Councilmen Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of August 30, 1965 having been duly certified accurate by two councilmen . and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as read. An Ordinance appropriating the amount of $162,000.00 from unanticipated revenues in the 1962 Street Improvement Construction Fund having been read in its entirety at the regular meeting of August 30, 1965, was read by title only at this meeting and it was MOVED by Robinson, seconded by Lynch, that Ordinance No. 692 providing for said appropriation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 692, AN ORDINANCE appropriating the amount of $162,000.00 from unanticipated revenues in Fund No. 911, the 1962 Street Improvement Construction Fund to be expended in the manner as provided by the. 1962 General Obligation Street Improvement Bond Ordinance. This being the time fixed for the hearing on Petition No 388 as filed by Clarence McBeth and others praying for the annexation of property South of East Nob Hill Boulevard be- tween South 1st and U.P.P.R. Railway, it was MOVED by Lynch, seconded by Brown that Ordinance No. 693, providing for said annexation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 693, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property as M -1 , Light Industrial Zone. . This being the time fixed for the hearing on Petition No. 389 as filed by W. L. Fulk praying for the annexation of property in the vicinity Cornell and Washington Avenues , it was MOVED by Robinson, seconded by Lambert that Ordinance No. 694, providing for said annexation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 694, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -2 , Two Family Zone. This being the time fixed for the hearing on Petition No. 391 as filed by Charles M. French praying for annexation of property in vicinity of Manners Lane and Tieton Drive, it was MOVED by Lynch, seconded by Brown, that Ordinance No. 695, providing for said annexation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye on roll call . ORDINANCE NO. 695, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as B -2 Local Business Zone. 'This being the time fixed for the hearing on Petition No. 392 as filed by Ralph S. Morton and others praying for annexation of property in vicinity of North 58th Avenue and Richey Road, it was MOVED by Lambert, seconded by Robinson, that Ordinance No. 696, providing for said annexation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 696, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -1, Single Famil Zone This being the time fixed for the hearing on Petition No. 393 as filed by Thomas Opstad praying for annexation of property located South of Lincoln Avenue between 52nd Avenue and 55th Avenue, it was MOVED by Robinson, seconded by Lambert, that Ordinance No. 697, providing for said annexation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Mr. Fred Velikanje, Attorney, re- presenting Mrs. Winifred Miller, owner of property in the area to be annexed, informed the Council that Mrs. Miller had obtained a county permit to build a tri -plex on this property, and since Mrs. Miller did not wish the property to be nonconforming, has re- quested that this area be zoned to R -2 so that she could at least build a duplex.. Mr. • Opstad stated that the R -2 zoning allowing duplexes would not be advantageous to him, and asked that the notice be withdrawn. Council pointed out to Mr. Opstad that under the county permit Mrs. Miller is allowed to build a tri -plex or duplex, whether the area is annexed or not. Mr. Opstad stated he was reluctant to annex under R -2 zoning as Mr. Rankin another property in the proposed annexation was not present for discussion. Mr. Dick Miller, husband of Winifred Miller, then withdrew the request for R -2 zoning, stating he did not wish to hinder the council in their decision regarding the annexation.,as presented. - ORDINANCE NO. 697, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -1, Single Family Zone This being the time fixed for the hearing on Petition No. 394 as filed by Elsie Wesselius and others praying for annexation of property located at the Northwest corner of Cornell. and South 7th Avenue, it was MOVED by Lynch, seconded by Lambert that Ordinance No. 698, providing for said annexation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. - ORDINANCE NO. 698, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -2, Two Family Zone. • r 67. SEPTEMBER 7, 1965 . ' • This being the time fixed for the hearing on Petition No. 386 as filed by John D. Minaglia and others requesting rezone of property at 2703 and 2709 Nob Hill Boulevard, from R •2, Two Family Zone, to R -3 Multiple Family Zone, and the Planning Commission having re- commended the rezone of said property, it was MOVED by Brown, seconded by Robinson that an Ordinance providing for said rezone be passed as read; Mr. Elery•Grandstrand, Real Estate Broker n� hiving an interest in this property the Council to consider zonin this area to g -1, which would also serve R -2 and R -3 zoning. He stated that home rental units should be built about 90 to 100 feet from arterials in order to eliminate noises, etc. He felt that the B -1 zoning for the north side of Nob Hill would • • act as a buffer to the arterial. -Mr. Gast stated that the Planning Commission felt that if a B -1 zone is granted it would make it more difficult to deny B -2 and B -3 Business • zone requests from other property owners along the North side of Nob Hill Blvd. Council- man Brown stated that he felt well - planned controlled B -1 zoning being used as a buffer was not objectionable. Councilman Lambert and Kurbitz concurred with Councilman Brown. Councilman Robinson favored the R -2, R -3 zoning for this area. Others present for dis- • cussion of this matter, were Mr. Clifford Nelson, Mr. St. Aubin and Mrs. Ruby Anderson who favored the business zoning. All persons having been heard, Mayor Larson asked for a roll call vote to pass the ordinance providing for said rezone: Robinson, voting Aye; Brazier, Brown, Kurbitz, Lambert, Larson•and Lynch voting Nay on roll call. Motion lost for want of majoiity vote. A formal written motion' having been prepared by the City Attorney disapproving the recommendation of the Planning Commission was then read and it was MOVED by Lynch, seconded by Brown that said motion be passed: carried, Brazier, • Brown, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Robinson voting Nay. This being the time fixed for the hearing on Petition No. 396 as filed by Frank M. • Bacon requesting rezone of property at 1018 South 10th Avenue from R -2, Two Family Zone, • to B -3, General Business Zone, and the Planning Commission having recommended the re- zone of said property, it was MOVED by Brown, seconded by Lynch that Ordinance No. 699, accepting the recommendation of the Planning Commission be passed as read; carried, Brazier, Brown,. Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll Mr. Charles Lyon, representing petitioner, was present. . ORDINANCE NO 699, AN ORDINANCE accepting the recommendation of the Planning Commission .and rezoning certain property situated at 1018 South 10th Avenue, Yakima, Washington from R -2, Two Family Zone, to B -3, General Business Zone. . This being the time fixed for the hearing on Petition No. 397 as filed by E. L. Clark and others requesting rezone of property located at 1902 -1914 Nob Hill Blvd; 1101 -1105 South 20th Avenue and 1102 and 1104 South 19th Avenue from R -2, Two Family Zone to B-1' General Business zone, and the Planning.Commission having recommended the rezone of said property, it was MOVED by Robinson, seconded by Brown that Ordinance No. 700, be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. . A notice of intention to commence annexation proceedings having been filed with the City Clerk on September 7, 1965 by M. L. Cawley for property located South of King Street • between 7th and 8th Avenue and signer of said notice being present at this ieeting, it was MOVED by Robinson, seconded by Lynch that this date, September 7, 1965, be set as.time of meeting with the initiating party; carried, Brazier, Brown, Kurbitz, Lambert, ' Larson, Lynch and Robinson voting aye by voice vote. City Manager Smith reported that in accordance with Statute the preliminary budget for 1966 has been duly filed with the Mayor and Councilmen for their consideration. Mgr. Smith also stated that- a resolution adopting,.the preliminary budget for 1966 is being. prepared for their consideration at next week's Council meeting. Public hearings.on the budget wil commence October 14. Manager Smith requesting permission to send Fired Chief W. K. "Pete" Moore to Portland to a conference of the Pacific Coast Intermountain Association of Fire Chiefs, on September 20 through 23rd at.an approximate expense of $70.00, it was MOVED by Kurbitz, seconded by Lynch that Chief Moore be allowed to attend this convention with expenses paid; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting • aye voice vote.
