The City Council met in regular session, Mayor Larson, Councilmen Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson,'City Manager and City Attorney Ahdrews present on roll call. . III The invocation was given by Councilman Brazier. The minutes of the regular meeting of April 12, 1965 having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Consideration•of the referendum petitions against Ordinance No. 625 relating to Cable Television was brought on for discussion. and Mayor•Larson explained that there is one of three things that may be done in this matter; (1) repeal Ordinance No. 625, (2) submit • this ordinance to the qualified voters of the City at the next regular City election in 1967 or (3) hold a special election as soon as possible. In order to get this matter be- fore the Council for discussion, it was MOVED by Brazier, seconded by Lynch that the City Attorney prepare a resolution for the next regular meeting of the Council authorizing and • providing for a special election on Ordinance No. 625. Mr. J. S. Applegate,.Attorney representing Cable TV of Yakima Valley, Inc. spoke for said motion and introduced Mr. • Robert L. De Pietro, Manager of said TV Company. Mr. Applegate indicated that this company . will bring in 12 TV Channels plus FM background music, 24 hour weather service, three complete' net works, full schedule of Canadian programming, two independent stations whose • programs are not net work, plus service to schools and service in color. Council members indicated that they would not be in favor of accepting gifts of electioncosts from in- dividuals, companies or corporations. All persons having been heard, Mayor Larson called • for a roll call vote°onc'the motion and it carried: Brazier, Brown, Kurbitz, Larson a.nd • Lynch •voting :.aye on roll calla Councilmen Lambert and Robinson disqualified themselves and did not vote. Councilmen Brazier and Kurbitz indicated that they will be unable to . attend the next regular meeting of the City Council and City Attorney Andrews stated that the majority of thos e present can pass the resolution as ordered and that people not voting as in the case of Councilmen Lambert and Robinson, are deemed to be voting with the majority., . Moved by Robinson, seconded by Brown that Resolution No. D -$00 being a resolution of • intention 'to improve certain property by the construction of a domestic water system and • fixing the date of hearing on said resolution for.the 10th day of May, 1965 and repealing Resolution No. D -79$, be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson Lynch and Robinson voting aye on roll call. (This resolution corrected to include the legal description of property at 2604 Power House Road.) • RESOLUTION NO. D'4$00, A RESOLUTION of intention to create a local improvement district, and repealing Resolution No. D -798. . • Petition No. 362, 363 and 364 having been filed with the City Clerk April 14, 1965, re- questing -the formation of local improvement districtsfor the construction of domestic .water .system, sanitary sewer and curbs, gutters.and the surfacing of streets, all in High View Plat, it was MOVED by Lynch, seconded by Lambert that said petitions be. referred to . the City Manager and staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. . Moved by Lynch, seconded by Brown that Resolution No. D -$O1 fixing the time for hearing . on the matter vacating a porti� of 16th Avenue for the 17th day of May, 1965, be padded as read: carried, Brazier, grown, Lambert, Larson, Lynch and Robinson voting aye on roll call. :04-; (caption ':on page 17) . A resolution having been prepared authorizing proceedings regarding certain Tahoma Cemetery Property (Damaskos) and it having been reported that there is possibility that this matter . may be settled outside of said proceedings, it was MOVED by Robinson, seconded by Brazier that this matter be postponed indefinitely: carried, Brazier, Brown, Kurbitz, Lambert • Larson, Lynch and Robinson voting aye by voice vote. The Planning Commission having indicated that action has been tabled on Petition No. 353 as filed by Marvin Eberle, said petition requesting the rezone of property located-at 1201 • South 16th Avenue and Mr. Howard Hettinger, attorney representing Mr. Eberle, having filed an appeal from the decision of the Planning Commission with the City Clerk on the 14th day of April, 1965 and being present at this meeting explained that he believes that the Planning. Commission is without authority to take this action, that such action is causing his client delay'in building a 10 unit apartment building for college students. Council members pointed out that there is nothing that the City Council can do at this point in this procedure. No formal action was taken at this meeting on this matter. A vacancy having been created•on the Planning Commission by the resignation of Mr. Jim Cowan it was MOVED by Lambert, seconded by Lynch that Mr. Ellis Cummins be appointed to fill the unexpired term of Mr. Cowan or.until August 31, 1968: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. . . Upon the recommendation of Manager Smith, it was MOVED by Lynch, seconded by La.mbert'that Mr. Mat Young, Assistant Fire Marshall be allowed to attend the Arson Seminar to be held in Portland, Oregon on May 17, 1965 through May 21, 1965 and that his expenses be paid: III carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Manager Smith estimated expenses at approximately $100.00.
