HomeMy WebLinkAbout05/10/1965 Business Meeting • • MAY 10, 1965 . • The City Council met in regular cession, Mayor Larson, Councilmen Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson,, City Manager Smith and•City Attorney Andrews present on roll call. . • The invocation was given by Councilman Lambert. . • t he minutes of the regular meeting of May 3, 1965 having been duly certified accurate by two Councilmen and no.one present wishing to have said minutes read publicly, Mayor Larson .declared said minutes approved as recorded. . This being the time for`the hearing on Resolution No. D- $00, a resolution of in- tention to create a local improvement district for the construction of :a domestic water system, it was MOVED by Lynch, seconded by Brown that. Ordinance No. 645 providing for said improvement and creating L.I.D. No. 939, Powerhouse Road & Others Domestic Water District, be passed as read: carried, Brazier, Brown, Kurbitz, Lam :ert, Larson, Lynch and Robinson voting aye on roll call. Discussion of this matter disclosed two protests filed in writing by Bernard M. Maier and his wife Elba and Arlie R. Lusk who live at 2611 and 26 2 Powerhouse Road respectively.' Mr. Lusk was present at this meeting. ORDINANCE NO. 645, AN ORDINANCE° providing for the improvement of certain property by con- structing the necessary mains, fir.ehydrants, valves and appurtenances for the purpos: of supplying water for domestic use and fire protection ;' establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being the time for the hearing on the assessment roll for L.I.D. No. 919, Nob Hill Shopping Center Sanitary Sewer and there being no protests in writing or otherwise, it was MOVED' by Robinson, seconded by Lambert that Ordinance. No. 646 confirming said. assessment roll and every part thereof, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert Larson, Lynch and Robinson voting aye by voice vote. ORDINANCE NO.•646, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 919 as created and established by Ordinance No. 506 of the Ordinances of the City of Yakima. • Petition N 370 requesting formation of a local improvement district for curbs, gutters and the surfacing of Walnut Street from 45th Avenue to 47th Avenue and 46th Avenue from Tieton Drive to Walnut Street having been filed with the City Clerk on May 3, 1965 by Howard F. Farnsworth and others, it - was MOVED by Robinson, seconded by Lynch that said • petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. An ordinance appropriating $1,500. from the unappropriated money in the Current Expense Fund to the 1965 Budget for the Current Expense Fund, namely for printing and advertising, "- having: been read in its entirety, was ordered laid on the table for one week or until the . regular meeting of the City Council to be held May 17, 19 • Moved by Robinson, seconded by Lambert that Ordinance No. 647 regarding street planting and amending the Yakima. Municipal Code, be passed as read. • MOVED by Robinson, seconded by Lambert that said ordinance be amended as follows "Section 5; subsection (b) The beautification endeavor may be sponsored by a group or association and may be on a group basis, area basis or district basis, but nothing contained herein shall prohibit individua property onwers from beautifying only that segment of the street right -of -way abutting their individual properties, provided, however, that abutting property owners shall be notified by the applicant of applicant's intention to undertake the project prior to the • . time application is made." Discussion indicates that the Metropolitan Park Board has agreed to take on certain responsibilities as set forth in this ordinance. ORDINANCE NO. 647, AN ORDINANCE relating to streets and sidewalks.; authorizing the plant- ing of trees and shrubs in public rights of way and requiring a permit therefor; prescrib- ing conditions and regulations applicable thereto; declaring violations to be misdemeanors and providing a penalty; adding a new section numbered 8.16.005, and amending Sections E. 8.16.010, .020,.030, .040 and .050. of the City of Yakima Municipal Code. Mr. Howard Hettinger, Attorney representing this petitioner being present, requested that the emergency clause be used in the preparation of this ordinance, since his client is anxious to complete a 10 unit apartment house before school starts next september.
