Council- men Brazier and Kurbitz absent. MOVED by Robinson, seconded by Brown that Councilmen • Brazier and Kurbitz be excused from this meeting:. carried, Brown, Lambert, Lynch and Robinson voting aye by voice vote. Councilman Lynch gave the invocation. ° • The minutes of the regular meeting of April-26, 1965 having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. • • In accordance with action taken by the City. Council at their regular meeting of April 26, 1965, it was MOVED by Brown, seconded by Lambert that Resolution No.•D1803 authorizing the execution of contracts with Larry Smith and Company, Lewis - Redford Engineers and Architects Associated for profession planning services be passed.as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier and Kurbitz absent. RESOLUTION NO. D -803 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute contracts with Larry Smith & Company, Lewis- Redford Engineers, and Architects Associated bf Yakima for professional planning services. • •This being the time for the hearing on the assessment roll for L.I.D. No. 91$, Nob Hill Shopping Center Domestic Water District, and there being no protests in writing or other- wise, it was MOVED by Robinson, .seconded by Brown that Ordinance No. 642 confirming said assessment roll and every part thereof, be passed as read: carried, Brown, Lambert, Larsor. • Lynch and Robinson voting aye on roll.lcal "l. ORDINANCE NO. 642, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 91$ as created and established by Ordinance No. 505 of the Ordinances of the City of Yakima. This being the time for the hearing on the Assessment roll for L.I.D. No. 924, Nob 'Hill and South 24th Avenue Paving District, it was MOVED by Lynch, seconded by Brown that Ordinance No. 643 confirming said district and every part thereof, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier and • Kurbitz absent. Discussion disclosed that two written protests have been filed with the City Clerk namely by Mr. N. Ackerman and K.A. Carner protesting the work done in this district and the cleanup work left undone by this contractor. Public Works Director Mayo . indicated that he prefers not to make a recommendation at this time concerning remedial work to be done, but did offer copies of letters to the Council written by the staff which set forth what is expected of this contractor. Mr. Seipp, Mrs. Richardson and Mr. & Mrs. Ackerman were all present at this meeting. ORDINANCE NO. 643, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 924 as created and established by Ordinance No. 544 of the Ordinances of the City of Yakima. _ Ill Petition No. 365 as filed by M. D. Brown and others requesting rezone of property at 2009 to approximately 2109 Lincoln Avenue North; 'Petition No. 366 as filed. by Yakima Gospel Hall Inc., and others requesting the vacation of property between Bell 'and Tieton Drive and East of 44th Avenue; Petition No. 36$ as filed by Joe Hocker and others requesting the vacation of the alley directly east o.f.Lot 13, Block $ Broadway Park Addition 2 and • Petition No. 369 as filed by Grant Handlos requesting the vacation of Lot 7, Block 2• • Applewood Manor, all having been.file'd with the City Clerk on April 19, April 2$ and 29th • respectively, it was MOVED by Lynch, seconded by Brown that said petitions be referred to the City Manager and Planning. Brazier and Kurbitz absent. • Petition No. 367 having been filed with the City Clerk April 2$, 1965 by John G. Fairbrook and others requesting the construction of curbs, gutters and the surfacing of the North 1/2 of Douglas Drive from North 44th Avenue to 300 feet east thereof, it was MOVED by Lynch seconded by Robinson that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz. absent. .Section 101, 102 and 103 entitled Title, Purpose and Scope of the Uniform Building Code, .1964 Edition Volume I, having been read in full before the consideration and passage of • the Ordinance adopting by reference said code, it was MOVED by Lynch, seconded by Lambert • that Ordinance No. 644 relating to building regulations and adopting by reference the Un.i form Building Code 1964 Edition and amending and adding certain sections td the Yakima Municipal Code, be passed as.r.ead carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by roll call vote. Brazier and Kurbitz absent. • • ORDINANCE NO. 644, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1964 Edition, Copyright.1964 by the International Conference of Building Officials, regulating the erection, construction, enlargement, alteration, repair, moving removal, conversion, demolition, occupancy, equipment, use, height, area and main- tenance of•buildings or structures in the City of Yakima; providing for the issuance of permits and collection of fees therefor; providing penalties for the violation thereof; amending Sections 11.04.010, .020 and .030, and adding Sections 11.04.040, 050, .060 and .070 as new sections, all of the City of Yakima Municipal Code. Moved by Robinson, seconded by Lambert that Resolution No. D -$04 authorizing the purchase of equipment and hiring of services for rebuilding of two comminutors at the Yakima Sewage Treatment Plant, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson • .voting aye on roll call. Brazier and Kurbitz absent. • RESOLUTION NO. D -804, A RESOLUTION authorizing the purchase of equipment and the hiring of services without calling . for bids. • The City of Yakima being a member of the Statewide City Employees Retirement System and • said retirement system requesting payment of v$84.47 in accordance with 41.44.210 R.C.W. - Death in line of duty benefit, which provides for payment of $1,000.00 death n.line of Duty benefit, it was MOVED by Lynch, seconded by Brown that said $84.47 be de'eucted from the Release Matching Funds now on deposit with said Retirement System for the City of Yaki a: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. • • 3j • • • MAY 3�, 1965 • CH Consulting Engineers having presented for payment, Monthly Estimate No. 12 on the Sewage Treatment Plant Additions under the •contract - _of G. R. Leischner and an error in the Sales Tax having been corrected*to read 41;266.05 and the amount due having been ad- justed.to 373 it was MOVED by Robinson, seconded by Lynch that said report dated April 26, 1965 be accepted as corrected and Estimate No. 12 as therein set forth be approved as corrected and payment of $73,63.$.21 is hereby authorized for payment: carried. Brown Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent The City Engineer reporting the final estimate, estimate No. 12, for payment on the Lenox Avenue *Overcrossing, it was MOVED by Lynch, seconded by Robinson that said report dated April 2$, 1965 be accepted and approved and that the Final Estimate in the amount of $74,135.65 payable to Dale M. Madden be approved and payment authorized :: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. Kimball '36,714.60 • De Blasio Brothers 45,413.16 • • Totem Excavators Inc. 49,699.00 ' Oxford and Cook 51,$19.77 • for the construction of Sanitary Sewers as provided in L.I.D. No..935“South 8th Avenue Sanitary Sewer and L.I.D. No. 93$, Blossom Hill & Other Sanitary Sewers and the City Engineer recommending the bid of N': L. Kimball as the lowest and best bid, it was MOVED by Robinson, seconded by Lambert that said bid in the amount of $36,714.60 be awarded to N. L. ^ Kimball for the construction of sanitary sewers as provided for in L.I:.D. No. 935 and 93$ and the City Manager be and is hereby authorized to enter into a contract with • said contractor on behalf of the City of Yakima upon the filing of the proper bond and in- surance:: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. • • Manager Smith having requested permission to send Police Officer, Richard CI.ark. to Sparks Nevada to a Western States Crime Conference to be held May 11, 1965 to May 15, 1965 and estimating the expense of this trip at $100.00, it was MOVED by Robinson, seconded by • Lynch that Officer Walker be allowed to attend this conference with expenses paid: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
