HomeMy WebLinkAbout10/11/1965 Business Meeting 81 October 11, 1965 The City Council met in regular session, Mayor Larson presiding,.Councilmen Brown, Kurbitz, Lambert and Lynch, City Manager Smith and City Attorney Andrews present on roll call, Robinson absent and excused. MOVED by Lynch, seconded by Lambert that Councilman Brazier be excused from this meeting. . . The Invocation was given by Councilman Lynch. . The minutes of the regular meeting of October 4, 1965, and the Recessed Meeting of October 7, 1965 having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the hearing on Resolution No. D -$65, being a Resolution of Intention to improve property by constructing a sanitary sewer, and there being no protests in writing or otherwise, it was MOVED by Lambert, seconded by Brown that Ordinance No. 721 providing for said improvement and creating L.I.D. No. 946, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Brazier and Robinson absent. Mr. French, property owner in this district, spoke in favor of this improvement. ORDINANCE NO. 721, AN ORDINANCE providing for the improvement of certain property by con- structing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being the time fixed for the hearing on the Assessment Roll for L.T.D. No. 929, 52nd. Avenue and Various Other Streets Paving Districts, and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Lambert that Ordinance No. 722 confirming said assessment roll and every part thereof, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Brazier and Robinson absent. E. L. Bingaman, property owner, was present for the hearing. . ORDINANCE NO. 722, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 929 as created and established by Ordinance No. 577 of the Ordinances of the City of Yakima. . This being the time fixed for the hearing on the Assessment Roll for L.I.D.. No. 931, Grant Street Domestic Water District, and there being no protests in writing or otherwise, it was MOVED by Brown, seconded by Lynch that Ordinance No. 723 confirming said assessment roll and every part thereof, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Brazier and Robinson absent. Mr. Mitzel, a property owner in the district, being present, stated he could not understand why he should have to pay for this assessment as he understood when he bought his property that all improvements were in and assessments paid. John. Mayo, Director of Public Works, explained this property has not been included in any Local Improvement District prior to this time, and therefore as far as our records show, this property had not paid its share �n improvements. He further indicated investigation was made and no records were found showing that any assess- ment fees had ever been paid on this property. He suggested Mr. Mitzel check . further and if he finds that a hook -up charge has been paid, it can be deducted from the assessment charges on his property. ORDINANCE NO. 723, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 931 as created and established by Ordinance No. 596 of the Ordinances of the City of Yakima. MOVED by Lambert, seconded by Lynch that Ordinance No. 724, authorizing condemnation proceedings in the acquisition of easements over and across certain property for sanitary sewer line in the Sumac area, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Brazier and Robinson absent. ORDINANCE NO. 724, AN ORDINANCE authorizing and directing the City Attorney of the City of Yakima to institute and prosecute legal proceedings for the condemnation and acquisition of easements over and across certain real property for the construction and maintenance of a sanitary sewer line; providing for the condemnation and taking of such real property and declaring the condemnation and taking thereof to be necessary for a public use required by the public interests; and directing that compensation for such taking be paid from the Water -Sewer Fund of the City of Yakima; and declaring an emergency. MOVED by Brown, seconded by Lambert, that Ordinance No. 725, amending Ordinance No. 694 providing for annexation of property West of Cornell and North of Washington Avenue and correcting an error in description of property, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Brazier and Robinson absent. ORDINANCE NO. 725, AN ORDINANCE amending Ordinance No. 694, passed by the City Council of the City of Yakima on the 7th day of September, 1965, and entitled "An Ordinance providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -2 Two - Family Zone "; and declaring an emergency. MOVED by Lambert, seconded by Brown that Resolution No. D -$72, authorizing execution of an Amendatory Contract with the United States of America Department of Interior, concern- ing City water supply, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Brazier and Robinson absent. Mr. Smith, City Manager explained he had met with Bureau representatives, our consulting engineer, Don Gray; Public Works Director, John Mayo; Irrigation Supervisor, Frank Stein; City Attorney,:Fred Andrews; and all concurred in the proposed amendatory contract and recommended the•document be accepted and executed by the City. RESOLUTION NO. D -$72, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a contract with the United States of America, Department of the Interior, Bureau of. Reclamation. 82 • October 11, 1965 . The Planning Commission having reported on the following: Petition No. 405, as filed by A. A. Kauzlarich and others, praying for the annexation of property between Scenic Drive & Webster Road; Petition No. 415, as filed by Wm. L. Cawley and others, praying for the annexation of property in the general area of 7th and 8th Avenues, between Pierce and King Street; Petition No. 420, as filed by Glascam Builders, Inc., praying for annexation of property located between South 31st and 32nd Avenues, North of Viola; Petition'No. `413, as filed by Robert E. Elves requesting the rezone of property located on the::Northeast corner of S. 28th Avenue and Nob Hill Blvd.; Petition No. 418, as filed by Erwin E. Strawn requesting the rezone of property located at 318 N. 16th Avenue; . Petition No. 419, as filed by Lumber & Sawmill Workers Local 2739 requesting the rezone of property located at 712 N. 7th Street; Petition No. 386, as filed by John Magnalia and others and the reconsideration of the request for the rezone of property at 2703 and 2709 Nob Hill Blvd., it was MOVED by Lynch, seconded by Brown that Petitions No. 405, 415 and 420, all being annexation petitions, be approved as meeting the requirements of law; that the City Manager and Mayor be authorized to obtain waivers of a meeting of a Review Board as author- ized by law; and that an order be prepared fixing the date for public hearing by the City Council as the 25th day of October, 1965; and that October 25, 1965, also be set as the time for public hearing by the City Council on Petition No. 419, being a request for a re- zone of property; and November 1, 1965 be set as the time for public hearing by the City Council on the matters of rezone of certain property as requested by Petitions No. 413, 418 and 386; and that the City Clerk give notice of said hearings as required by law; carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Fred Plath at 622 Pickens Road, having made application for Utility Connection. outside Yakima City Limits, it was MOVED by Lynch, seconded by Lambert that the application be accepted and the staff process the necessary agreement for this hook -up: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Brazier and Robinson absent. Rudy Gast, Planning Director, explained that Mr. Plath is willing to sign the Outside Agreement and that the signer is . also interested in annexing to the City. The Seventh -day Adventist Church, 507 N. 35th Avenue, having made Application for Utility Connection outside Yakima City Limits, it was MOVED by Lambert, seconded by Brown that the application be accepted and the staff process the necessary agreement for this hook -up: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. Mr. Whitehead, a member of the Church Board was present and indicated they are building, that they have signed the Outside Agreement and that the property is in the process of being annexed in the Hammerstad annexation. Brazier and Robinson absent. Councilman Lambert indicated that the work done recently by Superior Asphalt and Concrete Company has been satisfactory. Rudy Gast, Planning Director, mentioned to the Council that there was to be a meeting of the Park Board and the Planning Commission,. Tuesday evening, October 12, 1965, to discuss the Park Plan and particularly the dedication of a Park in a proposed Park Sub - division and that the City Council members were invited to attend. City Manager Smith read a letter from Mrs. Pat Arnold, secretary of Local #1122, City Employees Union, thanking the Council for their consideration of Budget requests. City Manager Smith requested authorization to send Paul Page, Sewage Superintendent, to the Pacific Northwest Polution Control Association meeting at Vancouver, B. C. from Novem- ber 3 thru 5th, 1965, at an estimated cost of $50.00. MOVED by Lynch, seconded by Kurbitz that Paul Page be allowed to attend this meeting with expenses paid: caried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote. City Manager Smith informed the Council that the term of Robert Williams as a member of the Board of Adjustment would expire November 1$, 1965 and would like to re- appoint Mr. Williams to succeed himself for a six -year term which will expire November 18, 1971. It was moved by Lambert, seconded by Lynch that the City Manager's recommendation be accepted and Robert Williams be re- appointed for a term of six years to the Board of Adjustment, to serve until November 1$, 1971: carried, Brown, Kurbitz, Lambert, Larson and Lynch voting aye by voice vote.
