HomeMy WebLinkAbout11/29/1965 Business Meeting 1 ®1. - November 29, 1965 The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews, present on roll call. The Invocation was given by Councilman Brazier. lir The minutes of the regular meeting of November 22, 1965, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. An Ordinance appropriating $2,500 from the Yakima Municipal Airport Fund to the 1965 Budget for same fund, for the purpose of paying for the work done in repairing the Airport ramp, having been read in its entirety at the regular meeting of November 22, 1965, and being read by Title only at this meeting, it was MOVED by Lynch; seconded by Robinson that Ordinance No. 745 providing for said appropriation be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 745, AN ORDINANCE appropriating the amount of $2,500 from unappropriated monies in the Municipal Airport Fund to Account 340, Stationary Equipment, Land, Building and Plant -- Maintenance and Operation, of the Maintenance and Operation Classification, in the 1965 appropriation for 390 - Municipal Airport. . An Ordinance appropriating $1,200 from the Irrigation Fund to the 1965 Budget for same fund, for the purpose of paying for hiring extra help in connection with new procedures being established for the collection of irrigation maintenance, having been read in its entirety at the regular meeting of November 22, 1965, and being read by Title only at this meeting, it was MOVED by Lambert, seconded by Brown that Ordinance No. 746 providing for said appropriation be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 746, AN ORDINANCE appropriating the amount of $1,200 from unappropriated monies in the Irrigation Fund to Account 020, Part Time, Temporary, Overtime, and Special Assignment, of the Salaries and Wages Classification, in the 1965 appropriation for 510 - Irrigation Fund. This being theNtime fixed for the hearing on the Appeal from the Planning Commission's decision on Petition No. 422, as filed by Harry E. Borland, requesting rezone of property at the Southwest corner of Second Avenue and Nob Hill Boulevard, it was MOVED by Robinson, seconded by Lambert that Resolution No. D -$$l, being a Resolution affirming the action of the Planning Commission in denying said application for rezone, be passed as read: carried, Brown, Lambert, Larson and Robinson voting aye on roll call. Brazier and Kurbitz voting nay on roll call. Lynch not voting. Attorney John Moore, speaking for his client, Mr. Borland, stated he could not understand the reason for the decision of the Planning Commis- sion denying this rezone request, since there were, no protests from property owners in the area, and one -half of the lot in question is already zoned for business and the site is not prime residential area. He requested that the City Council change their decision to affirm the action of the Planning Commission in denying said application for rezone. Mrs. Harvey Anderson, 1203 S. 3rd. Avenue, a property owner in this vicinity, was present and stated she was not objecting to the rezoning, but to the use of the property as a used car lot. Councilman Lambert explained that in supporting the Planning Commission's decision, she is not is favor of a B -3 use in an R -2 area. Councilman Brazier stated this is more than just a zoning problem, indicating he is in favor of discouraging future strip development, and thinks a study should be made of the future of Nob Hill Boulevard. In answer to Councilman Brown's question as to what uses could be made of the frontal strip, Rudy Gast, Planning Director suggested a duplex or triplex. Councilman Robinson indicated that he concurred with the Planning Commission's denial in this matter, but suggested that the Planning Commission study such, situations more thoroughly and make suggestions as . to the best uses of the land to the property owners requesting rezone. Rudy Gast agreed that the Planning Commission should be prepared to suggest alternatives and do try to do this as much as possible. He explained, however, in this rezone request that the Planning Commission's decision to deny was based on their opinion that Nob Hill Boulevard is an Arterial and is suffering from traffic congestion and added that traffic generated businesses will add to the problem. Councilman Kurbitz, in voting against the Resolution, said he appreciated the problems of the neighbors adjoining this property, but felt it would be more advantageous to have this zoned so it can be utilized rather than stand vacant, as he does not believe anyone will build on it as it is now zoned, He stated also, that probably a good portion: of Lenox Avenue will be used for business some time before too long, and doesn't think a used car lot will generate a lot of traffic. RESOLUTION NO. D -$$l, A RESOLUTION affirming the action of the Planning Commission in deny- ing the application of Harry E. Borland to rezone property situated at the Southwest corner of Second Avenue and Nob Hill Boulevard in the City of Yakima, Washington, from R -2, Two - Family Zone, to B -3, General Business Zone. . This being the time for the hearing on Petition No. 425, as filed by Trontech, Inc., prayin: for the annexation of property located North of Wide Hollow Creek and West of South 24th Avenue, and the Review Board not being able to hear this matter until December 2, 1965, it was MOVED by Lambert, seconded by Robinson that said hearing be continued to the regular meeting of December 6, 1965: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. . MOVED by Lambert, seconded by Brown that Ordinance No. 747 relating to the domestic water services and creating a new chapter in the Yakima Municipal Code, be passed as read: carrie., Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. City Manager Smith indicated this Ordinance will allow the transfer of water consumers from priv ate domestic water supply companies to the City of Yakima System. ORDINANCE NO. 747, AN ORDINANCE relating to the domestic water services of the City of Yakima; enabling the City Council of the City of Yakima to authorize the transfer of water consumers from private domestic water supply companies to the municipal domestic water system; restricting such transfers; and creating a new chapter, to follow existing Chapter 7.76, of the City of Yakima Municipal Code, said new chapter to be numbered and entitled "Chapter 7.78 TRANSFER OF DOMESTIC WATER SERVICE FROM PRIVATE DOMESTIC WATER SUPPLY COMPANIES TO THE CITY OF YAKIMA SYSTEM ". - - . MOVED by Robinson, - seconded by Brown that Ordinance No. 74$ relating to the classification 1 plan and salary schedule for City employees for 1966 and amending the Yakima Municipal Code be passed as read. City Manager Smith explained the revised pay schedule covers wage in- . . .creases provided in the 1966 budget and also revises regulations covering reimbursements to• ' City for travel, lodging and .meals when out. of town on City business. He mention ed there should be a correction in the Ordinance on page 3, Section 4,(b), 4th step should be changed to 5th_ step. It was also suggested that a. correction should be made on the last • page in Section 7, 2.24.010, changing the date of the 1st day of January, to read 31st day of December. It was MOVED by Robinson, seconded by Brown that Ordinance No. 74$ be amended . in accordance with the suggested corrections on page Section 4,(b) and the last page, Section 7, 2:24.010: carried, Brazier, Brown, Lambert; Larson, Lynch -and Robinson voting aye by voice vote. Kurbitz not voting.. Councilman Lynch questioned the payment of cloth -. • ing allowance to Police detectives and Patrolmen assigned to the Detective•Division and not . wearing a uniform in the performance of their duties, and also payment of twenty dollars • per month extra to Patrolmen who supervise 'jail meal planning, food purchasing, etc., and objected to this manner of paying them. He indicated he thought it would be better to place a specific title on these positions and allow a- specific pay range for them. Mayor Larson called for the vote on the original motion to pass Ordinance No. 74$ as amended: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. .: Kurbitz disqualifying himself because he-had not studied the Ordinance and did not feel qualified to vote. Lynch voting aye, with certain objections raised. . - ' ORDINANCE NO. 74$, AN ORDINANCE relating to personnel employed by the City of Yakima; adopting a general policy for pay steps within salary.ranges; providing for reimbursement of certain expenditures made by City officers and employees; authorizing special assignment pay. for certain City employees; adopting a classification plan, a schedule of salary ranges, . and a longevity plan for City employees; amending Sections 2.20.040, 2.20.0$5, 2.20.0$6, 2.20.0$$, 2.20.100, 2.20.110, 2.24.010; and repealing 2.24.030, and Chapter 2.12, all of the City of Yakima Municipal .Code. • MOVED by Lambert, seconded by Brown that Resolution.No. D -$$2 declaring the intention of. the City.Council to readopt the existing Zoning Code, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call.- City Attorney Andrews explained that this action must be taken in order to insure the validity of our . Zoning ordinances after the General Plan is in full force and effect. Discussion indicated the Planning Commission will hold a public hearing on the proposed readoption of said Title 12, Zoning, of the Municipal Code,on January 7, 1965, will publish the necessary legal notice for public hearing, and make its recommendations to the Council. RESOLUTION NO. D -$$2, A RESOLUTION declaring the-intention of the Yakima City Council to readopt Title 12, "ZONING ", of the City of Yakima Municipal Code. _, MOVED by Robinson, seconded by Lambert that Resolution No. D -$$3 authorizing the sale of - the old City Hall, be passed as read: carried, Brazier, Brown, Lambert, Larson,. Lynch Robinson voting aye on roll call. Kurbitz voting nay on ro 11 call. Discussion indicated that an offer has been made to buy this property. • Councilman Kurbitz questioned the ad- - • • visability of selling this piece of City property. RESOLUTION NO. D -$$3, A RESOLUTION authorizing the sale of real property owned by the City of Yakima. • . . City Manager Smith reported a study had been made of the proposed upgrading of our lighting - • system and recommended to the City Council that authorization be. given to proceed with the installation .of approximately 104 installations, replacing approximately 13 existing lights, and transfer of approximately $3$00 in the 1966 Budget from Account No. 520, the.street . • fund budget, to account No. 290,.M & 0 classification of the street fund budget. It was MOVED by Robinson, seconded by Lambert that authorization be given to transfer.said funds and to upgrade the City's lighting system, in accordance with the Manager, George Smith, and Public Works Director, John recommendation: carried, Brazier, Brown, Kurbitz, . Lambert, Larson; Lynch and Robinson voting aye by voice. vote. , • Public Works Director,John.Mayo, discussed with members of the Council the matter of a • letter_ from Max Vincent'referring to discussion at the. previous Council meeting on Novem- ber 22, 1965, regarding property owners on 20th and 24th Avenues:, being included in the. . . McClure Sidewalk L.I.D., since they already have sidewalks in front of their homes. Mr. Vincent suggested that perhaps an expression from the Council would . be - helpful in explain- ing to these property owners how this is going to be handled. There was a suggestion that since some property owners on 20th Avenue had paid for their sidewalks on an earlier L.I.D. that they be given full credit, and the assessments for the property owners on . 24th Avenue, ' with sidewalks already in and paid for,. be reduced by one -half, since they have .not paid sidewalk assessments previously. It was MOVED by Robinson, seconded by Lambert, that for the purpose of answering this request, the property owners on 20th and 24th Avenues having sidewalks in front of their homes already in and paid for, be assurred that when the Counci . sits as a Board of Equalization at the Confirmation of this District, the entire proposed sidewalk'assessment will be waived for these property owners: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. There was discussion on how this would affect the percentage of protests. Mayor Larson indicated he would not want this action to be construed as a means to get rid of. the protests against the proposed L.I.D., but it had been an oversight in the first place in not considering these property owners with sidewalks already in and paid for, when the estimated assessments were figured.
