HomeMy WebLinkAbout07/19/1965 Business Meeting 49 JULY 19, 1965 Kurbitz The City Council met in regular session, Mayor Larson, Councilmen Brazier, Brown, /Lambert, Lynch and Robinson, City Attorney Andrews, acting as City Manager, present on roll call. City Manager George Smith absent and on vacation. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of July 12, 1965, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Moved by Lynch, seconded by Brown that Resolution No. D -841, a resolution fixing the time for hearing on petition No. 368 requesting the vacation of a portio /t alley in Lot 13, Block 8, Broadway Park Addition No. 2, be passed as read; carried: Kurbitz, Lam - bert, Larson,Lynch and Robinson voting aye on roll call vote. RESOLUTION No. D -841, A Resolution fixing the time for hearing on petition for vacation of a portion of an alley. • This being the time for the hearing on Resolution No. D -835, being a Resolution of Inten- tion to create a local improvement district for the improvement of property by construction of pipe sewers, it was MOVED by Lambert, seconded by Robinson, that Ordinance No. 672 pro - viding for said improvement and creating L.I.D. No. 942 be passed as read; carried: Iaazis'., Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call vote. Inquirie-. made by interested property owners of the area concerning the specifications and procedures! to be followed in laying the sewer line were referred to and answered by John. Mayo, Director of Public Works, who re- assured the inquirers that protests could be accepted within the next 30 -day period. ORDINANCE NO. 672 - An Ordinance providing for the improvement of certain property by con - structing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being the time for the hearing on Resolution No. D -836, being a Resolution of Inten- tion to create a local improvement district for the improvement of certain streets by grading, ballasting and surfacing, it was MOVED by Robinson, seconded by Brown that Ordinance No. oviding for said improvement and creating L.I.D. No. 943, be passed as read; carried: Larson, Lynch and Robinson voting aye; Brazier qualifying his aye vote by asking to be excused from voting on the alley in Block 2 between Front and 1st Streets because his employer has an interest in this property; Brown qualifying his aye vote with the understanding that Mr. Charles Countryman be given ample time to plan a curved street. Norris (owners) 1013 S. 38th Ave During the meeting protests were filed by the following: J. T. Sandifer 1308 S. 8th Street Jack Geoghegan, Jr. 3$03 S. Nob Hill Blvd. Mr. & Mrs. Samuel P. Boyd et al filed 228 Chisholm Trail by Charles C. Countryman -of 213 Belaire Drive Vernon A. Roark Route 2, Box 4, Selah J. H. Talton 1306 S. 8th Street Mr. Charles Countryman speaking in protest of the portion of the L.I.D. extending West Walnut from Chisholm Trail to South 48th Ave., stated that actually a through street was not needed when parallel streets of Chestnut and Tieton served the purpose;. and that further by extending Walnut, his property would be infringed upon, taking 15' of his lot and 10' of his house and that they would have a good deal of student foot traffic immedi- ately outside their home and lastly that they purchased the property specifically to be located at a dead -end street. Councilman Robinson stated that he did not agree with Charles Countryman's contention that the cul de sac of Walnut Street be retained just to abide by the wishes of a few when in the tours✓ of time and progress the extension of main streets in any community makes it necessary to continue the thoroughfare. Other intereste. property owners were also present and inquired about the improvements or offered their approval in those sections which they had interests included Gerald DeZarn, Archie Oakes, Robert Roberts and Mr. Stuart" Mr. Norris and Mr. Geoghegan also,.protested and indicated that if the city could rezone their property for business they could then afford to parti- cipate in these improvements Tom Tompkins indicated that the residents in that section of Casa Court from S. 39th Ave. to 231' east had not all protested. Mr. Howard Hettinger, attorney, speaking on behalf of several interested parties who are in favor of the improve ment commented unfavorably on the protest of the Metropolitan Park District stating that i the District is in favor of the improvement but lacks the funds that the funds should be obtained by some statutory means as they (the Park District) carry the deciding vote over many persons who do approve the improvement but whose combined votes would be ruled out by the Park Boards protest. Martin Wilson of 1007 S. 38th Ave. in favor of the L.I.D. objected to the weight of thec Park District='s protest on this project; Mr. Mayo assured the Council that no final decision will be made on these protested improve- k ments until all of the protests have been evaluated and at the end of 30 days report to the Council the percentage of protests in each individual section of the L.I.D. The Council assured persons in attendance that they have every chance to protest the district out within the next 30 days if they will just file written protests within that time. Mr. May. also invited all those interested with questions on the improvements to come to the Engineer's office and discuss the matter. Mr. Kurbitz expressed the opinion that with the 50: . JULY 19, 1965 Metropolitan Park District's objection, the people of Yakima would feel that the city is dragging its feet inasmuch as the Park District is part of the city operation. Petitions Nos. 392, 393 and 394 having been filed with the City Clerk by Ralph S. Morton, Thomas Opstad and Elsie Wesselius, on July 14, 15 and 16, respectively, it was MOVED by Lynch, seconded by Lambert that Petitions 392, 393 and 394 be referred to the City Manager and the Planning Commission for study and recommendation; carried: Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call vote.
