at the regular meeting of November 29,
1965 and the Planning Director recommending that the Outside Connection, as filed by
Raymond L. Pinkal, be allowed, it was MOVED by Robinson, seconded by Lambert that said
application be approved on the condition that all property be included in the outside
hookup agreement:. carried, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice
vote. Brazier voting no, stating he is not 'sufficiently convinced in.the affirmative to
vote. yes. Discussion indicated this property may not be a part of an annexation for some
time. The City Council discussed policies regarding outside hookups - just how far are we
going to go .in approving the ones that are not contiguous to the City or may not be annexed
for a longtime. Since the cost is all borne by the person desiring the hookup and is not
costing the City anything, and the property might be annexed sooner or later, the majority
of the Council felt it would be 'permissible to approve such applications.

it was MOVED by Lambert, seconded by Lynch that the report of the City Treasurer dated
November 30, 1965, regarding the investments of the City of Yakima, be accepted and approv-
ed: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice
vote. Brown absent.
John Mayo, Public Works Director, reported that last week, the percentage of protests on
the McClure Sidewalk L.I.D. #948, was 50.7%, and as of this week to date, there are 50.6%
protests.
City Attorney Andrews reported on his meetings and correspondence with a Harry McMurray,
whose property outside the City Limits was flooded as a result of overflow from the Cowiche
Creek going through his property. Mr. McMurray has written to the railroad, who he believes
is chiefly responsible for this situation, because the new railroad bridge was placed at a
wrong angle and catches all the trash, causing his property to be flooded. • The railroad
has not answered his letter, and he has written to many others including the City of Yakima,
Yakima County Commissioners and the State Highway Department. He has conferred with City
Attorney Andrews, who asked the Council for suggestions on helping this man. City Attorney
Andrews mentioned Mr. McMurray had threatened to take materials from the dikes to prevent
his land from again being flooded if he doesn't obtain results from his notifications.
Councilman Robinson indicated that Mr. McMurray should be warned against removing materials
from the dikes and that he should seek help through his own Attorney. Councilman Lynch
indicated the'City Council should try to help Mr. McMurray in some way, but legally the
City can't-help him since he is outside the City Limits. After much discussion, it was
MOVED by Robinson, seconded by Kurbitz, that further consideration of this matter be post -,
poned: carried, Brazier, Kurbitz, Lambert, Larson', Lynch and Robinson voting aye by voice
vote. Brown absent.
