A RESOLUTION authorizing amendment of Resolution No. R-94-153 providing for
an interfund loan from the 551 -Equipment Rental Fund to the
333 -Law and Justice Capital Fund, and providing for
repayment.
WHEREAS, the Equipment Rental Fund has sufficient resources available for
investment to make the interfund loan authorized by Resolution R-94-153; and
WHEREAS, funds may be loaned as necessary to the 333 -Law & Justice
Capital Fund for cash flow requirements on construction of the Police/Legal Center;
and
WHEREAS, it is now necessary to extend the authority for the interfund loan
to include a portion of the purchase price of property at 210 South Second Street,
Yakima, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The purpose of the loan authorized to complete the Police Station/Legal Center
project, Resolution R-94-153, is amended to include the property at 210 South Second
treet. The interest rate shall be the current maturing three-year Treasury Note at
the time of each draw, and each draw on the loan shall be repaid, principal and
interest within three years of the borrowing date. Repayment shall be made from
Law and Justice Capital Funds and General Funds.
Further, the City Manager is hereby authorized to take all necessary and
prudent actions to complete the acquisition of the property at 210 South Second Street
and to enter into a Lease Agreement with the City/County Narcotics Unit, subject to
approval of all legal documents as to form by the City Attorney.

SUMMARY EXPLANATION:
Attached for Council approval is legislation necessary to complete the purchase transaction of property for
Police purposes at 210 South Second Street, Yakima;(Butler property). The authority to acquire the property
was previously given by Council in Executive Session in August of 1994.
The total acquisition cost ($210,000) was to be funded by the City ($110,000) and the City/County Narcotics
Unit (CCNU) ($100,000) with the City/County Narcotics (CCNU) portion representing future lease/rent
payments for use of the property for the next ten years. The building would be owned by the City at the end
of the lease term. At that time, if the CCNU were to continue use of the facility, a new lease/rent agreement
would be required.

is no need to conduct further environmental investigations of the property.
Upon Council approval of this report and corresponding legislation, the City Manager will take those
administrative steps necessary to close the purchase transaction and complete a lease agreement with the
City/County Narcotics Unit (CCNU).
