HomeMy WebLinkAbout05/17/1965 Business Meeting • • 2 MAY 17, 1965 The City Council met in regular 2ession, Mayor Larson, Councilman Brazier, Brown, Lambert, Larson and Robinson, City Manager Smith and City Attorney Andrews present on roll call. . It was MOVED by BRAZIER, seconded by Robinson that Councilman Kurbitz and Lynch be excused from attendance at this meeting; carried, Brazier,' Brown, Lambert, Larson and Robinson voting aye by voice vote. The Invocation was given by Councilman Brown. The minutes of the regular meeting of May 10, 1965 having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor. Larson declared said minutes approved as recorded. An Ordinance appropriating the amount of $1,500.00 from unappropriated money in the Current .Expense Fund to Printing and. Advertising of 1965 appropriation for the Statutory and.General Department, having been read in its entirety at the regular meeting of May 10, 1965 and • laid on-the table for one week' was read by title . only at this meeting sand it was MOVED by ROBINSON, seconded by Brown that Ordinance No. 648 providing for said appropriation be passed as read; carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye on roll call. ,Kurbitz and Lynch absent. ORDINANCE NO. 648, AN ORDINANCE appropriating the amount of $1,500.00 from unappropriated money in the Current Expense Fund to Account 115 -240, "Printing and Advertising" of the 1965 appropriation for the Statutory and General Department. • This being the time for the hearing on Resolution No. D-801, being a resolution fixing ' the time and place for hearing on the vacation of a portion of South 16th Avenue through the airport, 'it was-MOVED BY LAMBERT, seconded by Brown that Ordinance No. 649 providing for the vacation of said portion of South 16th Avenue, be passed as read; carried, Brazier, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz and'Lynch absent.. • ORDINANCE NO. 649, AN ORDINANCE providing for the vacation of a portion of South 16th Avenue within the City of Yakima, Washington . • Petition No. 371, having been filed with the City Clerk on May 14, 1965 by Yakima Grange Supply, requesting the paving of a strip of land West of North First Street' and approxi- mately. 200 feet North and parallel to I Street, it was MOVED by ROBINSON, seconded by Lambert, that said petition be referred.to the.City Manager and Staff for study and re- commendation ;.carried, Brazier, Brown, Lambert,Larson, and Robinson voting,aye by voice vote. Kurbitz & Lynch absent. . Petition No. 372, having been filed with the City Clerk on May 17, 1965 by Joe W. Hocker • requesting that property described as follows; Lot 13, Block 8, Broadway Park Addition, be rezoned from R -2, Two Family Zone, to B -1, Modified Business Zone, it was MOVED by • ROBINSON, seconded by Brown that said petition be referred to the Planning Commission for study and recommendation; carried, Brazier, Brown, Lambert, Larson and Robinson voting, aye'on roll call. MOVED by LAMBERT, seconded by Brown,, that Ordinance No. 650, an Ordinance fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in L. I. D. 913, and providing for the issuance of Local Improvement District Installments Notes for payment of the unpaid portion.thereof, be passed as read: carried, Brown, Lambert, Larson and Robinson voting aye on roll call. Kurbitz & Lynch absent. • ORDINANCE NO. 650, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of, the cost of the improvement in Local Improvement District, No. 913, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. • • An Ordinance appropriating the amount -of $3,250.00 from unappropriated money in the garage division to Part Time, Temporary, Overtime and Special Assignment and Rental accounts • of the 1965 appropriation for Garage Division, having been•read in its entirety was ordered laid on'the table for one week to be considered at the next regular meeting of the Council to be' on May 24, 1965. • MOVED by LAMBERT', seconded by Robinson that Resolution No. D 807 , a Resolution of Appreciation to the Central District of Federated Garden Club be passed as read; carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye on roll call..Kurbitz & Lynch abse t. . Bergamini in settlement of a damage claim be passed as read; •carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye on roll call. Kurbitz & Lynch absent. RESOLUTION NO. After full discussion the' Councilmen present wishing to have the entire council vote on this matter, it was MOVED by LAMBERT, seconded by Robinson that this be reconsidered at the next regular meeting of the Council when a full council is expected to be present; carried, Brazier, Brown, Lambert, Larson, and Robinson voting aye by voice vote. Kurbitz and Lynch absent. ** !SEE BELOW) The City Engineer reporting the completion of Local Improvement District No. 907, Horizon Heights Domestic Water Project, it was MOVED by Robinson, seconded by Lambert, that June 14,•1965 at the hour of 3 p.m. be fixed as the date of hearing on assessment roll for said district and that the City Clerk give due notice of hearing by publication and to each property owner as provided by law: carried, Brazier, Brown, Lambert, Larson, and • Robinson voting aye by voice vote. Oxford & Cook • It was MOVED by LAMBERT, seconded by Robinson that said report dated May 12, 1965 be accepted and approved and that estimate therein set forth be approved and payment' authorized; carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote Kurbitz and:Lynch absent. Under new business, Mr. Hay requested outside hook up agreement for city water to his residence on N. Street, which is partly in the city. Mr. Hay informed the Council that he had moved a house from Grandee Lodge to N street to be used as his home.. He said he was advised by the health department that digging a well on this site is questionable because many wells in the area are contaminated. Council suggested that since Mr. Hay's property 'is contiguous to the city, he make application for annexation in order to receive city • services. Council further informed Mr. Hay that outside agreements are reserved for noncontiguous areas onto. Mr. Hay indicated that he did not wish to be in the 'city because building code regulations are too rigid. Council stated these regulations were for the protection of city resixdents. Council wishing more information regarding city regulations in regard to this particular situation, asked that this matter be deferredthr one week. Council/instructed the staff to be in touch with Mr. Hay onthis matter in the meantime, and asked Mr. Hay to be present at next weeks Council meeting for further discussion of this matter::. There being no further business to come before the Council, it was MOVED by Brazier, • seconded by Brown that. we do now adjourn at the hour of 9;15 p.m. carried, Brazier, Brown, Lambert, Larson and Robinson voting aye by voice vote.
