RESOLUTION NO. R-95 -
AN RESOLUTION providing for amendment of the Yakima Urban Area Boundary
by amendment of several intergovernmental agreements for
wastewater treatment and disposal, urban area planning, and the
Urban Area Comprehensive Plan
WHEREAS, over past several decades the City has cooperated with neighboring gov-
ernments and special purpose districts by entering into several agreements, which
establish a mutually agreed Yakima Urban Area Boundary, and which in some
instances, have been amended from time to time. Specifically, such agreements
include the 1977 Urban Yakima Regional Planning Agreement, the 1976 Agreement
for Wastewater Treatment and Disposal Service, and the 1981 Yakima Urban Area
Comprehensive Plan, and
WHEREAS, the owners of a 320 acre parcel (the "Subject Property") in the Terrace
Heights area have recently obtained approval and recommendation from the Yakima
Urban Area Joint Board and the Urban Yakima Regional Planning Commission, bodies
established under some of the above-mentioned agreements, that the Yakima Urban
Area Boundary should be amended to include the Subject Property, and
WHEREAS, the Yakima County Commissioners have approved amendment of the
Yakima Urban Area Boundary to include the Subject Property and have rezoned the
Subject Property to Single Family Residential zoning under the Urban Area Zoning
Ordinance, and
WHEREAS City Council further understands that the proposed change in the Urban
Area Boundary is not intended by any person or entity to have any substantive effect
on the terms or the City of Yakima's obligations under either 1977 Urban Yakima
Regional Planning Agreement, the 1976 Agreement for Wastewater Treatment and
Disposal Service, or the 1981 Yakima Urban Area Comprehensive Plan, and
WHEREAS, it is in the best interests of the people of the City of Yakima that the Urban
Area Boundary be amended to include the Subject Property, and that the above-men-
tioned agreements be amended accordingly, NOW, THEREFORE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF YAKIMA, WASHINGTON
The City of Yakima joins in amendment of the Urban Area Boundary to include the
Subject Property, which is legally described as
The north half of Section 15, Township 13 N , Range 19 E.W.M
by the following. actions
1 Amendment of the legal description of the Yakima Urban Area which is
Appendix A to the Urban Area Zoning Ordinance, Title 15 YMC, as provided on the
attached "Exhibit A" and as illustrated on the map entitled YAKIMA URBAN AREA as
provided on the attached "Exhibit B" both of which exhibits are incorporated herein
by reference
2 Amendment of the Agreement for Wastewater Treatment and Disposal Service,
as provided on the attached "Third Amendment to Agreement for Wastewater

incorporated herein by reference

Agreement" as provided on the attached "Exhibit D" and is incorporated herein by
reference
4 Amendment of the pamphlet entitled "The Yakima Urban Area Comprehensive
Plan" as it is made adopted as the official comprehensive plan for the city of Yakima
under YMC 1 42.070
The Mayor and City Clerk are hereby authorized to execute the aforementioned
amendments to the agreements intentified in paragraphs 2 and 3 above

THIS AGREEMENT entered into this o2c day of � St1995, by and between Yakima
County, a municipal corporation, the City of Yakima, a municipal corporation, the City of Union Gap, a
municipal corporation, and the Terrace Heights Sewer District, a municipal corporation for the purpose of
amending the "Urban Boundary" as set forth in EXHIBIT A of the AGREEMENT FOR WASTEWATER
TREATMENT AND DISPOSAL SERVICE.
WITNESSETH:
WHEREAS, on February 23, 1976, the parties of this Agreement entered into an AGREEMENT
FOR WASTEWATER TREATMENT AND DISPOSAL SERVICE: and
WHEREAS, Section 10 Subsection I Paragraph A of that Agreement refers to an EXHIBIT A which
designates and legally describes the "Urban Boundary" of the Yakima Urban Area; and
WHEREAS, Theodore Potter and Harold Gable have applied for an amendment of the "Urban
Boundary" in the manner provided by the Yakima Urban Area Comprehensive Plan; and
WHEREAS, the Regional Planning Commission recommends that the Urban Boundary be amended
to include the Potter/Gable property as depicted on the revised EXHIBIT A attached hereto; and
WHEREAS, the parties believe that it would be in the public interest to amend the "Urban
Boundary" as set forth in EXHIBIT A of the AGREEMENT FOR WASTEWATER TREATMENT AND
DISPOSAL SERVICE;
NOW, THEREFORE, the above-named municipalities do hereby mutually consent and agree to the
following:
1. That EXHIBIT A of the AGREEMENT FOR WASTEWATER TREATMENT AND
DISPOSAL SERVICE entered into February 2, 1976 between Yakima County, the City of
Yakima, the Town of Union Gap and the Terrace Heights Sewer District be amended to
include the following land in the "Urban Boundary:"
The north half of Section 15, Township 13 N., Range 19 E.W.M.
2. Except as herein provided for, the AGREEMENT FOR WASTEWATER TREATMENT
AND DISPOSAL SERVICE last amended in February, 1986 shall remain in full force and
effect.
3. This Amendment shall be recorded with the Yakima County Auditor.

FOURTH AMENDMENT TO THE URBAN YAKIMA
REGIONAL PLANNING AGREEMENT

THIS AGREEMENT entered into this day of CS20±--• , 1995, by and between Yakima
County, a municipal corporation, the City of Yakima, a municipal corporation, and the City of Union
Gap, a municipal corporation, for the purpose of amending the "Urban Boundary" as set forth in
EXHIBIT A of the URBAN YAKIMA REGIONAL PLANNING AGREEMENT.

YAKIMA REGIONAL PLANNING AGREEMENT; and

describes the "Urban Boundary" of the Yakima Urban Area; and
WHEREAS, Theodore Potter and Harold Gable have applied for an amendment of the "Urban

FOURTH AMENDMENT TO THE URBAN YAKIMA
REGIONAL PLANNING AGREEMENT

THIS AGREEMENT entered into this day of a%u. • , 1995, by and between Yakima
County, a municipal corporation, the City of Yakima, a municipal corporation, and the City of Union
Gap, a municipal corporation, for the purpose of amending the "Urban Boundary" as set forth in
EXHIBIT A of the URBAN YAKIMA REGIONAL PLANNING AGREEMENT.
WITNESSETH:
WHEREAS, on January 25, 1977, the parties of this Agreement entered into the URBAN
YAKIMA REGIONAL PLANNING AGREEMENT; and
WHEREAS, Section 5 of said Agreement refers to an EXHIBIT A which designates and legally
describes the "Urban Boundary" of the Yakima Urban Area; and
WHEREAS, Theodore Potter and Harold Gable have applied for an amendment of the "Urban
Boundary" in the manner provided by the Yakima Urban Area Comprehensive Plan; and
WHEREAS, the Regional Planning Commission recommends that the Urban Boundary be
amended to include the Potter/Gable property as depicted on the revised EXHIBIT A attached hereto;
and
WHEREAS, the parties believe that it would be in the public interest to amend the "Urban
Boundary" as set forth in EXHIBIT A of the URBAN YAKIMA REGIONAL PLANNING
AGREEMENT;
NOW, THEREFORE, the above-named municipalities do hereby mutually consent and agree to
the following:
1. That EXHIBIT A of the URBAN YAKIMA REGIONAL PLANNING AGREEMENT
entered into January 25, 1977 between Yakima County, the City of Yakima, and the
Town of Union Gap be amended to include the following land within the "Urban
Boundary:"
The north half of Section 15, Township 13 N., Range 19 E.W.M.
2. Except as herein provided for, the URBAN YAKIMA REGIONAL PLANNING
AGREEMENT last amended in February, 1986 shall remain in full force and effect.
3. This Amendment shall be recorded with the Yakima County Auditor.
4. This Amendment shall be in full force and effect and binding upon its execution.
