A RESOLUTION authorizing and directing the City Manager and City Clerk of the
City of Yakima to execute a Purchase and Sale Agreement with
Yakima County.•

WHEREAS, property was acquired by the County,�of Yakima for lack of other
bidders at a tax foreclosure sale; and

WHEREAS, RCW 84.64.320 authorizes the Board of County Commissioners to
dispose of tax foreclosure property to another governmental agency by means, of
private negotiation for such consideration as may be deemed by the Board of County
Commissioners to be adequate, but not less than the principal amount of the unpaid
taxes; and
WHEREAS, the City of Yakima has offered to purchase said property from
Yakima County for the sum of $569.73; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to purchase this proPerty, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby authorized and directed to execute
a Purchase and Sale Agreement with Yakima County, Washington, for the following
specific parcel of land:
Natches Orchard tracts, that part of lot 8 lying West of Franklin Ave,
North of P. P. & L. Company, records of Yakima County, Washington.
(Yakima County Assessor's Parcel No. 181315-44416).
The City Manager is hereby authorized and directed to take all necessary steps to
proceed with the purchase of said property and with the closing of this real estate
transaction.

PURCHASE AND SALE AGREEMENT
This Agreement is made and entered into this day of
199_, by and between the COUNTY OF YAKIMA, a municipal corporation of
the State of Washington, whose address is 128 North Second Street, Yakima,
Washington 98901 (hereafter referred to as "Seller") and the CITY OF YAKIMA,
a municipal corporation of the State of Washington, whose address is 129
North Second Street, Yakima, Washington 98901 (hereinafter referred to as
"Purchaser"), WITNESSETH:
IT IS MUTUALLY AGREED by and between the parties hereto as follows:
Section 1. Purchase and Sale of the Property.
Seller hereby agrees to sell and Purchaser hereby agrees to purchase,
subject to and on the terms and conditions hereinafter set forth and for the
price hereinafter fixed, certain real property in Yakima, Yakima County,
Washington, legally described as follows:
Natches Orchard tracts, that part of lot 8 lying West of Franklin
Ave, North of P.P. & L. Company, records of Yakima County,
Washington.
(Yakima County Assessor's Parcel No. 181315-44416).
and graphically shown on the print marked Exhibit A, attached hereto and
hereby made a part hereof. The sale property shall be referred to as the
"Property."
It is understood that the sale and conveyance made pursuant to this
Agreement shall be subject to any and all applicable federal, state, and local
laws, orders, rules, and regulations.
Section 2. Purchase Price.
The purchase price for the Property to be paid by Purchaser to Seller
shall be the sum of Five Hundred Sixty -Nine Dollars and Seventy -Three Cents
($569.73) ("Purchase Price").
Section 3. Payment of the Purchase Price.
At the time of closing of escrow, Purchaser shall pay to Seller the entire
Purchase Price in cash or by City of Yakima Warrant.

Section 4. Closing.
Closing of this transaction shall take place within twenty (20) days after
execution of this Agreement by all parties at the office of the Yakima County
Prosecuting Attorney.
Section S. Title.
Upon closing of escrow as set forth in Section 4, title to the Property shall
be conveyed by Seller to Purchaser by a duly executed Tax Title Property Deed.
Title to the realty shall be in fee simple and clear of all liens, encumbrances,
exceptions, and reservations other than the following:
(1) Rights reserved in federal patents or state deeds;
(2) Building or use restrictions consistent with current zoning, other
than government platting and subdivision requirements;
(3) Utility easements.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement
as of the date first herein written.

WHEREAS, the following described real property was acquired by
the County for lack of other bidders at a tax foreclosure sale:
Natches Orchard tracts, that part of lot 8 lying West of
Franklin Ave, North of P.P.&L. Company, records of Yakima
County, Washington.
Parcel no. 181315-44416; and,
WHEREAS,

has offered to purchase the above-described real property from Yakima
County for the sum of $569.73, which sum is greater than the principal
amount of unpaid taxes.
NOW, THEREFORE, BE IT HEREBY RESOLVED that $569.73 is deemed
adequate compensation to the County from the City of Yakima for the
following described property:
Natches Orchard tracts, that part of lot 8 lying West of
Franklin Ave, North of P.P.&L. Company, records of Yakima
County, Washington.
Parcel no. 181315-44416; and,
BE IT FURTHER RESOLVED that the Chairman of the Board of Yakima
County Commissioners is hereby authorized to execute all documents,
including conveyances, necessary to complete the sale authorized
herein. j

SUBJECT: Parcel for Canal Pathway (#18131544416)

We have been able to reach an agreement with the County of Yakima
regarding parcel #18131544416. The County has pulled the parcel
off of the auction list and we will pay the minimum bid price to the
County of $569.73. We will be paying for this parcel out of Fund
392. Ron Zirkle with the Prosecuting Attorney's Office, County of
Yakima was able to get this taken care of today. Our
recommendation is that you approve this purchase for the use in the
Canal Pathway, that will start construction in the Spring of 1996.

of the statues of the state of Washington, in such cases made and

Subject: Powerhouse Canal Pathway
We have discovered a "pending" contract in our 1995 files for
which, it appears, we have never received the original executed
contract. It is our Contract #95-136 (Resolution No. R-95-187)
covering the Purchase and Sale Agreement with Yakima County for
the Canal Pathway Project.
I have attached a copy of what we have in the pending file, hoping
it will help. Could you please check your records and advise
what you know about the status of this outstanding contract. Do
you, by chance, have a signed copy?
