November. 15, 1965 The City Council met in regular session, Assistant Mayor Brazier presiding, Councilmen Brown, Kurbitz, Lambert and Robinson, City Manager Smith and City Attorney Andrews, present on roll call. It was MOVED by Robinson, seconded by Kurbitz that Mayor Larson and Council- ' man Lynch be excused from this meeting; carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of November 8, 1965, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Assistant Mayor Brazier declared said minutes approved as recorded. An Ordinance appropriating $8,860 from Unappropriated monies in the Municipal Garbage Fund to the 1965 Budget for the same fund, having been read in its entirety at the regular meet- ing of November 8, 1965, and being read by Title only at this meeting, it was MOVED by Lambert, seconded by Brown that Ordinance No. 739 providing for said appropriation for the purpose of paying equipment rental rates to the City Garage for the balance of the current year, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote. Larson and Lynch absent. ORDINANCE NO. 739, AN ORDINANCE appropriating the amount of $8,860 from unappropriated monies in the Municipal Garbage Fund to Account 320, Rentals, of the Maintenance and Operation. Classification, in the 1965 appropriation for 320 - Municipal Garbage. This being the time fixed for the hearing on Resolution No. D -873, being a Resolution of Intention to create a Local Improvement District to improve property by constructing concrete sidewalks in the vicinity of the McClure School, and there being protests in writing, as well as approximately 140 persons present wishing to be heard on this matter, Councilman Robinson suggested the Council not make a motion to pass the Ordinance at this time, although an Ordinance providing for the creating of L.T.D. No. 948 was read. Assis- tant Mayor Brazier opened the meeting to hear those present wishing to speak for or against said improvement. John Mayo, Public Works Director, explained Local Improvement District procedures and also indicated that the streets to be included in this.. District had been selected by a committee of six McClure P.T.A. members, together with the City Engineering Staff and the City Attorney. There was much discussion for and against this proposed , Sidewalk District and many questions were asked regarding the forming of the proposed L.I.D. Seven persons asking questions regarding procedures and mechanics of the improve- ment, who decided where they should be placed, liability of the property owner in keeping the sidewalks clean, how the cost was figured, and other questions that were answered by the Council and John Mayo, Director of Public Works, were: Travis McCullough; Norman Mack, 702 S. 22nd Ave.; Ralph W. Cramer, 1002 S. 20th Ave.; Mrs. Gustave Hunziker,1212 S. 20th Ave.; Tom Mitzlaff, 1306 S. 21st.; Don Tate and John Makinson. Fourteen persons verbally protesting the forming of the Sidewalk L.I.D. at this meeting were: Richard McClusky, 1113 S. 20th Ave.; Marion S. Cline, 1110 S. 17th Ave.; A. J. Kraft, 1114 S. 16th Ave.; Minnie Bierly, 1119 S. 20th Ave.; A. F. Walker, S. 18th and Plath; Ray Baker, 1021 S. 20th Ave.; Francis Peck, 1405 S. 21st Ave.; Otto Brindamour, 1010 S. 23rd Ave.; James Rayner, Grant St.; Mr. Hanlow; Harry Huff; Brad Smith, Greenway off of 18th; Fred Hammerstad; and C.V. Lombard. Many of these protested because they felt the sidewalks were not needed, some because they had no children and felt they did not want to pay for something that would not benefit them. Others protested because they felt streets, curbs and gutters should be put in before sidewalks and many protested because they would have to share in the cost of sidewalks too far away. Some were not protesting the sidewalks, but were protesting the location. Those speaking for the forming of this L.I.D. were: Conrad Dumler, School Teacher at McClure School; Ellen Pearson, 2101 St. Helens St.; Peggy Suhm, 923 S. 25th Ave.; John Wikoff, 1014 S. 20th Ave.; Mrs. C. M. Gottleib, 711 S. 22nd Ave.; LeRoy Sebas- tian, 622 S. 22nd Ave.; Mrs. Arthur O'Neill, 809 S. 20th Ave.; Mrs. Don Moen, 1004 S. 25th Ave.; Mrs. Sebastian, 622 S. 22nd Ave.; Dr. F. A. Ditter, 708 S. 22nd Ave.; Ethel Albers, Bonnie Doone; and Max Vincent, who were interested in the safety factor for children and the aged, in going to and from school and the shopping area. Many felt it would increase property values and were interested in progress and improving the community. Judy Popp, asking the process of removing her name from a written protest, as she was not opposed to sidewalks but the location, was told she could do so in writing, and filing with the City Clerk. There being no further discussion for or against the forming of this L.I.D., Assistant Mayor Brazier concluded the public hearing. It was MOVED by Robinson, seconded by Lambert, that the matter of the hearing on Resolution No. D -873, to create an L.I.D. in the vicinity of the McClure School, be continued for one week: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye on roll call. Larson and Lynch absent. John Mayo indicated that at the present time there are some 40% written and filed protests. Robinson explained that the City Council's policy in these matters has been that if the protests amount to more than 50 %, they have dropped the proposed improvement, and that unless the protests do amount to more than 50 %, he will vote in favor of an Ordinance creating the L.I.D. Kurbitz stated that it has always been the policy of the Council to respect the wishes of the majority in the area. This being the time set for the hearing on the Assessment Roll for L.I.D. No. 934, North First Street Sanitary Sewer, and there being no protests in writing or otherwise, it was MOVED by Brown, seconded by Robinson that Ordinance No. 740 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye on roll call. Larson and Lynch absent. ORDINANCE NO. 740, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 934 as created and established by Ordinance No. 618 of the Ordinances of the City of Yakima. Petition No. 429, having been filed with the City Clerk on .November 12, 1965, by Monarch Stations, Inc., requesting vacation of a portion of South llth Avenue near Tieton Drive, it was MOVED by Lambert, seconded by Brown that said petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote. Larson and Lynch absent. In accordance with the request of Manager Smith, it was MOVED by Robinson, seconded.by Lambert that the Ordinance relating to public safety and morals and amending the Yakima Municipal Code be held over for one week and heard at the next regular meeting of the City Council on November 22, 1965: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote. November 15, 1965 MOVED by Brown, seconded by Robinson that Ordinance No. 741 fixing the time of delinquency and providing for the issuance of Installment Notes for the payment of the unpaid portion of L.I.D. No. 92$, Madera Heights, Schmidt's Uplands and L.K. Buchanan's Addition Sewer District, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye on roll call. Larson and Lynch absent. ORDINANCE NO. 741, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 92$, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. In accordance with the action taken by the City Council at their regular meeting on Novem- ber $, 1965, it was MOVED by Robinson, seconded by Kurbitz that Resolution No. D -$77 pledging the support of the Yakima City Council to the Yakima Area Industrial Committee of the Chamber of Commerce, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye on roll. call. Larson and Lynch absent. RESOLUTION NO. D -877, A. RESOLUTION pledging the support of the Yakima City Council to the Yakima Area Industrial Committee of the Chamber of Commerce in its program to develop industry in the Yakima Valley. An appeal, from the decision of the Planning Commission on Petition No. 422, as filed by Harry S. Borland requesting the rezone of certain real property located at the corner of second Avenue and West Lenox, having been filed with the City Clerk on November 10, 1965, it was MOVED by Robinson, seconded by Lambert that November 29, 1965 be set as the time for a hearing by the City Council on said matter, and that the City Clerk give notice of such hearing as required by law: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote. Larson and Lynch absent. City Manager Smith having received an application from Mr. Pinkal, for an Outside Utility Connection, it was MOVED by Robinson, seconded by Kurbitz that said request be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote. Larson and Lynch absent. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brown that we do now adjourn at the hour of 10 :15 P.M.: carried, Brazier, Brown, Kurbitz, Lambert and Robinson voting aye by voice vote.
