MAY 24, 1965.

The City Council met in regular session, Mayor Larson, Councilmen Brazier, Brown, Kurbitz,
Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll
call. . . .
The invocation was given by Councilman Brazier.
The minutes of the regular meeting of May 17, 1965 having been duly certified accurate by
two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson
declared said minutes . approved as recorded. .
In accordance with action taken by the City Council at their regular meeting of May 17, 196
with regard to e damage claim filed by Mrs. Gordon B. Clappison, it was MOVED by Lambert,
seconded by Robinson that Resolution N D -812 denying said damage claim be brought on for
reconsideration: Robinson and Lambert voted aye by voice vote. Brazier, Brown, Kurbitz,
Larson and Lynch voted nay by voice vote. Mrs. Clappison was present at this meeting are:
• explained that other things of value and use had been left on the top of the garbage can
and garbage employees have not picked them up and therefore she felt that this was a new
employee who was not familiar with all p,r.ocedures of collecting. ..
. An ordinance appropriating $3,250.00 to the 1965 Budget for the Garage Division, having been
read in its entirety at the regular - meeting of May 17, 1965, was read by title only at this •
meeting and it was MOVED by Robinson, seconded by Lynch that Ordinance No. 651 providing
for said appropriation, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert,'
Larson,_Lynch and Robinson voting aye on.roll call.

ORDINANCE NO. 651 AN ORDINANCE appropriating the amount of 3,250' — from unappropriated
money in the Garage Division, Fund No. 340, to Account 7 -020, Part Time, Temporary Overtime
and Special Assignment, and.Account 7 -320, Rentals of the 1965 appropriation for Garage
Division. •

In accordance with action taken by the City Council at their regular meeting of May 17,
1965 the 'matter of the request of Mr. Glen Hay for outsinh water connection was brought
on for discussion and since Mr. Hay was not present nor did he appear during this meeting
the matter was informally set aside and no further action or discussion held on it.
This. being the time fixed for the hearing on Petition No. 361 as filed by Harold Sanford
and others, praying,for the annexation of certain property located on the.South side of
Englewood Avenue and West of 35th Avenue, it was Moved by Lynch, seconded by Lambert that
Ordinance No. 652 providing for said annexation be passed as read: carried, Bra tier, Brown,
Kurbitz, Lambert, Larson and•Lynch and Robinson voting aye on roll call. 'There were no
protests in writing or otherwise to said annexation.
• ORDINANCE NO. 652,.AN ORDINAN ®E providing for the annexation by the City of Yakima of
certain property contiguous to the City of Yakima and zoning the same as R -2, Two Family
Zone. .
This date also being the date fixed for the hearing on the matter of rezoning certain
property at 1201 .South 16th Avenue as requested by Marvin Eberele and the Planning Commis-
sion having recommended the rezone of this property, it was MOVED by Robinson, seconded by
Brown that Ordinance No. 653 providing for said rezone, be passed as read: carried,
Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call.
ORDINANCE NO. 653, AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 1201 South 16th Avenue, in the City of Yakima,
Washington, from R -2, TwoFamily Zone, to R -3, Multiple- Family Zone, and declaring an
emergency.
Petition No. 373 having been filed May 17, 1965 by Barbara K. Small and Mrs. Charles E.
Wilcox requesting the -rezone of property at 414 and 416 North 3rd Street it was MOVED by
Robinson, seconded by Lynch that said petition be referred to the Planning Commission and staff
for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lvnch and
Robinson voting aye by voice vote.
Petition No. 374, 375 and 376 having been filed May 18, 1965 by Lester. O. Beaver and others
requesting the formation of a local improvement district for the construction of curbs,
gutters and the surfacing a portion of. 37th Avenue North of Bonnie Doane and for the con-
struction of sewer and water mains in the same area, it was MOVED by Lambert, seconded by
Brown that said petitions be referred to the City Manager and staff for study and recom-
mendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting
aye by voice vote. .
Moved by. Lambert, seconded by Lynch that Resolution No. D -813 authorizing a Lease Agreement
with West Coast Airlines I to lease additional available space in the Administration
Building, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert', Larson, Lynch and
Robinson voting. aye on roll call.
RESOLUTION NO.-D-813, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to enter into a Lease Agreement wit i West Coast Airlines, Inc.
Moved by Lynch, seconded by Brown that. Resolution No. D - 814 authori the execution of a
Lease Modification Agreement with William F. Janes reducing the area now leased in the
S • Administration building for the balance of tenancy at.the Yakima Municipal Airport, be
passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson
voting aye on roll call.. Discussion indicated that.a letter has been received from Mr.
Janes requesting this reduction in space.
RESOLUTION NO. D -814, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yal,Cima to execute a Lease Modification Agreement with William F. Janes
for property in the Administration Building at the Yakima Municipal Airport.
Moved by Brown, seconded by Lambert that Resolution No D -815 denying a damage claim in the
amount of $594.52 as filed by Percival Lateral, Inc., be pissed as read: carried, Brazier,
Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call.

MAY 24, 1965

The City Attorney having prepared a resolution denying a damage claim filed by Clifford M.
Campbell, said resolution was read but no motion to pass was - made by any council member.
Mr. Campbell being present protested the denial of said claim. He explained that this is
a new unoccupied house and that a break occurred in the line and that the meter was turned
off -for two months and system filled with dirt and sludge after the meter was turned on " .
again and that he could not have filed a'claim until the water was turned on and the
damage occurred. Mr. Glen Perkins, City Mater Department Employee indicated that this line
was not flushed after repairs by city crews. After discussion it was MOVED by Robinson,
seconded by Lynch that this claim be paid: carried, Brown, Kurbitz', Lambert, Larson, Lynch
and Robinson voting aye by voice vote. Brazier voting Nay stating that he can see no •
negligence on the part of the City. (a resolution authorizing payment to be prepared for
the next regular meeting of the City Council on.:June 1, 1965)
On the occassion of the retiring of J. A. Smith from the office of City Clerk, in which
position he has served for the past 10 years, and the office of.Clerk of the Council, in
which position he has served since the inception of the Council- Manager form of City
government in June, 1959, it was MOVED by Robinson, seconded by Brazier that Resolution
No. D -$16 being a resolution of• congratulation and appreciation, be passed as read:
carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll
call. .

RESOLUTION NO. D -$16, A RESOLUTION of . congratulation.and appreciation to James A. Smith. -
The City Engineer reporting the completion of L.I.D. No. 922, Anderson- Wallingford,
Carriage Hill, Lerson's Lot, ;:. 2 Sanitary Sewer District, it was MOVED by Robinson, seconded .
by Lynch that June 21, 1965.be fixed as the date of hearing on the assessment -roll for
said district and that due notice be given by publication and to each property owner as
required by statue: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson
voting aye by Voice vote.
Mr. Clarence Zimmerman attended this meeting and urged the Council to give consideration tc
better enforcement. of the Dog Leash Ordinances by appropriating more money for pers(41 to
enforce said ordinances.
There being no further business to come before the Council,• it was MOVED by Kurbitz,
seconded by Lynch that we do now adjourn at the hour of 4 :35 P.M: carried, Brazier, Brown,
Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote.
