HomeMy WebLinkAboutR-1995-160 HDR Engineering, Inc.RESOLUTION NO.R-95- 160 ARESOLUTION authorizing the execution of Contract Amendment #1 for professional engineering services between the City of Yakima, a municipal corporation, and HDR Engineering, Inc. WHEREAS , the City of Yakima owns and operates wastewater collection and treatment facilities in accord with applicable Federal, State and Local regulations; an d WHEREAS, the City has identified the need for specific engineering services to accommodate currently planned and financed projects; and WHEREAS, the City has completed the process of competitively selecting professional engineering services solely by virtue of qualifications in compliance with applicable State requirements for acquisition of professional services; and WHEREAS, HDR Engineering, Inc. has been previously selected to provide professional wastewater engineering services in response to continuing environmental mandates, community growth, Yep!?cement needs, and operational efficiencies; and WHEREAS, the City and HDR Engineering have entered into a contractual relationship via City contract #93-115 and authorized by Council Resolution R-93- 146; and WHEREAS, the City and the Engineer anticipated a contract amendment to define and authorize necessary services in the areas of design, bidding and construction administration services; and WHEREAS, an agreement with HDR Engineering, Inc. to provide these services to the City of Yakima is in the best interest of the City of Yakima, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk are hereby authorized to execute the attached and incorporated Contract Amendment #1 for professional wastewater engineering services with HDR Engineering, Inc. for the City of Yakima. Mayor ATTEST: City Clerk 11/15/95 cw hdr amendment resolution November 15, 1995 cw AMENDMENT NO. 1 TO THE AGREEMENT BETWEEN CITY OF YAKIMA, WASHINGTON AND HDR ENGINEERING, INC FOR PROFESSIONAL SERVICES THE AGREEMENT dated December 23, 1993 by and between the CITY, City of Yakima, Washington and the ENGINEER, HDR ENGINEERING, INC., is hereby amended as set forth herein. WITNESSETH: WHEREAS, the City and the Engineer have entered into a contract for professional services related to upgrading the City's existing wastewater treatment facility , herein referred to as the "Project"; WHEREAS, the City has agreed to have the Engineer provide the extra services as described in the attached Contract Amendment No. 1; and WHEREAS, the agreement contains provisions in Section 2, for the City to authorize extra work in connection with this Project; NOW THEREFORE, in consideration of the terms, conditions and covenants of performance contained or incorporated herein, the City and the Engineer agree that the Agreement shall be amended as follows: I. EXHIBIT A - SCOPE OF WORK A. Paragraph 1.2 - Study and Report Phase 1. Add subparagraph 1.2.5.12 which reads as follows: "1.2.5.12 Plant Capacity Study - A technical memorandum addressing hydraulic, biological and solids capacity of each unit process in the facility Yakima Contract Amendment No.l November 15,1995 1 will be presented in a tabular format." 2. Add subparagraph 1.2.5.13 which reads as follows: "1.2.5.13 Geotechnical Services - Provide a technical report for the following tasks: • Geotechnical conditions at new headworks facility. • Geotechnical conditions at secondary clarifiers and primary digesters. • Geotechnical conditions beneath aeration basins." B. Paragraph 1.4 - Design Phase - Construction Documents 1. Add subparagraph 1.4.1.4 which reads as follows: "1.4.1.4 Prepare plans and specifications for the prepurchase of bar screens and grit equipment." 2. Add subparagraph 1.4.1.5 which reads as follows: "1.4.1.5 Prepare plans and specifications for the repair/replacement of leaking hot water supply and return piping at the wastewater treatment facility and for the addition of sludge grinders to the feed to the primary digesters and centrifuges. Project shall be known as Mechanical Improvements." 3. Add subparagraph 1.4.1.6 which reads as follows: "1.4.1.6 Prepare plans and specification for a heavy electrical maintenance contract for the facility's electrical equipment." 4. Add the following subtasks to subparagraph 1.4.1.3.1, Digester Improvements, which read as follows: "■ Revise recirculation piping in primary digester pumping room to minimize air/gas traps in the suction piping. • Relocate methane gas moisture separator for primary digester No. 1 to gas handling room. • Add recirculation piping and pump to secondary digesters. • Add gas storage covers to secondary digesters. • Prepare plans and specifications for the prepurchase of the digester mixers and covers. Contract shall be known as Digester Equipment Purchase." Yakiri Contract Amendment No.I November 15.1995 2 5. Add the following subtasks to subparagraph 1.4.1.3.3, Bar Screen, which read as follows: "• Design to include building and channel covers for odor control. • Add vortex type grit basins, grit cyclone, grit classifiers and grit storage hopper to design. • Separate recycled plant return flows from raw influent." 6. Add subparagraph 1.4.1.3.7 and 1.4.1.3.8 which read as follows: "1.4.1.3.7 Hazardous Materials Storage Building - Prepared plans and specifications for a building to meet National Fire Code and National Electric Code for storage of paints, oils, chemicals and consumable required for facility to function properly. 1.4.1.3.8 Nonpotable Water System Improvements - Prepare plans and specifications for improvements to C-2 water system to include increasing distribution pipe size, revising controls and modifying pumps as required." C. Paragraph 1.5 Bidding Phase- Prebid Services 1. Revise the first sentence to read as follows: "After written authorization to proceed with the Bidding Phase of each of the below listed projects: • Bar Screen and Grit Equipment Prepurchase, • Digester Equipment Prepurchase, • Electrical Maintenance Contract, • Mechanical Improvements, • Process Improvements, Engineer shall:" D. Paragraph 1.6 Construction Phase - Services During Construction 1. Add Paragraph 1.6.1 which reads as follows: "1.6.1 Construction Services for the following projects: • Bar Screen and Grit Equipment Prepurchase • Digester Equipment Prepurchase • Electrical Maintenance Contract • Mechanical Improvements • Process Improvements • SCADA System Improvements • Biosolids Removal" Yakima Contract Amendment No.l November 15.1995 3 E. Paragraph 1.7 Operational Phase 1. Add Mechanical Improvements to the list of projects. II. EXHIBIT B - PAYMENTS TO ENGINEER A. In subparagraph 1.1.1 delete the words "Nine Hundred Eighteen Thousand Seven Hundred Dollars (918,700)" and replace with the words "One million Eight Hundred Sixteen Thousand Seven Hundred Ten Dollars ($1,816,710)". B. In subparagraph 1.1.1.1 delete the words "Forty-eight Thousand Five Hundred Dollars ($48,500)" and replace with the words "Four Hundred Fifty dollars ($450). C. In subparagraph 1.1.1.2 replace subparagraph to read as follows: "1.1.1.2 The costs for SCADA System and Code Call Improvements, as described in Sections 1.2.1, 1.2.5.7, and 1.4.1.2 of EXHIBIT A, shall not exceed Sixty-five Thousand Dollars ($65,000) without written authorization from the CITY." D. Revise subparagraph 1.1.1.3 to read as follows: "1.1.1.3 Facility Plan Update costs, include the Technical Memorandums as described in Sections 1.2.2.2, 1.2.2.3,1.2.3,1.2.4,1.25.1 through 1.255, 1.2.5.11 through 1.2.5.13, the Facility Plan Update as described in Section 1.2.6 of EXHIBIT A and the heavy electrical maintenance contract described in subparagraph 1.4.1.6, shall not exceed Two Hundred Thirty-three Thousand Nine Hundred Dollars ($233,900) without written authorization from the CITY. The final costs of services associated with the Facility Plan Update will be adjusted after the urban growth boundaries for the Metropolitan Yakima area are determined, and the results of the industrial site and spray field studies are accepted by the CITY." E. Delete the costs in subparagraph 1.1.1.5, Project Financing, in its entirety. F. Revise the costs in subparagraph 1.1.1.6, Biosolids Removal, to read: "shall not exceed Sixty-eight Thousand One Hundred Sixty Dollars ($68,160). G. Revise subparagraph 1.1.1.7 to read as follows: "1.1.1.7 Costs for design services for the Process Improvements, as described Yakima Contract Amendment No.] November 15,1995 4 in Section 1.4.1.3, shall not exceed Five Hundred Sixty-two Thousand Five Hundred Dollars ($552,500) without written authorization from the CITY. H. Add subparagraph 1.1.1.8 which reads as follows: "1.1.1.8 Costs for services during construction for the Process Improvements, as described in Section 1.4.1.3, shall not exceed Six Hundred Seventy -Eve Thousand Seven Hundred Dollars ($675,700) without written authorization from the CITY, and are based on a 13 month construction duration. These costs may be adjusted if the construction duration is not 13 months." I. Add subparagraph 1.1.1.9 which reads as follows: "1.1.1.9 Costs for design services and services during construction for the tasks described in Sections 1.4.1.4 and 1.4.1.5 shall not exceed One Hundred Eleven Thousand Dollars ($111,000) without written authorization from the City. III. The terms, conditions, and covenants of performance set forth in the Agreement are amended as specifically set forth in this Amendment No. 1. On December 21, 1993, City Council authorized the City to enter into a contractual agreement for engineering services with the aforementioned engineering firm (Council Item 16, City Contract # 93-115, Resolution # R-93-146). The remaining elements found in the Projected Technical Scope of Work will be authorized through future contract amendment and Council approval." The moment has arrived for contract amendment and Council approval for engineering services required to move foreword on treatment facility improvements. A majority of the anticipated construction work rehabilitates the headworks and sludge digesters for proper operation, securing process capacity, and National Fire Code compliance. BOARD/COMMISSION RECOMMENDATION: COUNCIL ACTION: Resolution No. R-95-160 hdr contract arnerdment#1 November 16, 1995 cw Important pieces of equipment have been prepurchased and are on order for this work. The project has been adequately budgeted for in the 1995 and 1996 preliminary budgets with City Council approved PWTF financing and capital reserves. The total project is estimated to cost approximately $7 million. This amount includes all facets of the project budget consisting of design, bid, construction, construction administration, and start-up. Approximately $2 million has been committed to this project to date in equipment purchases and engineering services. This contract amendment authorizes additional design services to complete the preliminary work, bidding services for the major construction work forthcoming in 1996, and construction administration services necessary to ensure proper construction, quality installation and compliance with construction contract requirements. This request is coming to Council at this time because the last of key pieces of equipment necessary to shorten the construction schedule (thus contain overall costs significantly) have been ordered and delivery times known. The contract amendment adds $898,010 to the currently active agreement with HDR Engineering, Inc. for specific engineering services related to the upcoming construction contract. See the attached spreadsheet for cost and task outline summary. This is a "not to exceed", hourly per diem agreement. This means that, as opposed to "lump sum" style, line items not fully expended for a particular task are retained by the City. The original contract (#93-115) contained a series of work activities in addition to the treatment facility rehabilitation discussed above. Those items include but are not limited to the following highlights: •Biosolids lagoon cleaning contract development - project essentially complete. •Computer monitoring system improvements - project nearly complete. •Heavy Electrical maintenance contract development - complete and private contractor services engaged in 5 year contract. •Electrical Fault and Coordination Study - project complete. •Equipment Prepurchase services - task complete. •Mechanical Contract preparation and bid services - complete with contractor onsite constructing the required improvements (mainly heating pipe replacement). •Comprehensive Planning - HDR task deferred until such time as new or additional NPDES discharge requirements are known. However, other elements required for the development of the updated comprehensive plan have been addressed by others. The detailed orthophotographic work required to properly plan for sewer lines in the service area has been accomplished through a contract with CH2MHiIl in concert with the City's Information System.
