The City Council met in regular session, Mayor Larson, CouncilmanBrazier, Brown, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith present on roll .call. City Andrews noted absent. . The invocation was given by Councilman Lambert. The Minutes of the regular meeting of April 5, 1965 having been read and certified accurate by two Councilmen and no one wishing to have said minutes read at this meeting, Mayor Larson declared them approved as recorded. This being the time fixed for the hearing on Resolution D -786, a resolution of intention to improve property in Blossom Hill Addition and others for the construction of Sanitary Sewer and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Lambert that Ordinance No. 637, providing for said improvement and creating L. I. D. 938 as requested per petition No. 337, 339, and 348 be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by roll call. Brown not voting. . ORDINANCE NO. 637, AN ORDINANCE providing for the improvement of certain property by constructing a.pipe sewer with the necessary wye branches and manholes; establishing . a Local Improvement District providing for the method of payment thereof, and creating a special fund. Petition No. 360, having been filed with the City Clerk on April 7, 1965 by L. I. Larson and Harold R. Sanford requesting the formation of t Local Improvement District for the construction of pavement at the West half of North 35th Avenue from Englewood Avenue South to existing pavement , it was MOVED by Robinson, seconded by Lynch that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by roll call. A Notice of Intention to commence annexation proceedings having been filed with the City Clerk on April 12,1965 by L. I. Larson and Harold Sanford praying for the annexa- tion of property described as Lot 1, the Ontario Land Co. Subdivision, Section 22, Township 13 North, Range 18 E. W. M. Vol B Page 60, and the signers of said notice being present at this meeting, it was MOVED by Robinson, seconded by Lambert that this date ' April 12, 1965 be set as the time of meeting with the initiating parties, said parties being L. I. Larson and Harold Sanford: carried, Brazier, Brown, Kurbitz, Lambert, Larson Lynch, and Robinson voting aye by voice vote. The Initiating parties, L. I. Larson and Harold Sanford having stated to the Council that they will assume their - share of the city's existing indebtedness, it was MOVED by Robinson, seconded by Brown that the annexation proposed by said parties be accepted by the City of Yakima and that the area to be annexed be required to assume its share ill of the City's existing indebtedness: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson.voting aye by voice vote. L. I. Larson and Harold Sanford having filed petition for annexation with the City Clerk at this meeting, said petition being Number 361, it was MOVED by Brown, seconded by Lambert that said petition be referred to the City Manager and Planning Commission for study and recommendation: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. MOVED by Robinson, seconded by Brown that Ordinance No. 638 and ordinance relating to traffic regulations regarding the operation of trucks in the business district be passed as read: in discussion, Councilman Robinson Moved, and it was seconded by Lynch that the term Central Business District be amended to read Core Business District which would better define the business district as described in this ordinance: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye Mayor Larson then called for a roll call vote on the origianal motion;/ carrie, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Mr. H. A. . O'Reilley, representing the Labor unions was present for discussion of this ordinance. ORDINANCE NO. 638, AN ORDINANCE relating to traffic regulations; restricting the operation of certain vehicles in the Core Business District; and adding Section 9.56.070 as a 1 new section of the City of Yakima Municipal Code. . MOVED by Lynch, seconded by Lambert, that Ordinance No. 639, an Ordinance fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in L. I. D. No. 917, South 16th Avenue Arterial Improvement, and providing for the issuance of Local Improvement District installment notes for the payment of the unpaid portion thereof be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 639, AN ORDINANCE fixing the time of delinquency of installments of assess - ment levied for the payment of the cost of the improvement in Local Improvement District No. 917 and providing for the issuance of Local Improvement District Installment Notes . for the payment of the unpaid portion thereof. MOVED by Brown, seconded by Lambert that Ordinance No. 640, an ordinance fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in L. I. D. No. 920, Tieton Drive and South 34th Avenue to approxi- mately 42nd Avenue Paving District, and providing for the issuance of Local Improvement Distkict Installment Notes for the payment of the unpaid portion thereof, be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 640, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 920, and providing for the issuance of Local Improvement District Installments Notes for the payment of the unpaid portion thereof. Robinson that the City Council authorize the release of administrative expense in the amount of $3,577.24 from funds on deposit with Statewide City Employees Retirement System: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. . /Under new business, the City Clerk presented a certificate to the Council certifying that on the 9th day of April, 1965, Ted Roy, Attorney at Law filed with the Clerk, petitions relating to the enactment of Ordinance No. 625 which provides or the licensing of community antenna television systems in the City of Yakima ancrequesting that the City Council take such action as provided odor under Article 4, Section 3 of the Yakima City . Charter. The city Clerk further certified that 6,740 votes were cast at the last City General Election held on the 10th day of March, 1964; and that the number of signers on said petitions is approximately 1,000 of which signers, 725 are qualified electors, which constitutes more than 10 percent of the total number of votes cast at the last l preceding City General Election. With reference to the petitions filed, Mr. Robert DiPietro, Manager of Cable TV of Yakima Valley, read a letter from his company stating that as a result of this petition, the public will be delayed in getting the right of multiple- choice television, and urged the Council to press for a special election if the best interests of the public are to be served, we cannot deny multiple- choice television in Yakima. The letter stated delay is . costly, but more important, delay in depriving the people of Yakima that towwhich they are absolutely entitled, multiple - choice television. Mr. Halverson, Attorney at Law, representing Cable TV was in attendance. No action was taken on this matter Councilman Kurbitz made the statement that he was sorry that it was impossible for him to attend all of the meetings in which Cable TV was discussed. Inc. having requested the City of Yakima to install at the warehouse in Gleed, two fire hydrants in addition to the two already on the premise, as the Fire Insurance Underwriters had requested this; and Nordberg - Westberg Fruit Co. having stated that they are willing to pay for the cost of installation and the monthly service fee, it was MOVED by Lynch, seconded by Brown that this request be granted; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Fred E. Hammerstad, representing United Builders, having requested outside city sewer service for a proposed housing development named Glen Haven described• legally as follows: part of the EZ of the wz of the SE4 of the NE% of Section 28, Township 13 North, Range 18 E.W.M and Mr..Hammerstad having stated a proposed annexation is intended for this area within the next year, it was. MOVED by Kurbitz, seconded by Lynch that this request be granted; carried, Brazier, Brown, Kurbitz, Lambert, Larson, &Lynch voting aye by voice vote. Robinson abstained from voting. City Manager Smith announced that from April 19th through the 30th, the City Sanitation Department will have its annual pickup of brush and trash in the residential areas of the city. City Manager Smith called to the attention of the Council a letter from the),Code Study Committee in which they stated that it was the unanimous decision of the Committee to recommend that the City Council adopt the 1964 Edition of the Uniform Building Code of the International Conference of Building Officials by reference, as the building code of the City of Yakima, with additions and alterations as recommended by the Code Committee.
