October 25, 1965
The City Council met in regular session, Mayor Larson presiding, Councilmen Brazier,Brown,
Kurbitz,, Lynch and Robinson, City Manager Smith and City Attorney Andrews, present on roll
call. MOVED by Rbbinson, seconded by Brown that Councilman Lambert be excused from this
meeting: carried, Brazier, Brown, Kurbitz, Larson, Lynch and Robinson voting aye by voice
vote.
The Invocation was given by Councilman Brazier.
The minutes of the regular meeting of October 1$, 1965, having been duly certified accurate
by two Councilmen and no one present wishing to have said minutes read publicly, Mayor
Larson delcared said minutes approved as recorded.
This being the time fixed for the hearing on Petition No. 419, as filed by Lumber and Saw-
mill Workers Local 2739, requesting rezone of property located at 712 N. 7th Street, from
R -3, Multiple Family Zone, to B -1, Modified Business Zone, and the Planning Commission
having recommended the rezone of said property, it was MOVED by Brown, seconded by Lynch
that Ordinance No. 72$ accepting the recommendation of the Planning Commission, be passed
as read: carried, Brazier, Brown, Kurbitz, Larson, Lynch and Robinson voting aye on roll
call. Lambert absent.
ORDINANCE NO. 72$, AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 712 North 7th Street, in the City of Yakima,
Washington, from R -3, Multiple Family Zone, to B -1, Modified Business Zone.
This being the time fixed for the hearing on Petition No. 405 as filed by A. A. Kauzlarich
and others praying for annexation of property located in the general area of Scenic Drive
and Romona.Road, it was MOVED by Brown, seconded by Robinson that Ordinance No. 729 pro-
viding for said annexation, be, passed as carried, Brazier, Brown, Kurbitz, Larson,
Lynch and Robinson voting aye on roll call. Lambert absent. Mr. Charles Erickson, a
property owner in this vicinity, who had written a letter to the Council previously, was
present and discussed matters of zoning of this area with the Council.
ORDINANCE NO. 729, AN ORDINANCE providing for the annexation by the City of Yakima of
certain property contiguous to the City of'Yakima and zoning the same as R -1, One- Family
Zone.
This being the time fixed for the hearing on Petition No. 415, as filed by William L.
Cawley and others praying for annexation of property located in the general area of 7th
Avenue and 8th Avenue, between Pierce Avenue and King Street, it was MOVED by Lynch,
seconded by Brazier that Ordinance No. 730 providing for said annexation, be passed as
read: carried, Brazier, Brown, Kurbitz, Larson, Lynch and Robinson voting aye on roll call.
Lambert absent. Mr. Cawley, being present, asked if his Motorcycle Repair Shop on his
property would make any difference in the zoning of this property. Discussion indicated
that this had not been brought out at the Planning Commission meeting. Mr. Rudy Gast,
Planning Director, indicated that since this shop was already on the property, it would be
a non- conforming use in the R -2 Zone and could not be enlarged or rebuilt in case of 60%
loss.
ORDINANCE NO. 730, AN ORDINANCE providing for the annexation by the City of Yakima of
certain property contiguous to the City of Yakima and zoning the same: as R -2, Two- Family
Zone. .
This being the time fixed for the hearing on Petition No. 420, as filed by Glascam Builders,
Inc. praying for annexation of property located in between S. 31st Avenue and S. 32nd
Avenue, north of Viola, it was MOVED by Robinson, seconded by Lynch that Ordinance No. 731
providing for said annexation, be passed as read: carried, Brazier, Brown, Kurbitz, Larson,
Lynch and Robinson voting aye on roll call. Lambert absent. Mr. Frank L. Glaspy, Jr.,
President of the Corporation, was present.
ORDINANCE NO. 731, AN ORDINANCE providing for the annexation by the City of Yakima of
certain property contiguous to the City of Yakima and zoning the same as R -1, One- Family
Zone.
This . being the time fixed for the hearing on the Assessment Roll for L.I.D. No. 933,
South 44th Avenue Sanitary Sewer, and there being no protests in writing or otherwise, it
was MOVED by Robinson, seconded by Brown that Ordinance No. 732 confirming said assessment
roll and every part thereof, be passed as read: carried, Brazier, Brown, Kurbitz, Larson,
Lynch and Robinson voting aye on roll call. Lambert absent. Mrs. Donald Springer, a
property owner in this vicinity was present and protested the payment of sewer maintenance
charges in excess of the minimum since she is not hooked onto the sewer and will not be
for some time due to the fact that they have a new septic tank, put in just prior to when
this L.I.D. was started. The Council agreed this is an unusual case, but this may be
governed by State Statute, and informed her that the staff will check into this and advise
her accordingly.
ORDINANCE NO. 732, AN ORDINANCE confirming the assessment • roll covering Local Improvement
District No. 933 as created and established by Ordinance No. 606 of the Ordinances of the
City of Yakima. .
A Notice of Intention to commence annexation proceedings having been filed with the Clerk
on October. 21, 1965, by Orman E. Arnold, for property South of Mead Avenue and West of
Ledwich Avenue, and Mr... Arnold not being present, it was MOVED by Robinson, seconded by
Brown, that the next regular.meeting of the Council on November 1, 1965, be set as the
time for a meeting with the initiating party, Orman E. Arnold, who signed the Notice of
Intention to Commence Annexation Proceedings dated October 21, 1965: carried, Brazier,
Brown, Kurbitz, Larson, Lynch and Robinson voting aye by voice vote. .Lambert absent.
MOVED by Robinson, seconded by Lynch that Resolution No. D -$73, a Resolution of Intention
to create a local improvement district to improve property by constructing concrete side-
walks in the vicinity of the McClure School, and fixing the time of hearing for November
15, 1965, be passed as read: carried, Brazier, Brown, Larson, Lynch and Robinson voting
aye on roll call. Lambert absent. Kurbitz temporarily absent.
RESOLUTION NO. D - $74, A RESOLUTION of intention to create a local improvement district.
October 25, 1965
In accordance with action taken by the City Council at the regular meeting of October 1$,
1965, City Manager Smith reported on the application of Edward A. Bannister to hook up to
a sewer outside the City Limits and recommended that said request for hook -up be granted
as this whole area lends itself to annexation and Mr. Bannister is agreeable to annexing
and will sign an outside agreement. It was MOVED by Kurbitz, seconded by Lynch, that the
Council concurs with Manager Smith.," and that this outside hookup agreement be granted:
carried, Brazier, Brown, Kurbitz, Larson, Lynch and Robinson voting aye by voice vote.
Lambert absent.`
City Manager Smith reported that some 200 people visited the Open House of the Sewage
Treatment Plant on Saturday and Sunday, October 23 and 24, 1965.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Lynch that we do now adjourn at the hour of 4:10 P.M.: carried, Brazier, Brown,
Kurbitz, Larson, Lynch and Robinson voting aye by voice vote. Lambert absent.
