JUNE 21, 1965
The City Council met in regular session, Mayor Larson, Councilman Brazier, Brown, Kurbitz,
Lambert, Lynch and Robinson and City Manager Smith and City Attorney Andrews present on
roll call. .
•
The invocation was given by Councilman Brown. .
The minutes of the regular meeting of June 14, 1965 having been duly certified accurate
by two Councilmen and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as "recorded. - - - ' -
This being the time for the hearing on the assessment roll for L. I. D. 922, Anderson -
Wallingford, Carriage Hill, Larsons Lot 2, Sanitary Sewer District, and there being no .
protests in writing or otherwise, it was MOVED by Lynch, seconded by Lambert, that Ordinancec
No. 661, confirming said assessment roll, and every part thereof be passed as read; carried,,
Brazier, Brown, Kurbitz Lambert, Larson, Lynch and Robinson voting aye on roll call.
ORDINANCE NO. 661, an Ordinance confirming the assessment roll covering Local Improvement
District No. 922 as created and established by Ordinance No. 533 of the ordinances of the
City of Yakima .
This being the time f'i.xed for the hearing on Petition No. 373 as filed by Barbara K. Small
et al requesting the rezoning of property located between 2nd and 3rd streets and between
D and E streets and the Planning Commission having recommended the rezone of said property,
it was MOVED by Brown, seconded by Robinson, that Ordinance No. 662 providing for said
rezone be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and
Robinson voting aye on roll call. Mr. Reimcke, representing Barbara K. Small, et al was
present. Mr. Purcell stated he favored this rezone.
ORDINANCE NO. 662, an ordinance jccepting the recommendation of the Planning Commission and
rezoning certain property located between "D" and "E" Streets and North 2nd and 3rd Streets,
in the City of Yakima, Washington from R -3, Multiple Family Zone to B -1, Modified Business '
Zone. .
This being the time fixed for the hearing of the Planning Commission's Resolution of In-
tention recommending the rezoning of certain property located at 35th and Englewood Avenues,
it was MOVED by Lynch, seconded by Robinson, that Ordinance No 663 providing for said
rezone be passed as read; carried,, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and
Robinson voting aye on roll call.
ORDINAL: E NO. 663, AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 35th and Englewood Avenue, in the City of Yakima, -
Washington, from R -1, One Family Zone to R -2 , Two Family Zone
This being the time fixed for the hearing of the Planning Commission's Resolution of In-
tention recommending the rezoning of certain property located situated between 15th and
16th Avenue and between Lenox and Viola, it was MOVED by Robinson, seconded by Brown that
Ordinance No. 664 providing for said rezone be passed as read; carried, Brazier, Brown,
Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call.
ORDINANCE NO. 664, An ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated between 15th and 16th Avenue and between Lenox and
Viola, in the city of Yakima, Washington, froth R -2, Two Family Zone, to R -3, Multiple
Family zone. • .
In accordance with action taken by the City Council at their regular meeting on June 7,
1965, and upon the recommendation of the Planning Commission, the matter of amending the
zoning ordinance with regard to permitting equipment rental firms in a B -2 zone was con-
sidered. No formal action taken on this matter at this time since the Planning Director
indicated that the matter must be further considered by the Planning Commission at their
regular meeting of July 6th.
A notice of intention to commence annexation proceedings having been filed with the City
Clerk on June 17, 1965 by Elsie S. Wesselius for the property located between South 7th
Avenue and Cornell, and between Pierce and King Streets, and the signer of said notice
being present at this meeting, it was MOVED by Robinson, seconded by Lynch that this date,
June 21, 1965 be set as time of meeting with the initiating party; carried, Brazier, Brown,
Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The initiating
party, Mrs. Wesselius, having stated to the Council that the area to be annexed is willing
to assume its share of the city's existing indebtedness, it was MOVED by Lynch, seconded
by Lambert that the annexation proposed by said party be accepted by the City of Yakima,
and that the area to be annexed be required to assume its share of the city's existing
indebtedness; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting
aye by voice vote.

the general area between North 32nd and 35th Avenues and between Lincoln and Englewood
Avenues, and the signers of said notice being present at this meeting, it was MOVED by
Robinson, seconded by Lambert, that this date, June 21, 1965 be set as time of meeting with
the initiating parties; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and
Robinson voting aye by voice vote. The initiating parties, Lloyd Hammerstad and Donald
Skidmore having stated to the Council that the area to be annexed is willing to assume its
share of the city's existing indebtedness, it was MOVED by Lynch, seconded by Robinson,
that the annexation proposed by said parties be accepted by the City of Yakima, and that
the area to be annexedabe required to assume its share of the city's existing indebtedness;
carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice
vote.

Petition No. 380 having been filed by Buren Sheet Metal Co. et al on June 15, 1965 with •
the City Clerk, it was MOVED by Robinson, seconded by Lynch that said petition for annexation
be referred to the City M nager and the Planning Commission for study and recommendation:

Petition No. 381 having.beenlfiled with the City Clerk on June 15, 1965 by Calvin Chin
•requesting the formation of a local improvement district for the paving of a portion of •
Knoble Avenue, it was MOVED by Lynch, seconded by Lambert'that said petition be referred to the,
City Manager and Staff for study and recommendation; carried , Brazier, Brown, Kurbitz,
Lambert, Larson, Lynch and Robinson voting aye by voice vote.
Petition No. 382 having been filed with the City Clerk by E. L. Clark on June 17, 1965
requesting the rezone of property located at 1906 Nob Hill Blvd., it was MOVED by Lynch,
seconded by Robinson that said petition be referred to the Planning Commission for study
and recommendation; carried, Brazier, Brown, Kurbitz, Lambert,Larson, Lynch and Robinson
voting aye by voice vote. •
Petition No. 383 having been filed with the City Clerk on June 17, 1965. byPaul V. Creamer
requesting the rezone of property located at 1908- 10 -12 -14 Nob Hill Boulevard, it was MOVElI
by Robinson, seconded by Lynch that said petition be referred to the Planning Commission
for study and recommendation; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch,
and Robinson voting aye by voice vote.
Petition No. 384 having been filed with the City Clerk on June 17, by Kenneth G. Samson
and others requesting formation of a Local Improvement District for the. construction of
a sewer in the area between 47th Avenue, Glenside, Tieton Drive and Chestnut, it was
MOVED by Robinson, seconded by Lynch that said petition be referred to the City Manager
and staff.for study and recommendation; carried, Brazier, Brown, Kurbitz, Lambert, Larson,
Lynch and.Robinson voting aye by voice vote.

it was MOVED by Robinson, seconded by Lambert that said applications be approved and permits

The following names having been submitted to the Council as a result of an election held
on June 11, 1965 which was held in accordance with Article XVI,Section 3, Paragraph B of
the City Charter which states that a second member shall be appointed to the Civil Service
Commission by the City Council from a list of three names submitted to the Council chosen
by referendum vote of city employees, excluding police and firemen: Byron W.(Bud) Yadep,
Dwight S. Billington, A. C. Shelton, and Byron Yaden receiving the majority vote, it was
MOVED by Robinson, seconded by Lynch that Bryon W. (Bud) Yaden be reappointed to serve
a six -year term on the Civil Service Commission commencing August 1, 1965 and ending July
31, 1971:carried, Brazier, Brown, Kurbitz , Lambert , Larson,Lynch & Robinson voting aye by voice
County vote.
Councilman Kurbitz being unable to attend regularly the meetings of the Yakimg/District
Boardcf Health and Councilman Brazier having consented to fill this position, it was MOVED
by Lynch, seconded by Kurbitz that Councilman Brazier be appointed to serve on said Health
Board: carried, Brazier,Brown,Kurbitz, Lambert, Larson, Lynch & Robinson voting aye by voice vote
Under new business, J. W. Milton, filed with the Clerk of the Council a written protest
of 60 percent of the property owners located between South 16th Avenue and South 24th
Avenue, and adjacent to Nob Hill, protesting the formation of a local improvement district
for the widening of Nob Hill between 16th and. 24th Avenue, said protest stating that this
is a part of an arterial highway and that public funds should be used for its improvement
(L. I. D. 940 - Nob Hill Arterial Street Improvement). Mr. Milton stated that this district
is similar to one which is being protested by property owners in Seattle for which King
County Superior Court Judge Wright ruled in favor of the protesting property owners. City
Attorney Andrews advised the property owners in this district that they can pay the assess-
ment for this improvement by written protest and if the Supreme Court decision favors
those protesting, a refund can be made.
•� At this time Miss Eshter Schnick, Mrs. Gerald Gaudette, and Mrs. Roy Rice, representing
a group of citizens, protested the transfer of water rights from Nelson Bridge to Rowe
Hill and asked the Council to retain the Oak Flats site as they felt the transfer would
jeopardize the general system. Mr. Frank Stein, Public Utility Director discussed this
matter fully with those present, emphasizing that the Rowe Hill site was chosen as there
is not enough water at Oak Flats to supply future needs of Yakima. He further stated
that with the water rights obtained by the city from several Canal Companies, and the
city wells being available for emergency use, that a sufficient water supply should be
available for the general system. Council stated all phases of the Yakima Water system
will be studied thoroughly in order that a pure andcadequate water supply can be provided
for the present and future needs of Yakima..
There being no further business to come before thei_Council, it was MOVED by Kurbitz,
seconded by Lynch that we do now adjourn at the hour of 10 p.m.; carried, Brazier, Brown,
Kurbitz, Lambert, Larson, Lynch, and '. voting aye b voice vote.
