HomeMy WebLinkAbout03/15/1965 Business Meeting • 1 March 15, 1965 The City Council met in regular session, Mayor Larson, Councilman Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson, City Manager and City Attorney Andrews present on roll call. . • The INVOCATION was given by Councilman Brazier. The Minutes of the regu]ar meeting of March 8, 1965 having been certified accurate as read by two Councilmen and no one wishing to have said minutes read at this meeting, Mayor Lar- son declared them approved as recorded. MOVED by Brazier, SECONDED by Kurbitz that Resolution No. D -779 , a resolution of con- gratulations to the Marquette High School Squires Basketball Team for winning the State "A" high school basketball tournament for 1964 -65: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. At this time, Mayor Larson deferred matters on the regular.agenda:: called-on the Rev. Joe Denman, Pastor of Mt. Hope. Baptist Church and the Chairman of the Citizens for Progress Committee of Yakima to speak. The Executive Committee of this group, as well as other interested persons, were present at this meeting. Rev. Denman asked the Council for leader- ship in helping the negro in our community.to secure their constitutional rights in equal opportunities in employment, education and housing. He asked the Council to answer the following questions by a formal statement as soon as possible. 1) What is the community doing to improve living . conditions for the negro in Yakima? Rev. Denman stated that it is difficult for them to buy property West town, and it is difficult to secure conventional loans for place in which they are permitted to live. 2) What access will the negro have to the money being provided by the Presidents poverty program? Rev. Denman stated they need help along this line. 3) Is the Council in favor of the Fair Housing Bill? Rev. ; Denman wondered if a negro who is financially able could buy property on the West side in the City of Yakima. 4) What is the Council's . viewpoint on the situation in Alabama? Rev. Denman stated that the leaders of the community have not made a public statement re- garding this. 5) Is the Council aware of racial prejudice in the community, explain what it is and tell what they are doing about it? 6) Who is responsible for the in- dustrial proess for the city of Yakima? Rev. Denman stated the negro citizens of Yakima must travel but of the city 100 miles or more to work. They want the opportunity to work in Yakima. 7) Is it permissable for Negroes employed in the City Sanitation Department to be promoted to another department of the City. In conclusion, Reverend Denman thanked the Council for their attention, and said that it was not necessary to have demonstrations in Yakima when the negro is free to come to Council meetings and express their 'views and be heard. Mayor Larson thanked Rev. Denman and his group for coming, and stated they are always welcome to express their views to the Council. He further stated that the Negro people have many friends in our community. Mayor Larson asked Rev. Denman to submit a written copy of the questions to the Council and they would try to answer them - This being the time set by the Council for the hearing on Resolution No. D -775, an Intention to Improve certain property by the construction of Sanitary Sewers on South 8th Avenue, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 628 creating Local Improvement District No. 935, , and providing for said improvement by construction of Sewer be passed as read: In discussion, Mrs. Thecla Regimbal and others favored this improvement. There being no protests in writing or otherwise for said improvement, Mayor Larson asked for a vote on the motion: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robin- son voting aye on roll call. ORDINANCE NO. 628, AN ORDINANCE providing for the improvement of certain property by con- structing a pipe sewer with the necessary wye branches and man holes; establishing a Local • Improvement District, providing for the method of payment thereof, and creating a special fund. PETITION NO. 347, having been filed with the City Clerk on March 15, 1965 by Jerry E. Garrison and others, requesting the formation of an L. I. D. for the paving of Casa Courts from 39th Avenue East 231 feet; and PETITION NO. 348, having been filed with the City Clerk on March 15, 1965 by Bruce Glenwood Corporation requesting the formation of an L I D for the construction of Sewer on Glenside North of Tieton, it was MOVED by L'YNCH;T Seconded by BROWN that said petition be referred to the City Manager and staff for study and recommendation:,carriec4 Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. An Ordinance appropriating $3,000.00 to the 1965 Budget for Irrigation Fund having been read in its entirety was ordered laid on the table for one week, to be considered at the next regular meeting of the Council to be held on the 22nd day of March, 1965 at the hour of 3 p.m. MOVED. by LYNCH, SECONDED , by ROBINSON that Ordinance No. 629 an Ordinance fixing the time of delinquency of installments levied for the payment of the cost of the improvement in L. I. D. 909, South 38th and 40th Avenues and various others paving district, and providing for the issuance of L. I. D. installment notes for payment of the unpaid portion thereof be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 629, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 909 and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. MOVED by ROBINSON, seconded by BROWN that Resolution No. D -780 a resolution authorizing the payment of $20.00 Mrs. S. M. Rummel in settlement of a damage claim be passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. . . RESOLUTION NO. D -780, a resolution authorizing the payment of $20.00 to Mrs. S.M. Rummell in settlement of a damage claim. R. Larson and others and fixing the time of hearing on the 5th day of April 1965,be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D -781, a resolution of intention to create a Local Improvement District. MOVED by BROWN, seconded by LYNCH that Resolution No. D -782 being a resolution of intention to create a Local Improvement District for the Construction of Water Mains in Tri Skool addition as requested on Petition No. 342 as filed by Lester O. Beaver and others, and fixing the date of hearing on the 5th. Day of April at the hour of 3 p.m. beppassed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on - roll call. RESOLUTION NO. D -782, a resolution of intention to create a local improvement district The Planning Commission having reported on Petition No. 315 as filed by Paul T. Findley for rezone of certain property located on 31st and 32nd Avenue, it wassMOVED by LYNCH, seconded by LAMBERT, that April 5, 1965, be set as the time of hearing by the City Council on the matter of said rezone, and that the City Clerk give notice of such hearing as re- quired by law: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The Planning Commission having reported and having recommended annexation to the city of Yakima property located South of Nob Hill Blvd. between 44th Avenue and Glenside, and having recommended this parcel be rezoned from R -1, Single Family Zone, except for the Northerly 265 feet to be zoned R -3, Multiple Family zone, it was MOVED by ROBINSON, secondei by LYNCH, that the petition for annexation filed by John G. Fairbrook and Chester S. Meyer as per petition. No. 331 be approved as meeting the requirements of law, and that an order be prepared fixing March 29, 1965 at the hour of 3 p.m. as the time for a public hearing by the City Council on said petition: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by .voice vote. The Planning Commission reporting and having recommended annexation to the City of Yakima, property located North of Fruitvale Blvd. between North 8th and North 16th Avenues, and the Commission having recommended an M -1 Zone classification for the area owned and occupies; by the Pacific Power and Light Corporation yard; and R- 4(Suburban residence) zone for the main central portion of the area, presently occupied by a majority of the residences and orchard and pasture land; a B -3 (General Business) zone for the area adjoining Fruitvale Blvd. to provide for the expansion of highway oriented commercial development, it was MOVED by ROBINSON, seconded by BROWN, that the Petition for annexation as filed by Robert L. Alderson and others, being petition No. 332 be approved as meeting the requirements of law; that the City Manager and the Mayor be authorized to convene a review board, as re- quired by law, for a hearing and review of this proposed annexation; and that an order be prepared fixing the date of April 5, 1965, at the hour of 3 p.m. as the time for a public hearing by City Council on this petition; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lyncia and Robinson voting aye by voice vote. With reference to the Planning Commission's report on changing the names of four east -west arterials, the Planning Commission asked the Council to defer action on the matter at this time, as they have had a request from the County Commissioners asking to discuss this in more detail with the Planning Commission and the Yakima Chamber of Commerce. It was MOVED byROBINSON, seconded by LYNCH that this matter be deferred until a later date: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Smith, City Manager Gladys Richter, City Treasurer it was MOVED by ROBINSON, seconded by LYNCH, that said report dated February 28, 1965 be accepted and approved: carried, Brazier, Brown, Kurbitz, Lambert, Lambert, Lynch, and Robinson voting aye by voice vote. 4 MARCH 15, 1965 Under new business, Mrs. Louise James, Secretary of the Yakima Chapter of the NACP informed the Council that her group is planning neighborhood clean up work in some of the areas in the city where it is needed. She asked the Council if they would allow the use of city garbage trucks to help pick up the refuse after clean up work is completed. She requested that welfare workers be allowed to help in this project. Mrs. James also brought to the attention of the Council that certain property in the city limits of Yakima has deteriorated buildings on the premise which she felt should be demolished because they are dangerous and unsightly. One piece of property discussed was rezoned last year for the construction of a sign company and is located south of East Yakima Avenue facing the freeway. The owner has not utilized this property for this purpose. The other property discussed is NORTH of East Yakima Avenue, facing the freeway. Council suggested that steps be take by the staff to contact the owners to see if they will correct this condition. It was the MOVED by Lynch, seconded by Lambert that the City Manager and staff survey the situation as described, and that they make recommendations as to what legal procedure can be taken to remedy this situation; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch. and Robinson voting aye by voice vote. Councilman Brazier commended Chief Moore and his Fire Department for the excellent work done in preventing a serious fire at the Cascade Mill this past week. City Manager Smith reported that a letter had been received from the Corp of Engineers stating that they could not help us at this time in aid for flood control for the area near the sewage plant because of lack of adequate funds to do so. City Manager Smith informed the Council that the meeting of the Executive Committee of the Association of Washington Cities, of which Mayor Larson and Councilman Robinson are members, is being held in Olympia, March 16, 1965. The important matter of financial re- lief to cities through state legislation will be discussed.
