AUGUST 9, 1965
, The City Council met in regular session, Mayor..Larson presiding, Councilmen Brazier, Brown,
. Kurbitz, Lambert and Robinson, City Manager George Smith and -City Attorney Andrews present. •
• on roll call. Councilman Lynch absent. MOVED by Lambert, seconded by Brown that Council-
man Lynch be excused from this meeting;. carried: Brazier, Brown, Kurbitz, Lambert, Larson
and Robinson voting aye on roll call.
The Invocation was given by Councilman Lambert.
The minutes of the regular meeting of August 2, 1965, having been duly certified accurate •
by two Councilmen and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes be approved as recorded.
• This being the time fixed for the hearing on Petition No. 36$ as filed by Joe W. Hocker, •
requesting vacation of an 8' alley in Lot 13, Block $, Broadway Park Addition No. 2,
and the Planning Commission having recommended the vacation of said property, it was
MOVED by Lambert, seconded by Brown, that Ordinance No. 6$7 providing for said vacation be
• passed as read; carried: Brazier, Brown, Kurbitz, Lambert, Larson and Robinson voting
aye on roll 'call- Lynch absent.
ORDINANCE NO. 6$7 - AN ORDINANCE providing for the vacation of the alley, 8 feet wide
situated directly East of and abutting Lot 13, Block.$, Broadway Park Addition No. 2,
to the City of Yakima, Washington, according to the plat thereof, recorded in Volume 1
of.Plats,•Page 10, records of Yakima County, Washington. •
• A Notice of Intention to commence annexation proceedings having been filed with the City
• Clerk on August 5, 1965, by A. A. Kauzlarich for property located between 53rd Ave.. and
Scenic Drive and west of Homesite Drive, and the signer of said notice being present at •
this meeting, it was MOVED by Lambert, seconded by Brown,, that this date, August 9, 1965,
be set as the time of meeting with the initiating party; carried: Brazier, Brown,
Kurbitz, Lambert, Larson and Robinson voting aye on roll call. Lynch absent. Mr. A. A.
Kauzlarich having stated to the Council that the area to be annexed is willing to assume
r- its share of the city's existing indebtedness, it was MOVED by Robinson, seconded by
Brown, that the annexation proposed by parties be accepted by the City of Yakima,
and that the area to be annexed be required to assume its share of the city's existing •
indebtedness; carried: Brazier, Brown, Kurbitz, Lambert, Larson and Robinson voting aye •
. on roll call. Lynch absent. .

Moved by Lambert seconded by Broom that Resolution D -$47 authorizing City Manager George
. Smith to engage professional services of Don D. Smith, Transit Consultant, 1333 Airport .
Way. S., Seattle, Washington, to perform 'a bus system study for the• benefit of the city of
Yakima, in accordance with the proposal set forth in a communication from Mr. Don Smith
dated August 5, 1965, wherein the scope of the study is outlined, the fee of.$1,000 to
cover all expenses of the study and•the delivery of 25 copies of the completed report is •
set forth, and the completion date of September 30, 1965, is given, be.passed as read;
carried: Brazier, Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call.
Lynch absent. Mr. George Smith stated that two proposals for this study had been
received and that Mr. Don Smith's proposal was recommended for approval as this estimate
was considerably less than the other proposal. The importance of this study is twofold:
First, it would give very objective information and data upon which. to make a decision if
this project is undertaken as . a city operation and is submitted to the people; second,
this study will provide a system, plan and outline for the operation of a bus system;
it will provide projected data for this •operation for the next three to five years; it wil
• show whether the transit system. planned would meet the requirements of the city and it will
• give the necessary information for the staff and the City Attorney to prepare the required
ordinance. Funds to meet the cost of the study would come from unappropriated surplus in
the Current Expense Fund. •
• RESOLUTION NO. D -847 - A RESOLUTION authorizing and directing the City Manager of the City
of Yakima to engage professional services of Mr. Don Smith to perform a bus system study.
Moved by Robinson, seconded. by Brown, that Resolution D -$4$ authorizing and directing the
City Manager and City Clerk to execute a Supplemental Lease Agreement with Yakima Airport •
Restaurant, Inc.,.to.provide for altering and remodeling the banquet room of said.restau-
rant premises, be passed as read; carried: Brazier, Brown, Lambert, Larson and Robinson
voting aye on roll call vote; Kurbitz disqualifying his vote for the reason that he had
not studied the matter thoroughly and questioned whether we should furnish the carpeting.

RESOLUTION NO D - $48 - A RESOLUTION authorizing and directing the City Manager and City
Clerk to execute a Supplemental Lease Agreement with Yakima Airport Restaurant, Inc.
Moved by Robinson, seconded by Lambert, that Resolution D -849 authorizing the payment of
S200 to Leroy J. Phillips in full settlement of a damage . claim for a sewer backup into
the basement of claimant's residence at $04 West Logan, Yakima, Washington, on October 4,
• 1964, be passed as read; carried: Brazier, Brown, Kurbitz, Lambert, Larson and Robinson
voting aye 'on roll call vote. Lynch absent. .
RESOLUTION NO. D -$49 - A RESOLUTION authorizing the payment of 8200 to Leroy J. Phillips
in full.settlement of a damage claim.
Moved by Brown, seconded by Lambert, that Resolution No. 7D - $50 authorizing the Director
of Highways to perform various tests, as requested by the City of Yakima, of asphalt •
concrete samples from various City paving projects to the amount of 5300; carried:
Brazier, Brown, Kurbitz, Lambert, Larson and Robinson voting aye on roll call vote.
Lynch absent. Discussion indicated that the authorization is hereby granted for the with-
holding from the monthly fuel tax allotments, being an amount not in excess of the money
reasonably anticipated to accrue to the credit of the City of Yakima in the Motor Vehicle
Fund during the current biennium. .

The Planning Commission having recommended the annexation of property located south of E.
Nob Hill Blvd. (Lenox Avenue) between So. 1st Street and the Union Pacific railraod right -
of -way as requested by Petition No. 388 filed by Clarence E. McBeth with City Clerk
July 2, 1965, if was MOVED by Robinson, seconded by Brown, that Petition No. 388 be
approved as meeting the requirements' of law; that the City Manager and the Mayor be
authorized to convene a Review Board, as required by law, for a hearing and review of this
proposed annexation; and that an order be prepared fixing September 7, 1965, as the time
for a public hearing by the City Council on said petition; carried: Brazier, Brown,

that orders ,be prepared fixing September 7, 1965, as the time for public hearings by
the City Council on these petitions; carried: Brazier, Brown, Kurbitz, Lambert, Larson,
and Robinson voting aye by voice vote. Lynch absent. .

Petition Nos. 386, 396 and 397, respectively, and that the City Clerk give notice of such

The Planning Commission having initiated a recommendation to change the zoning of two
pieces of property in the general vicinity of East Chestnut Street and the Yakima city .
limits belonging to Cliff Wells to have Parcel "A " rezoned from R -3 (multiple family:)' to
B -3 (general business) and Parcel "B" rezoned from B -3 (general business) to R -3 (multiple
family) and correcting an error in the legal description of said parcel of land; and the
Planning Commission having also recommended by Resolution of Intention amendment of
Section 12.32.020 of the zoning ordinance it was MOVED by Robinson, seconded by
that September 13th be set as the time for hearings by the City Council on the matters
above mentioned and that the City Clerk give notice of such hearings as required by law. ••

City Manager George Smith calling on Mayor Larson to give a report on the Mayor's Conven-
tion in Detroit, Mayor Larson reported that the program under consideration is geared to
having the Federal government assist cities in their progress and development.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Brazier, that we do not adjourn at the hour of 3:55 p.m.; 'carried: Brazier,
