Kurbitz, Lambert, and City Manager Smith and City Attorney Andrews, present on roll call. Robinson absent and excused. The Invocation was given by Councilman Brown. Ji This being the time fixed for the hearing on Resolution No. D -$6$, being a Resolution of Intention to create Local Improvement. District for construction of domestic water system serving property fronting on the west side of South First Street from Lenox, South $2$ feet, and there being no protests in writing or otherwise, it was MOVED by Brazier, seconded by Lambert that Ordinance No. 726 providing for said improvement and creating L.I.D. No. 947, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Robinson absent. Gene Johnson, property owner in this district, was present and spoke in favor of this improvement. ORDINANCE NO. 726, AN ORDINANCE providing for the improvement of certain property by con- structing the necessary mains, fire hydrants, valves and other appurtenances for the pur- pose of supplying water for domestic use and fire protection; establishing a Local Improve- ment District, providing for the method of payment thereof, and creating a special fund. A Notice of Intention to commence annexation proceedings having been filed with the City Clerk on October 15, 1965, by Jere Irwin, President of Trontech, Inc., for property located North of Wide Hollow Creek and West of 24th Avenue, and Doug Wilson, an Attorney, and Vice President of Trontech, Inc., being present at this meeting, it was MOVED by Lambert, seconded by Brazier, that this date, October 1$, 1965, be set as the time of meeting with the initiating party: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson absent. Doug Wilson, Vice President of Trontech, Inc., having stated to the Council that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was MOVED by Lambert, seconded by Brown, that the annexation proposed by said party, be accepted. by the City of Yakima, and that the area to be annexed be required to assume its share of the City's existing indebtedness: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. - Robinson absent. Mayor Larson and City'Attorney Andrews informed the Petitioner that he could file his petition at this meeting since the Corporation is the only property owner involved. Petition No. 422, having been filed with the Planning Department by Harry E. and Lestie S. Borland, and in turn filed with the City Clerk on October 15, 1965, requesting the rezone of property located at the S.E. corner of Broadway and Lenox, it was MOVED by Lynch, seconded by Brazier that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson absent. Petition No. 423, having been filed with the Planning Department by Paul Garmo, Charles Fowler and Charles M. Hunt, and in turn filed with the City Clerk on October 1$, 1965, requesting rezone of property located at 10 S. 9th Street, it was MOVED by Brazier, seconded by Lambert that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson absent. Petition No. 424, having been filed with the Planning Department by Naomi E. Fromm, and in turn filed with the City Clerk October 1$, 1965, requesting rezone of property located at 3512 Tieton Drive, it was MOVED by Brazier, seconded by Brown that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson absent City Manager Smith reporting on an Application for a sewer hook -up outside the City Limits, as filed by Edward A. Bannister, indicated that Mr. Bannister is requesting this service in connection with the operation of his fruit warehouse and that he is agreeable�.to annexation.. After discussion, it was MOVED by Lambert, seconded by Brown that the appli- cation be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson absent. MOVED by Brazier, seconded by Lynch, that Ordinance No. 727 relating to assessment proced- ures for irrigation maintenance and amending Yakima Municipal Code, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Robinson absent. Mr. Les Newland was present and spoke regarding this Ordinance. ORDINANCE NO. 727, AN ORDINANCE relating to irrigation system maintenance; providing for payment of costs and expenses of repair, maintenance, upkeep and operation of irrigation . systems supervised and controlled by the City of Yakima by the levy of assessment against real property served by such irrigation systems; specifying the procedure for the con- firmation of assessment rolls for said purposes; establishing a penalty for delinquent payments of assessments; establishing assessments as liens on real property; and amending Sections 7.24.010, .020, .030, .035, .040, .050 and .060 of the City of Yakima Municipal Code, and creating Sections 7.24.055 and .065 as new sections of the City of Yakima Municipal Code. Petition No. 425, having been signed for Trontech, Corporation, by Doug Wilson, Vice Presi- dent, and filed on this date October 1$, 1965 with the Clerk of Council at this meeting, as instructed earlier in this meeting, requesting annexation of property located North of Wide Hollow Creek and West of 24th Avenue, it was MOVED by Lambert, seconded by Brazier that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Robinson absent. The City Engineer reporting the completion of L.I.D. No. 934, North 1st Street Sanitary Sewer, it was MOVED by Brazier, seconded by Lambert, that November 15, 1965 be fixed as the time for hearing on the assessment rolls for said district and that the City Clerk give due notice by publication and to each property owner as required by statute: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynchvvting aye by voice vote. Robinson absent. . City Manager Smith, on the recommendation of Chief Soderstrom, requesting authorization to send Lt. Jack LaRue, Sgts. Richard Clark and Erwin Metzer, to the Police Personnel School at Gresham, Oregon, November 1 thru 12, 1965 at an estimated cost of $150.00 per man, it . was MOVED by Brazier, seconded by Lynch, that these men be allowed to attend this school with expenses paid: carried, Brazier, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote.
