It was MOVED by Lynch,.seconded by Brazier that Councilman Kurbitz be excused-from attendance at this meeting: •carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. . . • - The Invocation was given by Councilman Lynch. . The minutes of the regular meeting of July.6, having been duly certified accurate. • by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded; . An Ordinance appropriating 52,300 to the 1965 Current Expense Engineering Budget having • been read in its entirety at the regular meeting on July 6, 1965, was read by title only at this meeting and it was MOVED by Robinson, seconded by Lynch that Orrdinance No. 670 providing for said appropriation be passed as read: carried, Brazier, Brown, Lambert, • Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. . ORDINANCE NO. 670, appropriating the amount of 52,300 from unappropriated monies in the Current Expense Fund to Account No. 102 -$40, Election Expense, of the Maintenance and and Operation Classification, in the 1965 appropriation for 102, Records Department. A Notice of Intention to commence annexation proceedings having been filed with the .City Clerk on July 12, 1965, by Charles M. French and Edith French, husband and wife,. for pro- . perty located north of Tieton Drive and East of Maners Lane, and the signers of said notice being present at this meeting, it was MOVED by Robinson, by Lambert that this date, July 12, 1965, be set as the time of . meeting with the initiating parties: carried, Brazier, Brown, Lambert,,Larson, Lynch and Robinson voting aye. The initiating parties having stated to the Council that.the area to be annexed is willing. to assume its share of the city's existing indebtedness, it was MOVED by Robinson, seconded by Lynch, that the annexation proposed by said parties be accepted by the City of Yakima, and that the area to be annexed be required to assume its share of the city's existing indebtedness: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on voice vote.. The initiating parties being the only persons to sign the annexation petition and having signed and filed with the Clerk of the Council • their petition praying for the annexation of said property, it was MOVED by Robinson seconded by Lambert that Petition No. 391 for annexation be referred to the City Manager ard Planning,Commission: carried, Brazier, Brown, Lambert,. MOVED by Lambert, seconded by Brown that Ordinance No. 671 relating to water service rates and providing for special irrigation rate to be charged to Washington State Highway Depart- . ment for freeway beautification purposes be passed as read: carried, Brazier, Brown, - 4;r'e Lambert, Larson, Lynch and Robinson voting aye by roll call vote. ORDINANCE NO. 671, relating to water service rates; providing for a special irrigation rate to be charged to the Washington State Highway Department for freeway beautification purposep; and adding Subsection (g) as a new subsection to Section 7.6$.252 of the City of Yakima Municipal Code. . The City Manager having. reported the necessity of additional space for a cooling unit in the Administration Building of the Municipal Airport, and it being deemed necessary in the best interests of the City to supply the - funds.for these accommodations, it was MOVED, by Lambert, seconded by Brown Resolution No. D -$3 transferring the amount of 8135 within the 1965 appropriation for the Yakima 1�'Iunicipal Airport be passed as read: carried, Braziew, Brown, Lambert, Larson, Lynch and Robinson voting aye by roll call vote. Kurbitz absent. RESOLUTION NO. D -839, transferring the amount of $135 within.the 1965 approrpiation for 390- Municipal Airport. • • MOVED by Robinson, seconded by Brown, that a Resolution authorizing the appointment of Fred H. Andrews, City Attorney., as acting City Manager for the periods of time during July 15 through 23 and August 2 through 6, 1965, inclusive, be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by roll call vote. JULY 12 1965 The Planning Commission having recommended the rezoning of certain property located at 2009 to approximately 2109 Lincoln Avenue as requested by Petition No. 365, filed by M. D. Brown, William Baker and Lincoln Center, Inc., it was MOVED by Robinson, seconded by Brown that. July 28, 1965, set as the time of hearing by the City Council on the matter of said rezone and that the City Clerk give notice of such hearing as required by law: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. The Planning Commission having recommended the vacation of alley in Broadway Park Addition #2 as requested by Petition No. 365 filed by Joe W. Hocker et al with the City Clerk on April 29, 1965, it was MOVED by Robinson seconded by Brazier that a resolution be prepared setting August 9th as the time for a hearing by the City Council on Petition No. 365: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The Planning Commission having recommended the annexation of property located along North 58th Ave. between Scenic Drive and the Tieton Canal and along the northwest edge of the present city limits as requested by Petition No. 378 filed by John Mayo et al with the City Clerk on June 10, 1965, it was MOVED by ,Lynch, seconded by Robinson, that Petition No. 378 filed by John Mayo et al be approved as meeting the requirements of law; that the City Manager and the Mayor be authorized to obtain waivers of a meeting of a Review Board, as authorized by law; and that an order Fixing Date of Publication Hearing on Petition for Annexation as July 26th be prepared: carried, Brazier,. Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. The Planning Commission having recommended the annexation of property located between Pierce and Washington and South 4th and 7th Aves., as requested by Petition No. 380 filed by Buren Sheet Metal Co., et al with the City Clerk on June 15, 1965, it was MOVED by Robinson seconded by Lynch, that Petition No. 380 filed by Buren Sheet Metal Co., et al be approved as meeting the requirements of law and the Mayor be authorized to convene a Review Board as required by law for a hearing and review of this proposed annexation, and that an order be prepared fixing July 26th as the date for the hearing: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent. The Planning Commission having recommended the rezoning of property located on the northeast corner of West Lenox and Landon as requested by Petition No. 385 filed by Joe W. Hocker with the City Clerk June 21, 1965, and the rezoning of property located at 415 N. 2nd Street initiated by Resolution of Intention by the Planning Commission, it was MOVED by Robinson, seconded by Lambert, that July 26th be set as the time for a hearing by the City Council on the matter of these rezoning matters, and that the City Clerk . give notice of such hearing as required by law: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by'yoice vote. Kurbitz absent. • The Planning Commission reporting on and approving the Final Plat of High View Court Sub - division, it was MOVED by Robinson, seconded by Brazier, that the Final Plat of High. View Court. Subdivision be accepted and approved by the Council and that the Mayor be authorized to sign same in behalf of the City of Yakima: carried, Brazier, Brown, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Under new business, Ray Baker,representing the property owners on the matter of the Nob Hill Arterial Street Improvement, L.I.D. 940, stated that he has obtained the names of 60.8% of those property owners who are protesting the LID in the event that the decision of the King County Court rules in favor of those protesting. Discussion pointed out that additional property-had been purchased by one of the protesting property owners which Ray 48 July 12, 1965 • Baker indicated would make the percentage of persons protesting sufficient to invalidate .'the L.I.D. This matter was informally referred to Public Works Director John Mayo.
